Agenda 02/22/2022 Item #16D6 (Prestige Home Centers Amendment #5 and Reinstatement)02/22/2022 EXECUTIVE SUMMARY Recommendation to approve and authorize the Chairman to sign the Reinstatement and Fifth Amendment between Collier County and Prestige Home Centers, Inc., for the Demolition and/or Replacement of Manufactured Housing program to extend the term and revise agreement language. (SHIP Grant Fund 791) OBJECTIVE: To continue to promote affordable housing strategies for low- to moderate-income persons through the State Housing Initiatives Partnership Program (SHIP). CONSIDERATIONS: The William E. Sadowski Affordable Housing Act provides funding to local communities to promote and advance affordable housing initiatives. Funds are generated through documentary stamp tax on real estate transactions. Under the SHIP Program, Collier County and the City of Naples receive funds from the State of Florida through the Florida Housing Finance Corporation (FHFC) to undertake eligible activities. On May 8, 2018, Agenda Item #16D8, the Board of County Commissioners (Board) approved the Agreement with Prestige Home Centers, Inc. (Prestige) for site-built manufactured housing. The first amendment was approved on August 14, 2018, Agenda Item #16D2. The amendment included additional terminology, added agreement language, and clarified allowable expenditures. The second amendment was approved on October 23, 2018, Agenda Item #16D5. The amendment included additional terminology, increased funding, and added additional allowable activities. The third amendment was approved on April 9, 2019, Agenda Item #16D8. The amendment allowed for partial payments and language was added to change the Financial and Compliance Reporting to 180 days after end of the fiscal year. The fourth amendment was approved on July 13, 2021, Agenda Item #16D13. The amendment extended the agreement term to November 30, 2021, increased the price list for a housing unit to match current market pricing, and increased the award to allow Prestige to complete the project. The proposed fifth amendment allows for an award of up to $150,000 per unit and no longer separates the unit (house) cost from ancillary costs. The $150,000 award is also consistent with the 2019 -2022 Local Housing Assistance Plan (LHAP) Demolition /Replacement Strategy. This action also includes the reinstatement of the agreement. This action is necessary as a result of a housing unit being installed exceeding the per-unit cost of $75,000 per the agreement which conflicts with the adopted LHAP. The homeowner required an Americans with Disabilities Act (ADA) unit. The additional cost for the unit to meet ADA standards exceeded the per-unit cost and could not be considered ancillary per the agreement. The unit was completed and received the Certificate of Occupancy on December 10, 2021, at which time the expenditure deadline was met. The remaining ADA external improvements (wheelchair ramp, carport, shed, and driveway) are additional expenses, but will not exceed the total allowable unit cost. The Reinstated and Fifth Amendment is to retroactively reinstate and extend the agreement to June 30, 2023. The additional time will allow for any unforeseen material delays related to the COVID-19 pandemic. FISCAL IMPACT: The proposed action has no Fiscal impact. The funding source for this grant is Florida Housing Finance Corporation. Funds are budgeted in the SHIP Grant Fund (791), Projects 33467 and 33525, 33569, and 33686.
