Agenda 04/12/2022 Item #16C 2 (Amended Utility Easement w/Foxfire Community Association)04/12/2022 EXECUTIVE SUMMARY Recommendation to approve the Amended Utility Easement, necessary to replace a portion of an existing Collier County Utility Easement with Foxfire Community Association of Collier County, Inc., a Florida not-for-profit corporation, associated with the construction of a new 2-story Cart Barn and Fitness Center at Foxfire Golf and Country Club Clubhouse, at no cost to the County. OBJECTIVE: To replace the existing utility easement which had previously been conveyed for access to utility facilities and for the County. CONSIDERATIONS: On July 24, 2012, Agenda Item #16C2, the Board accepted a Utility Easement for installation and maintenance of a monitoring well and for access at Foxfire Golf Course. The Utility Easement was recorded on July 31, 2012, in Official Records Book 4821, Page 3889, which conveyed access and utility facilities located within Foxfire Golf and Country Club (Foxfire) to the Board of County Commissioners of Collier County, Florida, as the Governing Board of the Collier County Water- Sewer District (County). The County has been monitoring many of the groundwater well sites within the county since the early 1990’s. Staff has developed a regional ground water monitoring plan as required by Section 3 of the Florida Department of Environmental Protection (FDEP) permits for both wastewater plants. Foxfire requires a portion of the existing Utility Easement, which is mainly for access to the monitoring wells, to be replaced due to the construction of the new 2-story cart barn and fitness center; however, Foxfire is conveying an Amended Utility Easement to replace a portion of the existing one. No utility facilities are being replaced, just access through their redesigned driveway and parking lot. FISCAL IMPACT: There are no fiscal impacts associated with this Executive Summary. Foxfire will be paying for the recording of the replacement Amended Utility Easement. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval - JAB RECOMMENDATION: To approve and authorize the Chairman to accept the Amended Utility Easement and to follow appropriate closing procedures and to record the Amended Utility Easement in the Public Records of Collier County, Florida.
