MINUTES OF THE HEARING OF THE
COLLIER COUNTY SPECIAL MAGISTRATE
Naples, Florida, February 4, 2022
LET IT BE REMEMBERED the Collier County Special Magistrate,
having conducted business herein, met on this date at 9:00 AM in
REGULAR SESSION in Administrative Building F, 3rd floor, Collier
County Government Complex, Naples, Florida, with the following
persons present:

Any person who decides to appeal a decision of the Special Magistrate will need a record of the
proceedings pertaining thereto, and therefore may need to ensure that a verbatim record of the
proceedings is made, which record includes the testimony and evidence upon which an appeal is
to be based. Neither Collier County nor the Special Magistrate shall be responsible for providing
this record.
I. CALL TO ORDER-SPECIAL MAGISTRATE BRENDA C. GARRETSON PRESIDING
The Honorable Special Magistrate Brenda C. Garretson called the hearing to order at 9:03 a.m.
All those testifying at the proceeding did so under oath.
II. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was recited.
Prior to conducting the hearing, respondents were given an opportunity to speak with
Code Enforcement officers to work out a possible resolution by stipulation. The goal is to
obtain compliance without punitive actions.

sound level meter exceeded the allowable decibel level for
an affected residentially zoned property set in Table 1,
Section 54-92, Article IV Noise, of the Collier County Code
of Laws and Ordinances.

Ops Manager Davidson said she believed the Special Magistrate had granted a motion for a
continuance, but the Respondent’s attorney and the County believe it would be cleaner if the

Special Magistrate Garretson agreed it would be cleaner. She said the Respondent’s attorney
has a hearing today in Circuit Court and cannot make it to this hearing. She noted that Circuit
Court hearings take precedence over hearings in this court. She granted the motion for
continuance.
Ops Manager Davidson asked if it was for a 30-day continuance.
Special Magistrate Garretson said Ms. Davidson advised her that the County Attorney
objected to a 60-day continuance due to the nature of the violation, noise complaints. She
added that if the Respondent’s attorney cannot finish discovery within 30 days, by March 4,
2022, he can request an extension.

Mr. Nikita John VonKravcik represented the respondent.
A stipulation was entered into by Thammasen C. Kanokwan (signed) on Feb. 4, 2022.
Mr. VonKravcik testified he can’t work on the driveway now.
Investigator McGonagle told him he can’t do anything until he obtains a vegetation permit
and can’t work on the driveway until that permit is approved.
Special Magistrate Garretson found the respondent in violation of the ordinance,
accepted the stipulation and ordered the respondent to:
1. Pay operational costs in the amount of $111.70 incurred in the prosecution of this
case within 30 days of this hearing, on or before March 4, 2022.
2. Abate all violations by obtaining all required Collier County approved mitigation
plans, building permit(s), inspections, and Certificates of Completion/Occupancy to
either keep the unpermitted improvement of the property as is, or to restore the
property to its original permitted condition within 180 days of this hearing, on or before
August 4, 2022, or a fine of

$100 per day will be imposed until the violation is abated.
3. Respondent must notify Code Enforcement within 24 hours of abatement of the
violation and request that the Investigator perform a site inspection to confirm
compliance. (That notice shall be by phone or fax and made during the workweek. If the
violation is abated 24 hours prior to a Saturday, Sunday or legal holiday, then the
notification must be made on the next day that is not a Saturday, Sunday or legal holiday.)
4. If the Respondent fails to abate the violation, the County may abate the violation using any

Mr. VonKravcik apologized and said he thought he could do what he wanted. He wasn’t
aware of the rules and thought only the City of Naples had rules. He said he’d fix the violation
as soon as possible.

culvert pipe and dirt OR remove all offending material and restore the right-of-way to
its original permitted condition within 60 days of this hearing on or before April 4,
2022, or a fine of $100 per day

Investigator Pitura testified that:
Service was given on Nov. 30, 2021.
This has been a recurring violation.
There have been four other violations in the past five years: March 2016, July 2017,
January 2019, and September 2021.
There are usually two or three cars parked on the grass, a violation.
The gate is locked most of the time and there have been numerous attempts to contact the
owner.
During the Feb. 3, 2022, prehearing inspection, the cars were not parked on the grass, but
this is a recurring violation, and the county is asking the court to recognize the violation.
Cars are more likely parked in the evening than during the day, but it’s hit or miss.
Complainant James Clark testified that:
He lives across the street, at 1 Derhenson Drive, and he witnesses continued disregard for
the ordinances in many ways besides this.
Cars are there all the time, this morning and every day.
Many neighbors are upset, but he’s the only one at the hearing today.
Neighbors want it to stop.
He said he has 50-60 photos of evidence of violations, if the county needs them.
Special Magistrate Garretson noted that respondents often stop violating but violate again if they
think no one is watching.

Finding the notice of hearing was properly served, Special Magistrate Garretson issued a
finding of fact that the respondent was IN VIOLATION of the referenced ordinance at the
time a notice of violation was issued for the recurring violation of parking on the grass
and ordered the respondent to pay $111.65 in operations costs incurred in the prosecution
of this case within 30 days, on or before March 4, 2022, and to abate all violations or
penalties will increase.

And suspended the accrual of fines for the sixty-day period.
On November 5, 2021, the Special Magistrate granted a continuance to January 7, 2022.
The violation has been abated.
Prior operations costs of $111.80 were paid.
Mr. Mendez testified that:
A different inspector came to his property and found the violation had been abated.

Special Magistrate Garretson noted that the state statute involved, the Florida Building
Code, was adopted by Collier County and that there has been no abatement of the violation.

$36,473.45. That amount will become a lien on the property, with fines continuing to
accrue.

Code Enforcement Supervisor Cristina Perez testified that Mr. Misener had been here
earlier and spoke to Code Enforcement officers, but he wants to pursue a different avenue
toward resolving the violation. She told him it wasn’t up to Code Enforcement at this point,
and he needed to speak to staff. She told him to request a continuance, but he left.
