EXECUTIVE SUMMARY
Recommendation to approve and execute an Amendment to the Randall Curve Developer
Agreement in order to extend the timeframes in Section Four by ninety (90) days.
OBJECTIVE: To approve and execute the attached Amendment to Developer Agreement that extends
the due dates within Section Four by ninety (90) days.
CONSIDERATIONS: At the June 22, 2021, BCC meeting, the Board directed staff to work
with landowner, GM Advisors, LLC, to review and bring back for consideration a potential land
exchange agreement for the subject properties. The County’s parcel currently serves as
transportation right-of way supporting Immokalee Road and its associated water management
between Wilson Boulevard and Randall Boulevard.
The Board approved the Agreement with GM Advisors, LLC on November 9, 2021 and is
recorded at OR Book 6045, Page 1878, of the Public Records of Collier County, Florida.
The Developer has been working diligently with the South Florida Water Management District
(SFWMD) to have permits approved within six months of the Effective Date of the Agreement.
The Developer has requested a ninety-day extension of the due dates within Section Four. Both
Parties mutually agree to these changes.
Section Four would read as follows:
Schedule. Design of the New Improvements shall be completed no later than nine (9) six (6) months from
the Effective Date unless otherwise mutually agreed upon by the parties. Permitting of the New
Improvements shall be completed no later than fifteen (15) twelve (12) months from the Effective Date
unless otherwise mutually agreed upon by the parties. Construction of the New Improvements shall be
completed no later than two (2) years and three (3) months from the Effective Date, unless otherwise
mutually agreed upon by the parties.
All other Sections of the agreement remain the same.
FISCAL IMPACT: While there is no direct fiscal impact, all costs associated with the Developer
Agreement shall be born by GM Advisors, LLC.
GROWTH MANAGEMENT: This amendment is consistent with the County’s Growth Management
Plan.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority
vote for Board approval. - JAK
RECOMMENDATION: To approve the attached Amendment to Developer Agreement and authorize
the Chairman to execute the Amendment on behalf of the Board.
