EXECUTIVE SUMMARY
Recommendation to approve Agreement #22-008-NS for Maintenance, Warranty and
Support for Collier Area Transit’s existing fixed route and paratransit software system
with Avail Technologies, Inc. to allow for continued vendor support whil e staff completes a
solicitation for a new system and authorize expenditures made under the Agreement
through approved FY22 Exemption Request 073.
OBJECTIVE: To continue the use of the Intelligent Transportation Systems (ITS) Equipment
and Software which provides vital computer-aided dispatch, passenger real-time bus schedule
information and trip planning functionality with adequate vendor support while staff completes a
solicitation for a new system.
CONSIDERATION: On July 26, 2011, the Board approved the award of the Request for
Proposal (RFP) No. 11-5650 for the Intelligent Transportation Systems (ITS) for Collier Area
Transit (CAT) to Avail Technologies, Inc. Avail Technologies has recently rebranded the
Intelligent Transportation Systems name to Enterprise Transit Management Software (ETMS).
An extended warranty has been purchased every year since the initial purchase and the existing
warranty is due to expire on January 31, 2022.
The County is currently soliciting for a new software system that will not be in place and fully
functional prior to the expiration of the existing warranty period. In order to have uninterrupted
service for the computer-aided dispatch, passenger real-time bus schedule information and trip
planning functionality, the County must purchase an additional extended warranty from the
existing vendor for Collier Area Transit.
Historically federal transit grants have been utilized for funding the support and warranty of the
ITS system and will continue to be pursued on an annual basis. Staff is requesting the Board
authorize the expenditures made under Agreement #22-008-NS for one-year plus additional
months, as needed, utilizing grant funds as they are awarded.
Exemption Request FY22 number 073 which has been approved by Procurement Services
provides for a not to exceed amount to Avail Technologies, Inc. in the amount of $71,695.84 per
fiscal year through September 30, 2023.
FISCAL IMPACT: Funding for the 2021-2022 warranty period in the amount of $71,695.84 is
available within the FTA Sections 5339 FY18 & 5307 FY20 CAT Grant Fund 424, Projects
33591 and 33702. Funding for the 2022 warranty period in the amount of $5,974.65 per month is
available within the FTA Section 5307 CARES ACT CAT Grant Fund 424, Project 33682.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a
majority vote for Board approval. - SAA
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated
with this Executive Summary.
RECOMMENDATION: To approve Agreement #22-008-NS with Avail Technologies, Inc.,
authorize expenditures made under the Agreement through approved FY22 Exemption Request
