GEOGRAPHIC LOCATION: The subject property is located at 180 Pago Pago Drive West, further described as Lot 193, Isles of Capri No. 2, in Section 32, Township 51 South, Range 26 East. Collier County, Florida. (See location map on the following page) PURPOSE/DESCRIPTION OF PROJECT: The subject property is located within a Residential-Single Family – 3 (RSF-3) Zoning District and supports a single-family dwelling with 85± feet of water frontage on Johnson Bay. The scope of this project is limited to adding an additional 38.25 square feet of terminal dock area to the east side of an existing dock facility for a second boatlift to accommodate an additional 18-foot vessel; neither the additional deck area nor the additional vessel will result in a protrusion greater than that of the existing dock and the required 15-foot side setback will be maintained. The property is located within an ST overlay zone (Johnson Bay), which will require an ST-permit for the proposed docking facilities prior to issuance of the building permits. The proposed docking facilities will be constructed waterward of the existing seawalled shoreline and attached to an existing docking facility. The shoreline does not contain native vegetation. The submerged resources survey provided revealed the presence of a seagrass species called Paddle grass (Halophila decipiens) (Exhibit 4 of 4). The paddle grass is located approximately 4 feet southeast of the proposed dock and boatlift addition and will not be impacted. The paddle grass runs as a continuous bed into the submerged properties east and south of the subject docking facility. The Paddle grass location meets the description referenced in LDC (5.03.06 J.2): All proposed dock facilities shall be located and aligned to stay at least 10 feet from any existing seagrass beds, except where a continuous bed of seagrasses exists off the shore of the property and adjacent to the property, and to minimize negative impacts to seagrasses and other native shoreline, emergent and submerged vegetation, and hard bottom communities. The docking facility has been designed to minimize impacts to the existing seagrass. The installation of the dock and boatlift will be closer than 10 feet from the seagrass beds. Therefore, in accordance with LDC 5.03.06 J.3 the following design criteria are required: a. The dock shall be at least 2.2 feet NAVD. b. The terminal platform area of the dock shall not exceed 160 square feet. c. The access dock shall not exceed a width of 4 feet. d. The access dock and terminal platform shall be sited to impact the smallest area of seagrass beds possible. This project does not require an Environmental Advisory Council Board (EAC) review, because this project did not meet the EAC scope of land development project reviews as identified in Chapter 2, Article VIII, Division 23, Section 2-1193 of the Collier County Code of Laws and Ordinances. STAFF ANALYSIS: In accordance with LDC Section 5.03.06.H., the Collier County Hearing Examiner shall approve, approve with conditions, or deny a dock facility extension request based on certain criteria. In order for the Hearing Examiner to approve this request, at least four of the five primary criteria and four of the six secondary criteria must be met: Primary Criteria: 1. Whether the number of dock facilities and/or boat slips proposed is appropriate in relation to the waterfront length, location, upland land use and zoning of the subject property. Consideration should be made of property on unbridged barrier islands, where vessels are the primary means of transportation to and from the property. 3.A.a Packet Pg. 7 Attachment: Staff Report 02222022 (21434 : PL20200000220 BDE 404 Cristobal St Helsel Dock) BDE-PL20200000220 – 404 Cristobal St. Page 5 of 7 February 22, 2022 (The number should be appropriate; typical single-family use should be no more than two slips; typical multi-family use should be one slip per dwelling unit; in the case of unbridged barrier island docks, additional slips may be appropriate.) Criterion met. The subject property is located within an RSF-3 Zoning District and supports a single-family dwelling for which the LDC allows two boat slips. The proposed project consists of expanding the existing facility by adding an additional 38.25 square feet of terminal dock area to accommodate a second boatlift. 2. Whether the water depth at the proposed site is so shallow that a vessel of the general length, type and draft as that described in the petitioner’s application is unable to launch or moor at mean low tide (MLT). (The petitioner’s application and survey should establish that the water depth is too shallow to allow launching and mooring of the vessel(s) described without an extension.) Criterion met. The petitioner is not seeking any additional protrusion. This matter was addressed as part of the original Boat Dock Extension, BDE-PL20110000644; see Attachment C. 3. Whether the proposed dock facility may have an adverse impact on navigation within an adjacent marked or charted navigable channel. (The facility should not intrude into any marked or charted navigable channel thus impeding vessel traffic in the channel.) Criterion met. The proposed dock facility does not protrude into any marked or charted navigable channel and will not impede any vessel traffic. 4. Whether the proposed dock facility protrudes no more than 25 percent of the width of the waterway, and whether a minimum of 50 percent of the waterway width between dock facilities on either side is maintained for navigability. (The facility should maintain the required percentages.) Criterion not met. The waterway width at the subject location is 144± feet; therefore, the existing, previously approved, 39-foot dock facility accounts for 27.08% of the waterway’s width. It has been demonstrated that there will be 88 feet between the subject dock facility and that on the opposite shore, thus over 50% of the waterway width is open for navigation. 5. Whether the proposed location and design of the dock facility is such that the facility would not interfere with the use of neighboring docks. (The facility should not interfere with the use of legally permitted neighboring docks.) Criterion met. The proposed additional boatlift will not interfere with neighboring docks and satisfies required side setback requirements; additionally, it is within the agreed established riparian line; see Attachment D, Agreement Regarding Riparian Line. Secondary Criteria: 3.A.a Packet Pg. 8 Attachment: Staff Report 02222022 (21434 : PL20200000220 BDE 404 Cristobal St Helsel Dock) BDE-PL20200000220 – 404 Cristobal St. Page 6 of 7 February 22, 2022 1. Whether there are special conditions not involving water depth, related to the subject property or waterway, which justify the proposed dimensions and location of the proposed dock facility. (There must be at least one special condition related to the property; these may include type of shoreline reinforcement, shoreline configuration, mangrove growth, or seagrass beds.) Criterion met. This project constitutes an addition to an existing boat docking facility that was allowed pursuant to CCPC Resolution No. 12-08, adopted on September 6, 2012. The subject location is located at the end of a canal for which any other design would cause issues for neighboring properties. 2. Whether the proposed dock facility would allow reasonable, safe access to the vessel for loading/unloading and routine maintenance, without the use of excessive deck area not directly related to these functions. (The facility should not use excessive deck area.) Criterion met. There is no excessive deck area within the proposed dock design which is influenced by environmental concerns; specifically, a seagrass bed. The terminal platform area is less than the allowable 160 square feet, and the access walkway is limited to 4 feet in width. 3. For single-family dock facilities, whether the length of the vessel, or vessels in combination, described by the petitioner, exceeds 50 percent of the subject property’s linear waterfront footage. (The applicable maximum percentage should be maintained.) Criterion not met. The proposed dock facility has been designed to moor a 30-foot vessel and an 18-foot flats type boat, the combined total being 48 feet. The total shoreline at this location is 85± feet; therefore, the vessels will exceed 50 percent of the linear water frontage. 4. Whether the proposed facility would have a major impact on the waterfront view of neighboring property owners. (The facility should not have a major impact on the view of a neighboring property owner.) Criterion met. The subject dock facility is located entirely within the required side setbacks and satisfies an existing riparian agreement; see Attachment D – Agreement Regarding Riparian Line. As designed, no new impacts to neighboring property views of the waterway will result. 5. Whether seagrass beds will be impacted by the proposed dock facility. (If seagrass beds are present, compliance with subsection 5.03.06(I) of the LDC must be demonstrated.) Criterion met. Whether the proposed dock facility is subject to the manatee protection requirements of subsection 5.03.06(E)(11) of this Code. (If applicable, compliance with section 5.03.06(E)(11) must be demonstrated.) Criterion is not applicable. Criterion not applicable. The provisions of the Collier County Manatee Protection Plan do not apply to single-family dock facilities except for those within the seawalled basin of Port of the Islands; the subject property is not located within Port of the Islands. Staff analysis finds this request complies with four of the five of the primary criteria. With respect to the six secondary criteria, one of the criteria is found to be not applicable, the request meets four of the remaining five secondary criteria. APPEAL OF BOAT DOCK EXTENSION TO BOARD OF ZONING APPEALS: As to any boat dock extension petition upon which the Hearing Examiner takes action, an aggrieved petitioner may appeal such final action to the Board of County Commissioners. Such appeal shall be filed with the Growth Management Department Administrator within 30 days of the Decision by the Hearing Examiner. In the event that the petition has been approved by the Hearing Examiner, the applicant shall be advised that he/she proceeds with construction at his/her own risk during this 30-day period. Any construction work completed ahead of the approval authorization shall be at their own risk. STAFF RECOMMENDATION: Based on the above findings, staff recommends that the Hearing Examiner APPROVE Petition BDE-PL20200000220, to allow for the construction of the proposed dock facility as depicted within the plans contained in Attachment A. In order for the Hearing Examiner to approve the request, it must be determined that at least 4 of the 5 primary criteria, and at least 4 of the 6 secondary criteria, must be met. Whether or not the number of dock facilities and/or boat slips proposed is appropriate in relation to the waterfront length, location, upland land use, and zoning of the subject property; consideration should be made of property on unbridged barrier islands, where vessels are the primary means of transportation to and from the property. (The number should be appropriate; typical, single-family use should be no more than two slips; typical multi-family use should be one slip per dwelling unit; in the case of unbridged barrier island docks, additional slips may be appropriate.) 2. Whether or not the water depth at the proposed site is so shallow that a vessel of the general length, type, and draft as that described in the petitioner’s application is unable to launch or moor at mean low tide (MLT). (The petitioner’s application and survey should show that the water depth is too shallow to allow launch and mooring of the vessel (s) described without an extension.) 3. Whether or not the proposed dock facility may have an adverse impact on navigation within an adjacent marked or charted navigable channel. (The facility should not intrude into any marked or charted navigable channel thus impeding vessel traffic in the channel.) CONSISTENT—Proposed dock and lift does not protrude into any marked channel and there are no other navigational issues 4. Whether or not the proposed dock facility protrudes no more than 25 percent of the width of the waterway, and whether or not a minimum of 50 percent of the waterway width between dock facilities on either side of the waterway is maintained for navigability. (The facility should maintain the required percentages.) CONSISTENT – Existing dock facility protrudes approx. 24% at this time , proposed addition of a lift and terminal access area will not change protrusion 5. Whether or not the proposed location and design of the dock facility is such that the facility would not interfere with the use of neighboring docks. (The facility should not interfere with the use of legally permitted neighboring docks.) Consistent – Property is located near the end of a waterway and has limited water depth at Mean Low Tide due to shoreline configuration 2. (The facility should not use excessive deck area.) CONSISTENT- Every effort during design was made to have minimal impact on current footprint of docking facility, Proposed terminal area is the minimum required to provide reasonable safe access to proposed lift area, existing terminal area is 110.25 SFT and with the addition of the proposed 38.25 sft total terminal area would be 148.5 sft which will be 11.75 sft less than the typical 160 sft allowed 3. For single-family dock facilities, whether or not the length of the vessel, or vessels in combination, described by the petitioner exceeds 50 percent of the subject property’s linear waterfront footage. (The applicable maximum percentage should be maintained.) Does not meet criteria – Existing boat is 30’ and requested additional facility lift will be accommodating a 18’ flats type boat which results in 56.4% and exceeds the linear waterfront by 6.4% 4. Whether or not the proposed facility would have a major impact on the waterfront view of neighboring waterfront property owners. (The facility should not have a major impact on the view of either property owner.) Consistent – Proposed pilings and lift with boat will have no affect of the view of either property owner to the east or the west as it does not extend out past the current BDE in place and will not reach higher than the current permitted lift and boat. 6. (THA) has been contracted to provide environmental services in the form of a Submerged Resource Survey (SRS) at a property addressed as 404 Cristobal St. in Isle of Capri, FL 34113 and that can be identified by folio #52450080000. This survey will provide planning assistance to both the property owner and regulating agencies during any review processes for the proposed project, which consists of expanding on an existing private, single- family docking facility with a small amount of decking an additional boat lift. The subject property consists of a 0.23-acre parcel that can be found on the North end of Isle of Capri on a canal that connects to Johnson Bay. The parcel currently contains a single-family residence with a vertical seawall shoreline and a docking facility with a single lift covered by a canopy. The property is neighbored to the north, east, and west by single-family residences and to the south by state-owned submerged lands. Nearly all surrounding lots contain docking facilities (with boatlifts) similar in size and equal in function to that which is proposed. The SRS was conducted on Monday, February 24th, 2020 between approximately 8:30 and 10:00 a.m. Site conditions consisted of clear skies light winds. Water clarity was poor, allowing for submerged visibility of only 6 to 12 inches. The ambient air temperature ranged between approximately 67 and 73 degrees Fahrenheit and wind speeds averaged 5-10 mph out of the southwest. The average ambient water temperature was approximately 70 degrees Fahrenheit. Low tide occurred prior to the site visit at approximately 7:49 a.m. and reached approximately -0.3 ft. above the mean low water mark. Ordinarily, if seagrasses are present within the vicinity of a project area, an analysis will be required regarding species, percent coverage, and impacts projected by the proposed project. The presence of seagrasses may be ample cause for re- configuration of the design for projects over surface waters in order to minimize impacts. The general scope of work performed during a typical submerged resource survey is summarized below: • THA personnel will conduct a site visit and swim a series of transects within the project site in order to verify the location of any submerged resources. • THA personnel will identify submerged resources within the vicinity of the site and produce an estimate of the percent coverage of any resources found. • THA personnel will delineate the approximate limits of any submerged resources observed via a handheld GPS device. 3.A.e Packet Pg. 91 Attachment: Attachment D - Backup RMH (21434 : PL20200000220 BDE 404 Cristobal St Helsel Dock) 404 Cristobal St. (Folio #52450080000) Submerged Resource Survey February 2020 3 3 Methodology THA biologists intentionally designed the methodology of the SRS to cover not only the entire property shoreline for the proposed dock installation but also the area within 200 ft. of the proposed site. The components utilized for this survey included: • Reviewing aerial photography of the surveyed area. • Establishing survey transect lines (spaced approximately 10 feet apart) overlaid onto aerials. • Physically swimming the transects, GPS locating the limits of any submerged resources found, and determining the percent coverage within the area. • Documenting and photographing all findings The surveyed area was evaluated systematically by following the established transect lines throughout the project site as shown on the attached exhibit. Neighboring properties, docking facilities, and other landmarks provided reference markers which assisted in maintaining correct positioning over each transect. Ordinarily, if any resources are found, they are photographed, GPS located, delineated, and analyzed for percent coverage within the area via a half meter square quadrant. 3.A.e Packet Pg. 92 Attachment: Attachment D - Backup RMH (21434 : PL20200000220 BDE 404 Cristobal St Helsel Dock) 404 Cristobal St. (Folio #52450080000) Submerged Resource Survey February 2020 4 4 Results The substrate found within the surveyed area consists of silty muck with occasional shell debris, rocks, and macroalgae. The substrate appeared consistent throughout the project site to the limits of the survey area. Depths increased gradually with distance from the seawall to the limits of the survey from approximately 3 to 6 feet. The shoreline at the project site consists of a vertical seawall. As previously stated, there is a single docking facility present at the project site which consists of approximately 613 square feet of over water structure and which protrudes approximately 34 feet from the MHWL. The proposed expansion would add approximately 39 square feet of over-water structure and would not increase the maximum protrusion of the facility. No mangroves or other natural shoreline are present at the project site. During the submerged portion of the survey, a single species of seagrass was observed within the vicinity of the project site: paddle grass or Halophila decipiens. No other seagrasses, oysters (besides scattered oyster debris found on the seawall and dock piles), or other resources were observed in any capacity. The seagrasses present were not found within the footprint of the proposed structures. Accordingly, no impacts to submerged resources are expected to occur as the result of the proposed project. No other resources were observed besides oysters present on the seawall and dock piles. Neither oysters nor seagrass would be affected by the additional docking structures. Your intent to use a general permit has been reviewed by Department staff for three types of authorizations: (1) regulatory authorization, (2) proprietary authorization (related to state-owned submerged lands), and (3) federal authorization. Regulatory Review – APPROVED Based on the forms, drawings, and documents submitted with your notice, it appears that the project meets the requirements for the general Permit under Rule 62-330.427, Florida Administrative Code. Any activities performed under a general permit are subject to general conditions required in Rule 62-330.405, Florida Administrative Code (attached), and the specific conditions of Rule 62-330.427, Florida Administrative Code (attached). Any deviations from these conditions may subject the permittee to enforcement action and possible penalties. Proprietary Review – GRANTED The activity appears to be located on sovereign submerged lands owned by the Board of Trustees. The activity is not exempt from the need to obtain the applicable proprietary authorization. As staff to the Board of Trustees, the Department has reviewed the activity described above, and has determined that the activity qualifies activity qualifies for a letter of consent under Rule 18-21.005(1)(c), Florida Administrative Code, and Section 253.77 of the Florida Statutes to construct and use the activity on the specified sovereign submerged lands and as long as the work performed is located within the boundaries as described herein and is consistent with the terms and conditions herein. During this term of this Letter of consent you shall maintain satisfactory evidence of sufficient upland interest as required by paragraph 18-21.004(3)(b), Florida Administrative Code. If such interest is terminated or the Board of Trustees determines that such interest did not exist on the date of issuance of this Letter of Consent, this Letter of Consent may be terminated by the Board of Trustees at its sole option. If the Board of Trustees terminates this Letter of Consent, you agree not to assert a claim or defense against the Board of Trustees arising out of this Letter of Consent. Special Consent Conditions 1. This duty to indemnify and hold harmless will include any and all liabilities that are associated with the structure or activity including special assessments or taxes that are now or in the future assessed against the structure or activity during the period of the authorization. 2. Failure by the Board of Trustees to enforce any violation of a provision of the authorization or waiver by the Board of Trustees of any provision of the authorization will not invalidate the provision not enforced or waived, nor will the failure to enforce or a waiver prevent the Board of Trustees from enforcing the unenforced or waived provision in the event of a violation of that provision. 3. Applicant binds itself and its successors and assigns to abide by the provisions and conditions set forth in the authorization. If the applicant or its successors or assigns fails or refuses to comply with the provisions and conditions of the authorization, the authorization may be terminated by the Board of Trustees after written notice to the applicant or its successors or assigns. Upon receipt of such notice, the applicant or its successors or assigns will have thirty (30) days in which to correct the violations. Failure to correct the violations within this period will result in the automatic revocation of this authorization. 4. All costs incurred by the Board of Trustees in enforcing the terms and conditions of the authorization will be paid by the applicant. Any notice required by law will be made by certified mail at the address shown on page one of the authorization. The applicant will notify the Board of Trustees in writing of any change of address at least ten days before the change becomes effective. 5. This authorization does not allow any activity prohibited in a conservation easement or restrictive covenant that prohibits the activity. General Conditions for Authorizations for Activities All authorizations granted by rule or in writing under Rule 18-21.005, F.A.C., except those for geophysical testing, shall be subject to the general conditions as set forth in paragraphs (a) through (i) below. The general conditions shall be part of all authorizations under this chapter, shall be binding upon the grantee, and shall be enforceable under Chapter 253 or 258, Part II, F.S. (a) Authorizations are valid only for the specified activity or use. Any unauthorized deviation from the specified activity or use and the conditions for undertaking that activity or use shall constitute a violation. Violation of the authorization shall result in suspension or revocation of the grantee’s use of the sovereignty submerged land unless cured to the satisfaction of the Board. (d) Structures or activities shall be constructed and used to avoid or minimize adverse impacts to sovereignty submerged lands and resources. (e) Construction, use, or operation of the structure or activity shall not adversely affect any species which is endangered, threatened or of special concern, as listed in Rules 68A-27.003, 68A-27.004, and 68A-27.005, F.A.C. (f) Structures or activities shall not unreasonably interfere with riparian rights. When a court of competent jurisdiction determines that riparian rights have been unlawfully affected, the structure or activity shall be modified in accordance with the court’s decision. (g) Structures or activities shall not create a navigational hazard. (h) Structures shall be maintained in a functional condition and shall be repaired or removed if they become dilapidated to such an extent that they are no longer functional. This shall not be construed to prohibit the repair or replacement subject to the provisions of Rule 18- 21.005, F.A.C., within one year, of a structure damaged in a discrete event such as a storm, flood, accident, or fire. Structures or activities shall be constructed, operated, and maintained solely for water dependent purposes, or for non-water dependent activities. 3. Federal (SPGP) Review – NOT APPROVED Your proposed activity as outlined on your application and attached drawings does not qualify for Federal authorization pursuant to the State Programmatic General Permit and a SEPARATE permit or authorization shall be required from the Corps. You must apply separately to the Corps using their APPLICATION FOR DEPARTMENT OF THE ARMY PERMIT, ENG FORM 4345, or alternative as allowed by their regulations. The GMP does not address individual Variance requests but deals with the larger issue of the actual use. The existing single-family use is consistent with the FLUM of the GMP. The requested variance does not have any impact on this property's consistency with the County's GMP. ZONING DIVISION ANALYSIS: The decision to grant a variance is based on the criteria in LDC Section 9.04.03. Staff has analyzed this petition relative to these provisions and offers the following responses: a. Are there special conditions and circumstances existing, which are peculiar to the location, size and characteristics of the land, structure or building involved? Are there special conditions and circumstances, which d o not result from the action of the applicant such as pre-existing conditions relative to the property, which are the subject of the Variance request? Yes, the applicant’s pool contractor submitted a site plan to Collier County as part of the building permit process and said site plan was approved; unfortunately, the site plan depicted a standard lot whereas it is in fact a corner lot. The difference in lot types causes an encroachment issue along the east property line as a much larger setback is required for front yards as opposed to side yards. The typical rear yard reduction for listed accessory structures, including pools, is also not applicable as corner lots have no rear yard; said reduction is typically to 10 feet. c. Will a literal interpretation of the provisions of this zoning code work unnecessary and undue hardship on the applicant or create practical difficulties for the applicant? Yes, modifying the existing pool to comply with the required setback would be cost prohibitive. The requested variance is needed to bring the existing pool into compliance with setback requirements and will further allow for the residence to maintain a clear title in the event of sale. d. Will the Variance, if granted, be the minimum Variance that will make possible the reasonable use of the land, building or structure and which promote standards of health, safety and welfare? Yes, the Variance, if granted, is the minimum required to accommodate the existing pool. e. Will granting the Variance confer on the applicant any special privilege that is denied by these zoning regulations to other lands, buildings, or structures in the same zoning district? By definition, a Variance bestows some dimensional relief from the zoning regulations specific to a site. LDC Section 9.04.02 allows relief through the Variance process for any dimensional development standard. As such, other properties facing a similar hardship would be entitled to make a similar request and would be conferred equal consideration on a case by case basis. f. Will granting the Variance be in harmony with the general intent and purpose of this Land Development Code, and not be injurious to the neighborhood , or otherwise detrimental to the public welfare? Yes, the general purpose and intent of the LDC for residential single-family zoned districts is to promote lands for single-family housing in areas of low density. Yes, there is significant landscaping and a wood privacy fence along the east property line that will buffer any impacts from the pool with respect to peace and tranquility. h. Will granting the Variance be consistent with the Growth Management Plan? Yes, approval of this Variance will not affect or change the requirements of the GMP with respect to density, intensity, compatibility, access/connectivity, or any other applicable provisions. Zoning Staff has viewed the referenced Building Permit Application and is convinced the provided site plan was approved in error and that the existing pool was constructed as depicted within said site plan. All pertinent information pertaining to said permit is contained within Attachment C. ENVIRONMENTAL ADVISORY COUNCIL (EAC) RECOMMENDATION: The EAC does not normally hear variance petitions. Since the subject variance doesn’t impact any preserve area, the EAC did not hear this petition. CONCURRENT LAND USE APPLICATIONS: There are no concurrent land use applications under review at the present time PUBLIC NOTICE: Notice Requirements for Variance petitions are contained within LDC Section 10.03.06.F.2.
