EXECUTIVE SUMMARY
Recommendation to approve the release of a code enforcement lien with an accrued value of
$117,588.50 for payment of $2,000 in the code enforcement action titled Board of County
Commissioners v. Elias Valencia, relating to property located at 2930 70th St SW, Collier County,
Florida.
OBJECTIVE: That the Board of County Commissioners accept an offer to release a code enforcement
lien with an accrued value of $117,588.50 for payment of $2,000, in relation to Code Enforcement
Special Magistrate Case No. CEPM20170013286.
CONSIDERATIONS: When the subject property was owned by Elias Valencia, the Code Enforcement
Special Magistrate ordered the imposition of a lien on the property, due to code violations consisting of a
damaged soffit, fascia, and roof in a state of disrepair. The lien was recorded on October 18, 2018, at
O.R. Book 5563 Page 2444. The current lien amount is $117,588.50, based on 1,176 days of accrued
fines ($100 per day from February 6, 2018, through April 26, 2021) totaling $117,600, plus $235.05 in
operational costs. A payment of $235.05 for operational costs and fees was paid on September 4, 2020.
The property was brought into compliance on April 26, 2020.
Como Ventures, LLC, acquired the property via General Warranty Deed recorded on September 4, 2020.
Pursuant to Resolution No. 2012-46, a request for reduction of fines may be considered, in part, when a
lien encumbers property under new ownership and the new owner has diligently pursued abatement and
achieved compliance and/or when payment of the lien would impose a severe financial hardship on the
owner. Como Ventures, LLC took title to this property, a home that was abandoned and remained in a
state of disrepair for nearly a decade. The home was determined to be unlivable due to repairs required to
meet new building codes, significant water damage, and a termite infestation so severe that the home was
demolished, and a new home is under construction. It took substantial amounts of time and money, over
$400,000, with extensive follow up with County departments relating to permits, including demolition of
the home, and construction fees. The property is actively maintained, the owner has paid $2,000 in
settlement of fines and requests the remaining $115,588.50 in accrued fines be waived. There are no
known code violations remaining on the property.
FISCAL IMPACT: Payment of $2,000 in settlement of fines has been received. If approved by the
Board, accrued fines in the amount of $115,588.50 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46. -CAK
RECOMMENDATION: To waive the remaining fines in the amount of $115,588.50, accept payment
amount of $2,000, and authorize the Chair to sign the attached release and satisfaction of lien for
recording in the Official Public Records.
