CESM Minutes 02/04/20221 February 4, 2022 MINUTES OF THE HEARING OF THE COLLIER COUNTY SPECIAL MAGISTRATE Naples, Florida, February 4, 2022 LET IT BE REMEMBERED the Collier County Special Magistrate, having conducted business herein, met on this date at 9:00 AM in REGULAR SESSION in Administrative Building F, 3rd floor, Collier County Government Complex, Naples, Florida, with the following persons present: SPECIAL MAGISTRATE: Honorable Brenda C. Neither Collier County nor the Special Magistrate shall be responsible for providing this record. I. CALL TO ORDER-SPECIAL MAGISTRATE BRENDA C. GARRETSON PRESIDING The Honorable Special Magistrate Brenda C. Garretson called the hearing to order at 9:03 a.m. All those testifying at the proceeding did so under oath. II. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was recited. Prior to conducting the hearing, respondents were given an opportunity to speak with Code Enforcement officers to work out a possible resolution by stipulation. MOTION FOR CONTINUANCE 3. CASE NO: CEN20220000628 OWNER: Naples 2.0 LLC OFFICER: Eric Short VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 54, Article IV, Section 54-92(b)(1). Readings from a calibrated sound level meter exceeded the allowable decibel level for an affected residentially zoned property set in Table 1, Section 54-92, Article IV Noise, of the Collier County Code of Laws and Ordinances. Ops Manager Davidson said she believed the Special Magistrate had granted a motion for a continuance, but the Respondent’s attorney and the County believe it would be cleaner if the motion was placed on the record and followed up with a written order. Special Magistrate Garretson agreed it would be cleaner. She said the Respondent’s attorney has a hearing today in Circuit Court and cannot make it to this hearing. She noted that Circuit Court hearings take precedence over hearings in this court. She granted the motion for continuance. Ops Manager Davidson asked if it was for a 30-day continuance. Special Magistrate Garretson said Ms. Davidson advised her that the County Attorney objected to a 60-day continuance due to the nature of the violation, noise complaints. She added that if the Respondent’s attorney cannot finish discovery within 30 days, by March 4, 2022, he can request an extension. B. MOTION FOR EXTENSION OF TIME None C. Fence erected on the property without first obtaining a Collier County building permit. FOLIO NO: 54050680002 ADDRESS: 3915 Estero Bay LN, Naples, FL 34112 4 February 4, 2022 Investigator Tony Asaro requested the hearing. The Hanrahans were not present. The stipulation was entered into by Vivian and Travis Hanrahan on Feb. 1, 2022. Special Magistrate Garretson accepted the stipulation and ordered the respondents to: 1. Pay operational costs in the amount of $111.70 incurred in the prosecution of this case on or before April 1. 2. Abate all violations by obtaining all required Collier County building permit(s) or a demolition permit, inspections, and Certificate of Completion/Occupancy for the unpermitted fence within 90 days of this hearing, by May 4, or a fine of $100 per day will be imposed for each day the violation continues. 3. Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request that the investigator perform a site inspection to confirm compliance. (That notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday, Sunday or legal holiday, then the notification must be made on the next day that is not a Saturday, Sunday or legal holiday.) 4. Non-permitted roof- over on an existing mobile home and a non-permitted covered front porch erected on improved occupied residential property. FOLIO NO: 00062600008 ADDRESS: 5010 Lake Trafford RD, Immokalee, FL 34142 Investigator John Connetta requested the hearing and represented the county. The Ramirezes were not present. A stipulation was entered into by Esteban Ramirez Jr. on Feb. 3, 2022. Special Magistrate Garretson accepted the stipulation and ordered Mr. Ramirez to: 1. Pay operational costs in the amount of $111.70 incurred in the prosecution of this case within 30 days of this hearing, on or before March 4, 2022. 2. Removal of native vegetation and/or prohibited exotics from unimproved estate zoned property using heavy machinery without first obtaining approval from the Florida Department of Environmental Protection and required Collier County permits. FOLIO NO: 41442960000 ADDRESS: 4344 32nd Ave. SE, Naples, FL 34117 Investigator McGonagle requested the hearing and represented the county. Mr. Nikita John VonKravcik represented the respondent. A stipulation was entered into by Thammasen C. Kanokwan (signed) on Feb. 4, 2022. Mr. VonKravcik testified he can’t work on the driveway now. Investigator McGonagle told him he can’t do anything until he obtains a vegetation permit and can’t work on the driveway until that permit is approved. Special Magistrate Garretson found the respondent in violation of the ordinance, accepted the stipulation and ordered the respondent to: 1. Pay operational costs in the amount of $111.70 incurred in the prosecution of this case within 30 days of this hearing, on or before March 4, 2022. 2. Abate all violations by obtaining all required Collier County approved mitigation plans, building permit(s), inspections, and Certificates of Completion/Occupancy to either keep the unpermitted improvement of the property as is, or to restore the property to its original permitted condition within 180 days of this hearing, on or before August 4, 2022, or a fine of 6 February 4, 2022 $100 per day will be imposed until the violation is abated. 3. Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request that the Investigator perform a site inspection to confirm compliance. (That notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday, Sunday or legal holiday, then the notification must be made on the next day that is not a Saturday, Sunday or legal holiday.) 4. If the Respondent fails to abate the violation, the County may abate the violation using any method to bring the violation into compliance and may use the assistance of the Collier County Sheriff’s Office to enforce the provisions of this agreement, and all costs of abatement shall be assessed to the property owner. Mr. VonKravcik apologized and said he thought he could do what he wanted. He wasn’t aware of the rules and thought only the City of Naples had rules. Thammasen OFFICER: Michele McGonagle VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 110, Article II, Section 110-31(a). Collier County Land Development Code 04-41, as amended, Sections 10.02.06(B)(1)(a), 10.02.06(B)(1)(e) and 10.02.06(B)(1)(e)(i). Added culvert pipe and dirt in the right of way without obtaining required Collier County permits. FOLIO NO: 41442960000 ADDRESS: 4344 32nd Ave. SE, Naples, FL 34117 Investigator McGonagle requested the hearing and represented the county. Mr. Nikita John VonKravcik represented the respondent. A stipulation was entered into by Thammasen C. Kanokwan (signature on stipulation) on Feb. 4, 2022. Special Magistrate Garretson found the respondent in violation of the ordinance, accepted the stipulation and ordered the respondent to: 1. Pay operational costs in the amount of $111.75 incurred in the prosecution of this case within 30 days of this hearing, on or before March 4, 2022. 2. Abate all violations by obtaining all required Collier County Permit(s) or Demolition Permit, inspections, and Certificate of Completion/Occupancy for the unpermitted culvert pipe and dirt OR remove all offending material and restore the right-of-way to its original permitted condition within 60 days of this hearing on or before April 4, 2022, or a fine of $100 per day 7 February 4, 2022 will be imposed until the violation is abated. 3. Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request the Investigator perform a site inspection to confirm compliance. (That notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday, Sunday or legal holiday, then the notification must be made on the next day that is not a Saturday, Sunday or legal holiday.) 4. An unlicensed/inoperable vehicle on improved residential property. FOLIO NO: 62781480000 ADDRESS: 805 99th Ave. N., Naples, FL 34108 Investigator Lopez-Silvero requested the hearing and represented the county. Ms. Kessler was not present. A stipulation was entered into by Kathryn Kessler on Feb. 4, 2022. Special Magistrate Garretson accepted the stipulation and ordered Ms. Kessler to: 1. Pay operational costs in the amount of $111.70 incurred in the prosecution of this case within 30 days of this hearing, on or before March 4, 2022. 2. Abate all violations by Obtaining and affixing a current valid license plate to each vehicle not stored within the confines of a completely enclosed structure and/or must repair defects so vehicle is immediately operable or remove offending vehicle(s) from residential property within seven days of this hearing, on or before February 11, 2022 or a fine of $50 per day will be imposed until the violation is abated. 3. Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request the Investigator perform a site inspection to confirm compliance. (That notice shall be by phone or fax and made during the workweek. Vehicles parked on the grass. FOLIO: 49582000000 ADDRESS: 51 Derhenson Drive, Naples, FL 34114 Date of Hearing Notice by Certified Mail: Jan. 14, 2022 Date of Hearing Notice Property/Courthouse Posting: Jan. 14, 2022 The respondent was not present. Investigator Thomas Pitura represented the County. Complainant James Clark is a neighbor of the respondent. Evidence Entered: Composite Exhibit A – Three photos taken on Nov. 29, 2021. Composite Exhibit B – Five photos taken on Dec. 22, 2021. Exhibit C – An aerial photo Investigator Pitura testified that:  Service was given on Nov. 30, 2021.  This has been a recurring violation.  There have been four other violations in the past five years: March 2016, July 2017, January 2019, and September 2021.  There are usually two or three cars parked on the grass, a violation.  The gate is locked most of the time and there have been numerous attempts to contact the owner.  During the Feb. 3, 2022, prehearing inspection, the cars were not parked on the grass, but this is a recurring violation, and the county is asking the court to recognize the violation.  Cars are more likely parked in the evening than during the day, but it’s hit or miss. Complainant James Clark testified that:  He lives across the street, at 1 Derhenson Drive, and he witnesses continued disregard for the ordinances in many ways besides this.  Cars are there all the time, this morning and every day.  Many neighbors are upset, but he’s the only one at the hearing today.  Neighbors want it to stop.  He said he has 50-60 photos of evidence of violations, if the county needs them. Special Magistrate Garretson noted that respondents often stop violating but violate again if they think no one is watching. 9 February 4, 2022 Finding the notice of hearing was properly served, Special Magistrate Garretson issued a finding of fact that the respondent was IN VIOLATION of the referenced ordinance at the time a notice of violation was issued for the recurring violation of parking on the grass and ordered the respondent to pay $111.65 in operations costs incurred in the prosecution of this case within 30 days, on or before March 4, 2022, and to abate all violations or penalties will increase. Expired right of way permit number PRROW2014082232; Right-of- way and driveway entry in disrepair on improved Estates- zoned parcel. FOLIO NO: 37987760009 ADDRESS: 3610 White Blvd., Naples, FL 34117 Mr. Mendez was present. Supervisor Cristina Perez represented the county. Supervisor Perez testified that:  An order of violation was issued on Oct. 2, 2020.  On June 4, 2021, the Special Magistrate granted a continuance to July 2, 2021.  On September 3, 2021, the Special Magistrate granted a continuance to November 5, 2021, And suspended the accrual of fines for the sixty-day period.  On November 5, 2021, the Special Magistrate granted a continuance to January 7, 2022.  The violation has been abated.  Prior operations costs of $111.80 were paid. Mr. Mendez testified that:  A different inspector came to his property and found the violation had been abated. Fine Amount: $100/day 10 February 4, 2022 Duration: 396 days Total Fine Amount: $39,600 Operational Costs: $111.80 Total to Date: $39,711.80 Special Magistrate Garretson DENIED the county’s motion for fines and operating costs, citing the abatement. Mr. Mendez asked if he still had to pay today’s operational costs. Special Magistrate said he did not have to because he’s now in compliance and that was his reward. 2. CASE NO: CELU20210010147 OWNER: Jeffery M Stone and Kelsey Edwards OFFICER: Thomas Pitura VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 54, Article VI, Section 54-179 and Collier County Land Development Code 04-41, as amended Section 2.02.03. Outside storage and/or litter consisting of, but not limited to, a car seat cover, wood, moving carts and bicycles. Investigator Migal testified that:  On Nov. 5, 2021, the Special Magistrate issued a Finding of Fact, Conclusion of Law and Order.  The Respondent was found in violation of the referenced ordinances and ordered to correct the violations.  The violation has not been abated as of Feb. 4, 2022. 14 February 4, 2022 Part C of the Order Fine Amount: $250/day Duration: 84 days (Nov. 13, 2021-Feb. 4, 2022) Total Fine Amount: $21,000 Part D of the Order Fine Amount: $250 per day Duration: 61 days (Dec. 6, 2021-Feb. 4, 2022) Total Fine Amount: $15,250 Previously Assessed Operational Costs: $111.70 Operational Costs for Today’s Hearing: $111.75 Total Amount to date: $36,473.45 Special Magistrate Garretson noted that the state statute involved, the Florida Building Code, was adopted by Collier County and that there has been no abatement of the violation. Finding the Notice of Hearing was properly served, the Special Magistrate GRANTED the County’s Motion for Imposition of Fines and Operational Costs for a total amount due of $36,473.45.
