Agenda 02/08/2022 Item #16F 1 (COPCN Class 2 w/Just Like Family Consierge Medical Transport Services d/b/a Brewster Ambulance Service)02/08/2022 EXECUTIVE SUMMARY Recommendation to renew a Certificate of Public Convenience and Necessity for a Class 2 ALS non -emergency inter -facility ambulance transports to Just Like Family Concierge Medical Transport Services (D.B.A. Brewster Ambulance Service) to allow post -hospital inter -facility medical ambulance transfer services. OBJECTIVE: To proceed in the best interest of the public health, safety and welfare by renewing a Certificate of Public Convenience and Necessity (COPCN), Class 2 Advanced Life Support (ALS) inter -facility ambulance transport certificate(s) to Just Like Family Concierge Medical Transport Services (D.B.A. Brewster Ambulance Service). These certificates are subject to certain conditions noted below. CONSIDERATIONS: Just Like Family Concierge Medical Transport Services (D.B.A. Brewster Ambulance Service) was originally granted a Certificate of Public Convenience and Necessity on March 8, 2018, by the Board. The certificate requires annual renewal, and the current COPCN expires on March 7, 2022. The renewal application was brought before the Emergency Medical Authority on December 8, 2021, and unanimously recommended to the Board that the Certificate be renewed. Staff has deemed the application complete and recommends that the COPCN be renewed for one year. Section 50-60 of the Code of Laws and Ordinances provides: Each certificate holder shall file within 90 days of expiration applications for renewal of his certificate. Renewals shall be based upon the same standards as the granting of the original certificate along with such other factors as may be relevant. The renewal application shall be accompanied by a $250.00 renewal fee. The renewal certificate may be approved routinely by the Board, upon advice of the administrator, or the Board may hold a hearing on the same. These requirements have been met, and the administrator recommends renewal. FISCAL IMPACT: There is no fiscal impact to the Board for the granting of this certificate. The Board is requested to accept and recognize as revenue in Fund (001) the $250.00 application fee with the corresponding application. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact resulting from this action. LEGAL CONSIDERATIONS: A hearing is not required for renewal. If a hearing is held, the Board must find that the standards set forth in Section 50-57 of the Code of Laws and Ordinances have been satisfied based on competent evidence as follows: (1) That there is a public necessity for the service. In making such determination, the Board of County Commissioners shall consider, as a minimum, the following factors: a. The extent to which the proposed service is needed to improve the overall emergency medical services (EMS) capabilities of the County. b. The effect of the proposed service on existing services with respect to quality of service and cost of service. Packet Pg. 643 02/08/2022 C. The effect of the proposed service on the overall cost of EMS service in the county. d. The effect of the proposed service on existing hospitals and other health care facilities. e. The effect of the proposed service on personnel of existing services and the availability of sufficient qualified personnel in the local area to adequately staff all existing services. (2) That the applicant has sufficient knowledge and experience to properly operate the proposed service. (3) That, if applicable, there is an adequate revenue base for the proposed service. (4) That the proposed service will have sufficient personnel and equipment to adequately cover the proposed service area. Additionally, then Board has the option to appoint a hearing office as provided by Section 50-58 of the Collier County Code of Laws and Ordinances. Sec. 50-58. - Appointment of hearing officer. In making the determinations provided for in section 50-57 above, the Board may, in its sole discretion, appoint a hearing officer to hold a public hearing and to make factual findings and conclusions as a result of the hearing. Should a Hearing Officer be appointed, said hearing officer shall render a written report to the Board within 30 days of the hearing, which report shall contain the officer's findings and conclusions of fact, and a recommended order. The findings and conclusions of fact shall be binding upon the Board, but the recommended order shall be advisory only. Accordingly, this item is approved for form and legality and requires a majority vote for Board action. The training and experience of the applicant. The management team at Brewster Ambulance Service collectively has over 300 years of experience in the EMS industry with varied experience in Field training, education, management, air medical and critical care transport. With over a century in the ambulance industry, we can provide the expert leadership needed to run a respectable, high quality service. Our Quality Assurance Department is staffed by 10 full-time Paramedics. All QA staff have a minimum of 10 years with a Paramedic certification. Our QA staff reviews patient care reports for quality assurance and adherence to our medical protocols and standards of care. Brewster Ambulance Service is committed to maintaining compliance with all federal, state and local laws and regulations. We are compliant with Florida Statute 401 and Florida Administrative Code 64J in accordance with standards set forth by the Bureau of EMS and Department of Health. Our state license is valid through May 15, 2022 Brewster Ambulance Service accepts all insurance providers. All billing and collections are done in house with our team of close to 60, to ensure patient confidentiality and a payment plan for all patients with financial difficulty. All BAS field employees maintain their credentials in a proactive manner as well as pursue continuing education tracks so they achieve individual career and certification objectives. During orientation and throughout the year, all employees are required to take a course or refresher course in infection control, airborne pathogens, blood -borne pathogens, HIPAA, injury prevention, and emergency vehicle operations. EMTs and Paramedics are responsible for maintaining their own credentials and certifications. Brewster Ambulance Service sponsors continuing education support in order for employees to maintain their certifications thru CMTI which is an accredited EMS education provider. The required 16-hour Emergency Vehicles Operators Course is handled by our in house EVOC Instructor. We uses a combination of classroom and practical driving to train staff on the proper driving techniques to safely drive an emergency vehicle in the state of o Florida.
