02/22/2022 EXECUTIVE SUMMARY Recommendation to adopt a Resolution to hold a public hearing to consider vacating the 100-foot right-of-way and easement, described as Tract “G”, as recorded in Deed Book 23, Page 47 of the Public Records of Collier County, Florida, located in Sections 23 and 24, Township 48 South, Range 28 East, Collier County, Florida (PL20210002017). _____________________________________________________________________________________ OBJECTIVE: Pursuant to sections 336.09 and 336.10, Florida Statutes, and Resolution No. 2013-166, the Board of County Commissioners must authorize a public hearing to consider the vacation of a portion of any type of public road right-of-way. CONSIDERATIONS: The Development Review Division has received a request from Fr ancesca Passidomo, Esq., of Coleman Yovanovich & Koester, P.A., as agent for the property owner. This request is to vacate the 100-foot right-of-way and easement, described as Tract “G”, as recorded in Deed Book 23, Page 47 of the public records of Collier County, Florida, located in Sections 23 and 24, Township 48 South, Range 28 East, Immokalee, Collier County, Florida. This Application for Vacating proposes to vacate the 100-foot right-of-way and easement described as Tract “G” in Agreement recorded in Deed Book 23, Page 47, of the Public Records of Collier County, Florida (the “100-foot right-of-way and easement”) to accommodate construction of non-residential farm buildings, as to the agricultural land (Section 23) and the neighborhood general commercial improvements, as to the Longwater Village SRA area (Section 24). The 100-foot right-of-way and easement proposed to be vacated is described and depicted on Exhibit “A”. It is south of and generally parallel to the public right-of-way known as Oil Well Road. The 100-foot right-of-way and easement was purportedly granted as a right-of-way and easement for public road by Humble Oil and Refining Company, then-lessee of the Properties for oil and gas exploration purposes, to Collier County on August 1, 1951. The nature of the rights of Humble Oil and Refining Company as to the Properties, the location of Oil Well Road, and the Owner’s (and its affiliates’) commitment to dedicate additional right -of-way for expansion of Oil Well Road collectively demonstrate that: 1. Humble Oil and Refining Company was merely an easement holder of a private easement granted under Deed Book 12, Page 483, and Page 487. The purpose of the 100-foot right-of-way and easement granted to Humble Oil was to further its oil and gas exploration rights under certain private oil and gas leases, and on its face repeatedly expresses that the easement is a private easement to the lessee. Humble Oil did not have authority to grant the Easement in property it did not own. The 100-foot right-of-way and easement was not lawfully conveyed but has become a cloud on title to the Properties. Enclosed please find correspondence to Trinity Scott regarding the history of the Easement to further elaborate this point. 2. Access is served by Oil Well Road, a one hundred fifty (150) foot wide right-of-way parallel to the 100-foot right-of-way and easement. There is a gap between the public right -of-way and the 100- foot right-of-way and easement and is not connected to any other public right-of-way and easement. The County has confirmed that the Easement serves no public use or value. 3. Pursuant to Oil Well Road Agreement dated October 27, 2009, the Owner committed to and has satisfied conveying to the County, without compensation, additional (100 feet) of right-of- way sufficient to accommodate a six-lane cross section for Oil Well Road, as well as a dedication of land necessary for storm water detention, treatment, and drainage. The commitment is a significant benefit to the public and increases access and capacity in a logical location. 16.A.2 Packet Pg. 164 02/22/2022 In addition, the structures to be constructed over the 100-foot right-of-way and easement proposed to be vacated will further the County’s goals and policies for this area by preserving agricultural activities and concentrating business uses for the SRA along major corridors. In summary, Humble Oil did not own the land when they attempted to dedicate the 100-foot right-of-way and easement to the county for use as a public road, there is no present, or reasonably foreseeable necessity for retention of the 100-foot right-of- way and easement because it is not connected to any public easement or right-of-way, and compensating right-of-way has been dedicated by the Owner at its sole cost and expense in accordance with the Oil Well Road Agreement. The Development Review Division has reviewed this petition and found no reason for objection. The hearing will be advertised in a local paper of general circulation pursuant to Section 336.10, Florida Statutes and Resolution No. 2013-166, and the adjoining property owners will be given notice as well. FISCAL IMPACT: Growth Management Department, Development Review Division staff has collected a $2,000 “Petition to Vacate” fee from the petitioner which covers the County’s cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this Executive Summary.
