Agenda 04/26/2022 Item #16C 4 (Lease Agreement w/Beraca Baptist Church, Inc. in Immokalee)04/26/2022 EXECUTIVE SUMMARY Recommendation to approve a Lease Agreement with Beraca Baptist Church, Inc., on behalf of the Community and Human Services Division for the Senior Nutrition Program in Immokalee. (Human Services Grant Fund 707) OBJECTIVE: To obtain approval and execution of a Lease Agreement (Lease) to allow the County to continue leasing space for the Senior Nutrition Program in Immokalee, Florida, currently administered by the Community and Human Services Division. CONSIDERATION: The Community and Human Services Division assumed operation of the Senior Nutrition Programs January 1, 2008. These programs are funded annually by the Older Americans Act Program Title III (OAA Title III). The funds from this grant were received by Collier County thr ough the Area Agency on Aging of Southwest Florida, Inc. The Board of County Commissioners approved and accepted the most recent grant from the Area Agency on Aging of Southwest Florida Inc. on February 22, 2022, 16D7. The current OAA Title III grant period was effective as of January 1, 2022 and will end on December 31, 2022. The grant funds pay for the operational expense such as staff, rent and utilities to operate the senior congregate meal site program under the Seniors Nutrition Program located at the Roberts Center in Immokalee, Florida. Since there were no County-owned buildings in the Immokalee area to accommodate the meal program, a Lease Agreement was presented to and approved by the Board of County Commissioners on April 22, 2008, under item 16 D 4, to lease 3,000 square feet in a building owned by Goodwill Industries of Southwest Florida, Inc. (Goodwill), located at 907 Roberts Avenue in Immokalee. More recently, as the County’s Lease was ready to expire, in December 2021, Goodwill’s property was under contract to be sold to Beraca Church, Inc. A new lease could not be processed until the property was conveyed to the new owner. Since that time, staff has been in discussions with the Church’s legal representative to finalize a new Lease which is being submitted under this agenda item. With the terms of the new Lease not as favorable to the County as the Lease with Goodwill, and with the dire need for this location, until such time staff can locate an alternative location for this operation, the Church has agreed to the County’s request to remain at the property on a month-to-month rental basis. The space will remain the same size, but the rent is increased by One Thousand Dollars ($1,000.00) per month, and the County will pay an additional Three Hundred Dollars ($300.00) per month for water and electrical use. FISCAL IMPACT: The monthly rent of Two Thousand Five Hundred Dollars ($2,500.00), and the monthly water/sewer and electrical expense of Three Hundred Dollars ($300.00), shall be withdrawn from funds available in Human Services Grant Fund (707), Project 33784 (C1). GROWTH MANAGEMENT: There is no growth management impact. LEGAL CONSIDERATION: This item has been reviewed by the County Attorney, is approved as to form and legality and requires a majority vote for Board approval. -JAK RECOMMENDATION: That the Board of County Commissioners approves the Lease Agreement with Beraca Church, Inc., and authorizes its Chairman to execute same.
