COLLIER EMS PREMIUM PAY
MEMORANDUM OF UNDERSTANDING
BETWEEN THE
COLLIER COUNTY BOARD OF COUNTY COMMISSIONERS
AND
SOUTHWEST FLORIDA PROFESSIONAL FIREFIGHTERS
LOCAL 1826
INTERNATIONAL ASSOCIATION OF FIREFIGHTERS,INC.
This Premium Pay Memorandum of Understanding ("MOU") is entered into this 11th day
of January 2022, between the Collier County Board of County Commissioners (the "Board") and
the Southwest Florida Professional Firefighters, Local 1826, International Association of
Firefighters, Inc. (the"Union")(collectively referred to as the "Parties").
RECITALS
WHEREAS, the Union serves as the exclusive bargaining agent for all employees of the
County within the employment classifications set forth in Article 2, section 2.1 of the Collier
County Emergency Medical Services (the "EMS employees") bargaining unit as stated in the
Collective Bargaining Agreement approved by the Parties and covering the period commencing
on July 13, 2021 through September 30, 2025 (hereafter,the"CBA"); and
WHEREAS, the Coronavirus ("COVID-19") is a respiratory illness that has led to a
declaration of a public health emergency locally, state-wide, and nationally, and has required a
considerable expenditure of governmental resources; and
WHEREAS, the federal Coronavirus Aid, Relief and Economic Security Act("CARES")
was passed in March 2020, and the American Rescue Plan ("ARP") (collectively, the "Aid
Monies")signed into law on March 11,2021,both which,among other things,appropriated federal
monies for local units of government to cover expenditures incurred due to the COVID-19
pandemic; and
WHEREAS, the Aid Monies specifically appropriated federal monies to Collier County,
Florida(the "County")to mitigate the economic impact of COVID-19; and
WHEREAS, the Board agrees to allocate"Hazard" or"Premium Pay" to recognize EMS
employees for a defined period of time, based upon the availability of resources and governed by
the restrictions on the use of the Aid Monies as outlined in the Department of Treasury Coronavirus
State and Local Fiscal Recovery Funds interim rule, for their tireless work during the ongoing
pandemic despite the health risk and exposure; and

NOW,THEREFORE,in consideration of the above premises, and the mutual covenants,
terms, and provisions contained herein,the County and the Union agree as follows:
The Parties incorporate by reference the WHEREAS clauses set forth above as if fully set
forth herein.
TERMS
1. For the purposes of this MOU, EMS employees means all employees of the County
within the employment classifications set forth in Article 2, section 2.1 of the Collier
County Emergency Medical Services bargaining unit as stated in the Collective
Bargaining Agreement as well as others in the Division who, in the course of their
positions of employment with the County,completed essential work in response to the
pandemic.
2. Effective January 11, 2022,through February 25, 2022, (the "Relevant Period"), EMS
employees may be eligible to receive Premium Pay in the amount of$2,000.00 to be
paid in bi-weekly payments of$500.00 with the first payment being made on January
14,2022,and the final payment being made on February 25, 2022,for the performance
of any necessary actions taken to respond to COVID-19. Specifically, payments will
be issued with employees' regular pay checks on January 14, 2022, January 28, 2022,
February 11, 2022, and February 25, 2022, and are subject to Federal withholding, in
accordance with IRS regulations.
3. The $2,000.00 Premium Pay applies only to personal services that are substantially
dedicated to mitigating or responding to COVID-19, but it is presumed that all hours
worked by EMS employees relate to such services. To be eligible for the Premium pay,
employees must meet the following criteria:
a. Employed with the EMS Division on or before June 14, 2021; and
b. Must be employed between January 11, 2022, and February 25, 2022. If an
employee leaves employment between the above time periods they will not be
eligible for full payment.
4. Additionally, the $2,000.00 Premium Pay adjustment is not to be paid on any leave
payouts such as DROP or separations from employment with the County.
5. The $2,000 Premium pay shall not be incorporated when calculating the employees'
regular base rate of pay for any other type of payment (e.g., leave payout) unless
mandated by law.
6. The funding source for the Premium Pay comes exclusively from the Aid Monies
funding disbursements provided to and by the County and, therefore, will be cost

neutral to the County. If any overpayments (the "Overpaid Amount") are made to
EMS employees pursuant to this MOU, that should not have been made, the County
shall recoup any such Overpaid Amounts from the EMS employees who received
payment. In such case, the Overpaid Amount will be recouped from the impacted
employees in installments using a timeframe agreeable by the Parties, provided full
recoupment occurs no later than six months after the last such payment.
7. This Memorandum of Understanding shall become effective once fully executed by
both Parties.
8. Other than as specifically set forth herein,the Memorandum of Understanding does not
modify the CBA.
