Continue item 17C to the March 22, 2022 BCC Meeting: *** This item has been continued from the

being continued to the March 22, 2022 BCC Meeting. This item is the first of two hearings. ***
Recommendation to approve an Ordinance amending Ordinance number 04-41, as amended, the Collier
County Land Development Code, to change the name of the Bayshore Mixed Use Overlay District to the
Bayshore Zoning Overlay District and the name of the Gateway Triangle Mixed Use District to the Gateway
Triangle Zoning Overlay District, to rename the Bayshore Gateway Triangle Redevelopment Area to the
Bayshore Gateway Triangle Community Redevelopment Area; to add prohibited uses, add appearance
standards for outdoor display and storage, add a boundary map for the Bayshore Zoning Overlay District
and for the Gateway Triangle Zoning Overlay District, add architectural standards for single family homes,

Item 16A1 (PL#20210001222), the Bayshore proposed amendment to the Code of Laws to allow for enclosed
swales has been continued indefinitely, and based upon that continuance, Item 17C (PL#20210001222), the
general Bayshore LDC amendments are being continued to the March 22, 2022 BCC Hearing to remove
references to the swale enclosure proposed amendments.
16D9: The requested budget amendment is contingent on confirmation of final grant award.

EXECUTIVE SUMMARY
Recommendation to appoint a member to the Affordable Housing Advisory Committee.
OBJECTIVE: To appoint a member of the Collier County Planning Commission to the Affordable
Housing Advisory Committee, to a term expiring on October 1, 2023.
CONSIDERATIONS: This committee was created by Ordinance No. 91-65, as amended, which was
repealed and replaced by Ordinance No. 2013-27, which was further amended by Ordinance No. 2020-27.
The purpose of this 11 member committee as required and described by 420.9076 Fla. Stat. is to review
policies, procedures, ordinances, land development regulations, and the adopted local government
comprehensive plan, and to recommend specific actions or initiatives to encourage or facilitate affordable
housing. The committee is required to submit an annual report to the Board of County Commissioners
that includes recommendations on, and evaluates the implementation of, affordable housing incentives as
required by 420.9076(4) Fla. Stat. Terms are three years. A list of the current membership is included in
the backup.
Membership must consist of one elected official and ten citizens from at least six of the following
categories:
(a) One citizen who is actively engaged in the residential home building industry in co nnection
with affordable housing.
(b) One citizen who is actively engaged in the banking or mortgage banking industry in
connection with affordable housing.
(c) One citizen who is a representative of those areas of labor actively engaged in home building
in connection with affordable housing.
(d) One citizen who is actively engaged as an advocate for low-income persons in connection
with affordable housing.
(e) One citizen who is actively engaged as a for-profit provider of affordable housing.
(f) One citizen who is actively engaged as a not-for-profit provider of affordable housing.
(g) One citizen who is actively engaged as a real estate professional in connection with affordable
housing.
(h) One citizen who actively serves on the local planning agency pursuant to s. 163.3174.
(i) One citizen who resides within the jurisdiction of the local governing body making the
appointments.
(j) One citizen who represents employers within the jurisdiction.
(k) One citizen who represents essential services personnel, as defined in the local housing
assistance plan.
There is currently a vacancy on this committee. As noted above, F.S. 420.9076(2)h. allows for a
representative of the local planning agency to serve on the Affordable Housing Advisory Committee. The
Collier County Planning Commission (CCPC) recommends that Paul Shea be appointed as its
representative.

CCPC RECOMMENDATION: At its meeting on February 17, 2022, the CCPC voted unanimously to
recommend that Commissioner Paul Shea be appointed as its representative on the Affordable Housing
Advisory Committee, to fill the currently vacant term which expires on October 1, 2023.
FISCAL IMPACT: None.
GROWTH MANAGEMENT IMPACT: None.
RECOMMENDATION: That the Board of County Commissioners adopts the CCPC Recommendation,
and authorizes the Chair to execute the attached resolution confirming the appointment.

RESOLUTION NO. 2022 – ____
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, APPOINTING PAUL SHEA TO THE
AFFORDABLE HOUSING ADVISORY COMMITTEE.
WHEREAS, on July 31, 1991, the Board of County Commissioners adopted Ordinance No. 91-
65 establishing the Affordable Housing Advisory Committee; and
WHEREAS, Ordinance No. 91-65, as subsequently amended, on April 9, 2013 was repealed and
replaced by Ordinance No. 13-27, and further amended by Ordinance No. 20-27, which recreated and
reestablished the Affordable Housing Advisory Committee in accordance with F.S. § 420.9076. This
Advisory Committee consists of one elected official and ten citizen members appointed by the Board of
County Commissioners based on the membership categories described in F.S. § 420.9076(2)a.-k.; and
WHEREAS, there is a vacancy on this Advisory Committee; and
WHEREAS, the Board of County Commissioners previously provided public notice soliciting
applications from interested parties; and
WHEREAS, the Collier County Planning Commission has provided the Board of County
Commissioners with its recommendation for appointment.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, that PAUL SHEA (Local Planning Agency/CCPC, 420.9076(2)h.),
is hereby appointed to the Affordable Housing Advisory Committee, to fill the remainder of a vacant term
expiring on October 1, 2023.
