Agenda 05/24/2022 Item #16C 1 (CRA Donation Agreement w/collier county Housing Authority for installation of Welcome sign SR 29)05/24/2022 EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners, acting as the Community Redevelopment Agency Board (CRA), approve the Donation Agreement with the Collier County Housing Authority, for the acquisition of a Sign Easement necessary for the installation of a welcome sign on State Road 29 within the Immokalee Beautification MSTU boundaries acknowledging the Community of Immokalee, at a cost not to exceed $1,000. OBJECTIVE: To acquire a Sign Easement from the Collier County Housing Authority, (Authority) to facilitate the installation of welcome sign along Florida State Road 29 (Project). CONSIDERATIONS: The Immokalee Collier Community Redevelopment Area (ICRA) overlaps with the Immokalee Beautification Municipal Services Taxing Unit (MSTU) boundaries. ICRA staff manages the MSTU and the two entities coordinate and partner on initiatives to improve the community. The MSTU Advisory Committee desires to enhance and acknowledge the Community of Immokalee by placing a welcome sign and landscaping on State Road 29. The proposed location is just south of Farm Worker Way on the northbound side of State Road 29. The Sign Easement is approximately 384 square feet. In 2018, the MSTU approved a monument design from Q. Grady Minor & Associ ates, P.A. for a welcome sign located on SR 29 for a sign on the Panther Crossing Bridge. During plans review, the Florida Department of Transportation (FDOT) rejected the plan of erecting a sign on the pedestrian overpass and a new location was selected nearby at the Farm Worker’s Village on land owned by the Authority. The County’s Real Property Management Department commenced the acquisition process of a Sign Easement. In late 2020, the Authority had secured a mortgage with the United States of Ameri ca acting through the Rural Housing Service or successor agency, United States Department of Agriculture. Standard closing practice is to obtain a mortgage subordination prior to the recording of an easement for clear title. Given that the Lender is an agency of the Federal Government, there have been challenges obtaining the subordination. We have been informed that the Authority has paid a majority of its mortgage and that the risk of foreclosure of the property is very low. With this said, the attorney for the Authority along with the Real Property staff are continuing to pursue the subordination. The construction of this welcome monument sign has been on hold for the acquisition of the Sign Easement; and the MSTU desires to move forward on the construction of the welcome sign as soon as the easement can be recorded, and all required permits are received. FISCAL IMPACT: The total outlay should not exceed $1,000 (for title commitment, title policy and recording of documents). Funding is available in and is consistent with the Immokalee Beautification MSTU Fund (162). GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan standards to ensure the adequacy and availability of viable public facilities. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for approval. - RTT RECOMMENDATION: That the Board: 16.C.1 Packet Pg. 1005 05/24/2022 1. Approves and accepts the attached Donation Agreement, and Sign Easement with the Authority; 2. Authorizes the Chairman to execute the Donation Agreement, and any and all other County Attorney’s Office approved documents related to this transaction once they have been approved by the County Attorney’s Office; and 3. Directs the County Manager or his designee to proceed with the recording of the Sign Easement without the Subordination of Mortgage and to take all reasonable steps necessary to ensure performance under the Donation Agreement. Staff shall continue to pursue receipt of the Subordination from the Authority and upon receipt record the document to obtain clear title of the Sign Easement together with the issuance of a title insurance policy.
