10 days prior to the Hearing. All materials used during presentation at the hearing will become a
permanent part of the record.
Any person who decides to appeal a decision of the Hearing Examiner will need a record of the
proceedings pertaining thereto, and therefore may need to ensure that a verbatim record of the
proceedings is made, which record includes the testimony and evidence upon which the appeal is to
be based. Decisions of the Hearing Examiner are final unless appealed to the Board of County
Commissioners.
Hearing Procedures will provide for presentation by the Applicant, presentation by staff, public
comment and applicant rebuttal. The Hearing Examiner will render a decision within 30 days.
Persons wishing to receive a copy of the decision by mail may supply County staff with their name,
address, and a stamped, self-addressed envelope for that purpose. Persons wishing to receive an

Although we have a one level home, we must view the beauty of the Gulf
through and around the Purse Dock and it's boat and now the two
proposed personal watercraft and their lift, which will extend 4' more feet in
width than the current dock, further obstructing our view. Our primary concern,
however, is not the obstruction of our view, but is for the Environment and our
responsibility to protect it from unnecessary growth and development. Hearing
Examiners and Planners also share this responsibility.
The allowable vessel footage for the 74.99 feet of waterfront at the Purse
property is not to exceed 50% of the waterfront footage. Even one personal
watercraft exceeds this limit by 2.5' and the proposed two watercraft exceed
what is allowable by 12.5', which is a 33.33% overage. We are privileged to be
in a conservancy, and we need to be good stewards of it. Regulations exist for a
reason, and environments and Ecco systems are destroyed one exception at a
time.
The Purse Petition fails to abide by the lineal vessel footage requirement. In
allowing for an exception such as this, it may be good to consider the impact of
allowing every petition such a variance. This is how growth and development
overwhelm the Environment.
We are privileged to live on Dolphin Circle where Dolphins actually swim by
everyday. We want to keep unnecessary development from encroaching on their
established habitat and from destroying our privilege of enjoying them.
The ingress and egress of vessels from the proposed dock at #2 Dolphin Circle
cuts through a long established path of Dolphins. They swim in to fish in the
area between the dock at #2 Dolphin Circle and the dock at #6 Dolphin Circle.
The requested 4' extension of the Purse Dock Petition cuts into this feeding
area, and the activity of launching and re-docking the two proposed personal
watercraft will be a disturbance for the Dolphins.
The Staff report states that in order for a petition to be accepted, only four of the
Secondary Criteria need to be met. This seems like a very minimal standard,
especially within a conservancy.
When a hurricane and old age destroyed our dock at #6 Dolphin Circle, we were
grandfathered in to rebuild on the old footprint. We purposely did not install a lift
and do not keep a boat or personal watercraft; we keep the dock free of
furniture and clutter, all in keeping with our commitment to the ecology and
values of a conservancy. We believe in keeping a minimal human footprint to
support and encourage the natural environment and its creatures. We hope this
commitment is shared by all property owners who are fortunate enough to have
waterfront property bordering a conservancy.
