Agenda 02/22/2022 Item #16D4 (5-Year Renewal of Agreement w/Conservancy of SWFL)02/22/2022 EXECUTIVE SUMMARY Recommendation to approve a 5-year renewal of an agreement with the Conservancy of Southwest Florida allowing it to continue to provide environmental education programs at Collier County managed and operated beach park facilities. (General Fund 001) OBJECTIVE: To provide for and enhance the visitor experience at Collier County beach park facilities by entering into an agreement with the Conservancy of Southwest Florida in order to provide environmental education programs to park visitors. CONSIDERATIONS: On January 24, 2017, the Board of County Commissioners (Board) entered into a 5-year agreement with the Conservancy of Southwest Florida. The agreement has worked well for the county, and both parties find it advantageous to renew the agreement. The agreement permits the renewal of the agreement for a single additional 5-year term. Either party may terminate without cause by providing written notice thirty days in advance of termination. The Parks and Recreation Division and the Conservancy of Southwest Florida have determined and mutually agree that it is economically advantageous and in the best interest of the public to continue to deliver high quality, best-value, public services, programs, and facilities. The proposed agreement memorializes the arrangement. The agreement requires that the Conservancy provide the County Manager or his designee with an annual schedule of the programs it proposes to conduct at the County park facilities. The schedule for each calendar year shall be provided on or before the prior October 1 for review and approval by the County Manager or his designee. Any licensing, permitting, or other fees for any activities, events, and/or the programs shall be paid by the Conservancy. The agreement also requires fees and charges, including beach parking fees, for the public participating in the Conservancy sponsored programs at the County park facilities to be in accordance with the Collier County Parks and Recreation Department Facilities and Outdoor Areas License and Fee Policy Resolution No. 2021-263 or as it may be amended (which is the successor Fee Policy to Resolution 2015- 240 referenced in the original agreement). Participants will pay the $10 parking fee or present a County beach parking permit on their vehicle. FISCAL IMPACT: There is no significant fiscal impact associated with this item. Fees collected in accordance with Resolution No. 2021-263 will be deposited within the appropriate Parks Division cost center within General Fund (001). GROWTH MANAGEMENT IMPACT: There is no Growth Management impact.
