EXECUTIVE SUMMARY
Request that the Board discuss whether we should direct staff to look into amending the Land
Development Code and/or the Noise Control Ordinance in order to lessen the impacts that
commercial developments have on abutting residential communities.
OBJECTIVE: To lessen the impacts commercial businesses have on abutting residential neighborhoods.
CONSIDERATIONS: The Land Development Code (LDC) currently requires general screening
standards for all zoning districts, including the requirement that loading areas, outdoor storage, trash
collection, mechanical equipment, and other service function areas be located “out of view” from adjacent
properties. Commercial activities by their nature produce more noise as a result of such activiti es, and
disproportionately impact abutting residential communities. However, there are currently no specific
regulations for where a commercial development abuts residential property, with a few exceptions,
including car washes and facilities with fuel pumps. For Planned Unit Developments (PUDs), the
Planning Commission and the Board have historically applied limitations and restrictions on locations of
dumpsters, hours of operation, and increased buffers where a commercial development abuts a residential
community, however, these types of conditions are beyond what is required by the LDC and are not
specifically incorporated in the LDC. In addition, the Noise Control Ordinance (Ord. 90 -17) provides for
certain hours of construction and other activities that may need to be addressed.
I would like to discuss with the Board whether we should direct staff to look into amending the LDC
and/or the Noise Control Ordinance to include specific regulations for commercial developments that abut
residential communities.
FISCAL IMPACT: None at this time.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal
issues at this time and requires majority vote for Board action. - JAK
RECOMMENDATION: For the Board to discuss whether we should direct staff to look into amending
the Land Development Code and/or the Noise Control Ordinance in order to lessen the impacts that
commercial developments have on abutting residential communities
