EXECUTIVE SUMMARY
Recommendation to approve an agreement for the purchase of a perpetual, non-exclusive drainage
easement (Parcel 165DE) required for the construction and maintenance of a replacement
stormwater outfall pipe as part of the Poinciana Village Stormwater Improvement Project No.
50200. Estimated Fiscal Impact: $1,100. The funding source is Transportation Management
Services Department Stormwater Capital Fund 325.
OBJECTIVE: To acquire a drainage easement required for the construction and maintenance of a
replacement stormwater outfall pipe for the Poinciana Village Stormwater Improvement Project No.
50200 (the “Project”).
CONSIDERATIONS: Collier County is seeking to acquire Parcel 165DE, a perpetual non-exclusive
drainage easement, needed for the construction and maintenance of a replacement stormwater outfall pipe
as part of the Project. The attached agreement reflects a nominal compensation amount of $1,000 to
cover document review and administrative costs, in return for which the property owner, Riley Florida
Rentals, LLC, has agreed to convey this easement to the County. Staff recommends that the Board of
County Commissioners (the “Board”) approve the agreement.
FISCAL IMPACT: Funds in the amount of $1,100 will be required, being the compensation amount of
$1,000 and recording fees not to exceed $100. The funding source for the acquisition of the drainage
easement is Transportation Management Services Department Stormwater Capital Fund 325.
No maintenance costs are anticipated until such time as the Project is constructed.
GROWTH MANAGEMENT IMPACT: This action is consistent with the Stormwater Management
Sub-Element of the Collier County Growth Management Plan.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a
majority vote for Board approval. - DDP
. RECOMMENDATION: Approve the attached agreement and authorize the Chairman to execute
same on behalf of the Board;
. Accept the conveyance of Parcel 165DE and authorize the County Manager, or his designee, to record
the conveyance instrument in the public records of Collier County, Florida;
. Authorize the payment of all costs and expenses that Collier County is required to pay under the
terms of the easement agreement to close the transaction;
. Authorize the County Manager or his designee to take the necessary measures to ensure the County’s
performance in accordance with the terms and conditions of the easement agreement; and
. Authorize any, and all, budget amendments that may be required to carry out the collective will of the
Board.
