EXECUTIVE SUMMARY
Recommendation to approve Change Order #1 for Construction Agreement No. 20-7791 (the
“Agreement”), Vanderbilt Underground Utility Conversion Phase 4, with MasTec North America,
Inc., to increase the contract amount by $124,919.50 and adding 107 days to the project completion
date, due to the delays in coordination efforts with FPL and CenturyLink, and other issues
discovered during construction. (Vanderbilt Beach MSTU Fund 143)
OBJECTIVE: To ensure continuous construction services with MasTec for the final phase of the
Vanderbilt Beach Aerial to underground Utility Conversion project.
CONSIDERATIONS: On February 23, 2021 (agenda 11J), the Board awarded Agreement No. 20-7791
to MasTec North America to install and activate the FPL, CenturyLink, and Comcast utility conversion
network from aerial to underground for the Phase IV Vanderbilt Beach MSTU Utility Conversion Project
at a value of $1,765,869.40.
The County issued the Notice to Proceed on May 17, 2021. However, due to the COVID pandemic,
transportation and supply shortages, and increased product costs, the actual start of the work was delayed
until October 2021. During construction the project discovered underground conflicts, the contractor
experienced difficulty obtaining drilling crews, and the utility entities, FPL and Comcast, made
modifications that required different methods of installation than anticipated, all contributing to the
project delays. The additional time required to complete the project is projected to be 107 days. The
project modifications require additional material and the limited right -of-way in portions of the project
created challenges for the project. As an alternative construction method to the original contract, the
contactor proposes to perform a single bore to contain multiple conduits to minimize the conflict with the
other utilities in the area. These modifications is resulting in a cost increase of $124,919.50. The
additional funding will change the total value of the contract to $1,890,788.90.
The Vanderbilt Beach MSTU Advisory Board voted to recommend approval of this Change Order by a
vote of 5-0 on April 7, 2022. Staff reviewed the quoted additional work and services, compared it to
earlier bid items and similar work under the agreement, and has determined that the quoted work is
reasonable for the proposed additional services.
FISCAL IMPACT: Funding in the amount of $124,919.50 is available in Vanderbilt Beach MSTU
Fund (143) to cover the additional cost for this work.
GROWTH MANAGEMENT IMPACT: This item has no Growth Management Impact.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote
for Board approval. -SRT
RECOMMENDATION: The Board approve Change Order #1 for Construction Agreement No. 20-
7791, Vanderbilt Underground Utility Conversion Phase 4, with MasTec, North America Inc., to increase
the contract amount by $124,919.50 and adding 107 days to the project completion date (through and
including September 1, 2022), and authorize the Chairman to sign the attached Change Order.
