Steve Main had an excused absence. CRA Staff Present: Debrah Forester, CRA Director, Tami Scott, Project Manager and Shirley Garcia, Operations Coordinator. II.Pledge of Allegiance III.Adoption of Agenda: Al Schantzen made a motion to accept the agenda as written, Karen Beatty second. Approved unanimously. IV.Approval of Minutes: October 5th Meeting Minutes -Al Schantzen made a motion to approve the minutes as written, Mike Sherman seconded the motion. Approved unanimously. V.Community / Business - Presentations a.Collier County Sheriff’s Office: Sergeant Allyn Tuff and Corporal Michael Dipaolo from the Community Policing Unit in the Collier County Sheriff’s Office attended to provide updates within the CRA District. Cpl Dipaolo answered the questions about the drug arrests within the district, and stated there were 6 arrests made, one conveyance burglary from an unlocked vehicle and a construction burglary for the month of October. They reminded everyone to please lock their vehicles and not leave any items visible or unsecured. There were 10 noise complaints- if anyone had any questions regarding noise they can call Code Enforcement. Sgt. Tuff provided flyers regarding a Thanksgiving food drive with the East Naples Baptist Church if anyone was interested. Al Schantzen noted his concerns of dump trucks using Peters Ave next to Courthouse Shadows project taking both lanes when turning, prohibiting cars from utilizing a lane and asked the Sheriff’s Office to look into that problem. Sgt. Tuff said they can do some enforcement on that street and see what they can do to prevent that. Maurice Gutierrez asked if they could pull calls for service statistics for the past year and see where the district is at compared to the years before. b.Greater Naples Fire District- Michael Cruz, Lieutenant Inspector, provided some information on the rules for rentals of a single family and multi-family and safety check information. He noted that anyone interested in a free fire safety check of a dwelling to please contact their office. Mr. Cruz wanted to clarify the question about the fire on Areca Ave since that 5.A.2 Packet Pg. 56 Attachment: BGTCRA Agenda Packet-12-07-2021 (20829 : Bayshore Gateway Triangle CRA Local Advisory Board - December 7, 2021) is why he was asked to speak about fire safety. The home was designated as a single family, but he was made aware that there were extra units that did not show up on the original plans which changed its use to an apartment classification. Now that it has been correctly identified he will work with Code Enforcement to enforce building code requirements. Karen Beatty asked about fire extinguishers and Mr. Cruz said they can do a 15 Minute training on the use and how long they last etc. Al Schantzen asked about the address numbers on structures and if they were still required to be on the homes, Mr. Cruz stated yes and they work with Code Enforcement to enforce that code as well. c. Brookside Marina- Conditional Use- Clay Booker, Cheffy Passidomo P.A. attended to go over the request for the conditional use and ask for support from the CRA Board. Mr. Booker provided the information on the existing uses and the use the owners would like for future tenants to market the Marina. After some discussion by the advisory board and the concerns that it may have an impact on the residential properties abutting the Marina, the board tabled their support until after the owners hold their neighborhood informational meeting to see how the residents feel about the request. They invited Mr. Booker to come back after the NIMS meeting to review the project scope again before they decide whether to support the project. d. Private Development Update- Ms. DeJohn highlighted a couple of projects starting with St Matthews PUD and going before the planning commission on December 2 and the BCC on January 25th, 2022. Brookside Marina rezoning request for Marina type to operate water type business uses, Ms. Dejohn will be getting the date of the NIM to send out to the board. The three Promenade of Naples Boat Yard related requests has no updates at this time. Becca parking lot request decision is due by mid-November. Racetrak price sign has a request to raise their sign to 15 ft. Al Schantzen asked how they can raise it. Ms. DeJohn noted Florida law has changed regarding signage. VI. Old Business: a. 17 acres Discussion – Stantec proposal - Ms. Forester noted the negotiations are still underway. She requested that a special meeting be scheduled to discuss the 17-acre site including the final negotiations. Ms. Forester wanted them to consider a couple of items before the meeting one is how much more money do they want to spend on that property, second what is the end result that they want for that property. She brought up an example of another CRA partnering with a developer and contributing 10 million dollars towards the parking within the mixed-use project and have public parking in perpetuity for the City so that is something to think about or if they wanted to have it as all park lands and who would maintain it, either Parks and Recs or the MSTU or sell the property to a developer. 5.A.2 Packet Pg. 57 Attachment: BGTCRA Agenda Packet-12-07-2021 (20829 : Bayshore Gateway Triangle CRA Local Advisory Board - December 7, 2021) There was some discussion on available dates for the Special Meeting, and the board members decided to hold special meeting on November 10th at 6pm. Al Schantzen asked if the concern is spending money on Maintenance for the 17acres what is the decision to keep Dels? Do they plan on rezoning and selling and that should help with the carrying cost for the other property the CRA owns. Ms. Forester commented that Del’s is going to be demolished so they are working on that first, there is no carrying cost for Del’s because that was paid for with cash and right now there has been no interest from anyone to buy that property. Ms. Beatty noted an inventory of potential housing development in the area that she is preparing which shows over 2000 additional units could be built and questioned why the CRA is considering looking for more developers to buy and build more residential on the 17 acre site. b. Access Management Plan Proposed Update – Staff recapped the intent of the scope of work which is to provide an analysis of the roadway based on current and future traffic to see how to best manage access. Bayshore Drive is considered a “collector” in the Collier County Transportation System so any changes to Bayshore Drive regarding medians, parking, turn lanes will need to be approved by the Transportation System so the overall network isn’t negatively impacted. The final scope includes several public meetings including Bayshore Drive property owners, County Divisions, the MPO, transit and general public. Once the final plan is approved, the upgrading of Bayshore Drive – landscaping, lighting, sidewalks- can begin. Staff is requesting the CRA consider partnering with the Bayshore MSTU to pay 50% of the $165,350 proposal as noted in the attachement. Maurice Gutierrez asked if there was an agreement with Windstar who paid for the widening of Kelly Road to a 4 lane Bayshore Drive what will be the consequences if staff decided to change it back to a 2 lane road, the second if there were any changes to the bridge on Bayshore Drive being a grant would that be an issue as well. Staff is not aware of any grants associated with the bridge and there is no plan to change the bridge at this time. Windstar will be invited to participate in the public meetings. Camille Kielty made a motion to approve partnering with the MSTU, second by Al Schantzen. Approved unanimously. c. Mural Ordinance Update- Ms. Forester provided the updated mural ordinance and noted ordinance now includes a definition of a mural and minor changes related to the process based on review by GMD staff and the County Attorney’s office. The schedule of public meetings was reviewed. d. Branding Project – Ms. Forester noted the project was put on hold because of COVID and due to the delay staff has expanded their scope to actually develop the logo and tag line. The kick-off will be some time in December. Ms. Forester has their tentative schedule as December 13 and 14th and will work on a schedule for meetings. 5.A.2 Packet Pg. 58 Attachment: BGTCRA Agenda Packet-12-07-2021 (20829 : Bayshore Gateway Triangle CRA Local Advisory Board - December 7, 2021) e. Stormwater Study Update - Ms. Forester provided the update from the Subcommittee for the next phase in the Gateway Triangle Area- Bay Street with Linwood Way and Linwood Alley. Stormwater staff will develop a scope and fees and bring it back to the committee for review and approval. VII. New Business: VIII. Staff Report: a. CRA Directors Report- Ms. Forester provided the report and highlighted some of the projects within the district. b. Project Manager Report- Ms. Scott provided the updates on her list of projects. Dels’ pocket park is completed and there will be a ribbon cutting on November 5, everyone is welcome to join us. Ms. Scott provided an update on the CRA parking lot noting there is still some landscaping work that needs to be done and waiting for gates to be installed but the plan is to open on November 5th. There is some irrigation problems on the north end of Bayshore Drive and staff is trying to get it repaired now. Mike Sherman asked how the staff will manage the parking lot. Ms. Scott commented that the parking lot will be open 24/7, there is no charge and there will be signs installed with rules of what is not allowed including drinking, camping, etc. Concerns were raised regarding people leaving their vehicles in the parking lot for several days and only a few businesses taking advantage of the space. Staff will monitor and report back any issues or proposals to implement changes. In the future if the Board decides to make any changes and recommending charging, staff noted with current technology everything can be done via an app. Ms. Scott provided an updated on the Sabal Shores Street Lighting plan. The plan is to add lights to existing poles. Based on input, orange ribbons were wrapped around the poles they think could use a light. She will work on developing cost estimates and bringing that back to the committee. c. Maintenance Report: Ms. Forester provided the current maintenance report, there has been several claims filed and is working on getting reimbursed. d. Financial Report: Ms. Forester provided the current financial if anyone had any questions. IX. Other Agency’s: a. Collier County Code Enforcement: The Code enforcement report was attached if anyone had any questions. Mr. Johnson was not in attendance but would be available at the next meeting. X. Dels corner dedication November 5th @ 10am-Ms. Forester provided the dedication date and time and invited everyone to attend. b. Tamiami Trail Business Owner position vacancy- Ms. Forester noted the vacancy for the Tamiami Trail business owner with one applicant so far and will put it on December agenda. c. New Owner Hamilton Harbor Yacht Club – There was an article for the new owner of Hamilton Harbor attached for their information. d. Gore Nature Education Center Grand Opening – there was a flyer provided for an upcoming event if anyone was interested in attending. e. Naples Yard and Garden Show UF IFIS Ext – The flyer for the upcoming yard and garden show was provided for those interested. f. Development Begins on Metropolitan Naples- Coastal Breeze News- The article provided information on the Gateway Triangle property project. XI. Public Comments: XII. Staff Comments: XIII. Advisory Board General Communications: Karen Beatty asked about an odor in the neighborhood. After discussion, determined it was probably due to low tide. Maurice Gutierrez raised a suggestion regarding the use of TIF after the CRA ended and suggested that a small portion could remain to take care of long-term maintenance of the 17 acres. He also mentioned the FRA conference and suggested the Board training he attended be offered to the other members. Camille Kielty also commented on the FRA Conference and stated it was excellent and felt all board members should be required to attend training. XIV. Next Meeting Date: a. December 7, 2021 @ 6pm XV. Roll Call: Advisory Board Members Present: Maurice Gutierrez, Steve Main, Al Schantzen, Camille Kielty, Steve Rigsbee, Kathi Kilburn, Mike Sherman and Karen Beatty. Old Business: 5a. 17 Acre Site – Overview Presentation- Ms. Forester provided an overview of the 17 acres outlining the history and the costs associated with purchase and maintenance of the property over the years. The proposal from Stantec for the design of the Boardwalk was presented orally because it has not been officially approved by the Board of County Commissioners and is not yet a public record. The price of the negotiated Stantec proposal is between $550,000 and $700,000. The Advisory Board discussed staff’s presentation. Ms. Forester mentioned the letter of intent from Ms. Maddox to purchase the property for a mixed-use project and partner to build the boardwalk and the interest in the property from Opera Naples to be gifted for an outdoor music venue and no interest in assisting financially to build the boardwalk. Ms. Forester noted the BCC asked for a recommendation from the Advisory Board on how to proceed, put the property up for sale or to move forward with the Stantec proposal. If the Board was interested in proceeding with the Stantec proposal then a motion to recommend approval of the proposal would be requested. 1. Advisory Board Questions – Al Schantzen asked why the Stantec proposal was including determining the uses of the out parcels and if that would reduce the cost of the Stantec proposal if it was removed from the scope. Ms. Forester wanted to clarify again the scope of work needs to include the determination of what can be done on the out parcels because if the need to sell those other parcels were needed, it would be an incentive for investors to have those determinations done ahead of time and would be easier to sell if the board chooses to put it out for bid. Al Schantzen asked if the MSTU could pick up the maintenance of the boardwalk like they do for the CRA parking lot. Ms. Forester stated they can ask the MSTU and also check the ordinance if that allows for that. Mr. Schantzen recommends selling some of the other properties to offset giving the 17 acres to the community 5.A.2 Packet Pg. 61 Attachment: BGTCRA Agenda Packet-12-07-2021 (20829 : Bayshore Gateway Triangle CRA Local Advisory Board - December 7, 2021) if that is their concern of the carrying costs for the property. Steve Main just wants the boardwalk built and not worry at this time about the outparcels. 2. Public Comment- Sandra Arafet mentioned the MSTU approving partnering with the CRA to build the pathway years ago for $165,000 so she is not sure why there is a concern for building it now and feels they should proceed with the construction and use MSTU funds. Ms. Forester said the issue being discussed was moving forward on the design. If the MSTU wanted to contribute they can review their budget and make a recommendation to contribute for the construction. Mike Patch President of Moorehead Manor wanted to express the community’s support for open space of the 17 acres with the boardwalk to Sugden Park since their community is right across the street. They were not in favor of an open outdoor amplified music venue since their community is a 55 an up neighborhood with all elderly folks living there and that will negatively affect their quality of life. There were other public comments in support of the boardwalk to Sugden Park with the Arts and Cultural component to be included at some point so that it may bring in younger interest in the area. Mr. Schmidt runs a not for profit in the area and feels the parcel should benefit the community and not get held up with government red tape. He would like to propose an outdoor wellness center. He has experience in operating music venues in St. Louis. Harry Bandinel, previously involved in the 2017 proposal to purchase, noted the 17-acre site is difficult to develop and currently lives on New Moon Court would like to see the connection to Sugden and have lower density and lower heights and offer something to the community. Mr. Komerasky lives on Becca Ave and his concern is the noise issue if the 17 acres gets developed into a commercial development, he said if they can leave it green space that is what he would support first. Donna Fiala mentioned the arts that has been in the area for years now, and the bridge to Sugden Park has always been the first priority. The community is paying for it and they should continue to use their money to build what they want not residential. There were other comments to keep the property green space for the community and not put in more commercial that will cause more noise pollution in the area. Tish Dawson, via Zoom, requested that the Boardwalk move forward with an opportunity for arts and limited commercial. Meredith Gavin, resident of Weeks Avenue and owner of I Love Curry, noted her support for green space and cultural activities and to focus on the boardwalk connection. The Advisory Board requested information from Opera Naples regarding their interest. Wendy Needham, Opera Naples, Chairman of the Board spoke regarding Opera Naples search of a permanent venue for outdoor performances but expressed that they do not have funding to build or have an internal plan to move forward with any plans for the 17acre site. The sole purpose if they do decide to do anything on the site it would be to do an outdoor performance and it will be amplified music if there are any concerns with that. The other issue is that they do not stop at 9pm the music would go from 7-10pm if that is a concern as well. They were exploring the idea to see if building something on the site would work but they have no capital funding to build anything at this time and wanted to share that information. 5.A.2 Packet Pg. 62 Attachment: BGTCRA Agenda Packet-12-07-2021 (20829 : Bayshore Gateway Triangle CRA Local Advisory Board - December 7, 2021) 3. Board Discussion-Karen Beatty mentioned how many available properties within the CRA District for single family and multi family residential units, she brought in a list of vacant and developable land in the CRA showing an estimate of 2,437 units and provided it to the CRA Board and community to review. She also mentioned that the intended purpose for the 17acres was never for residential it was always purposed for a cultural arts facility and a pathway to Sudgen Park and perhaps some small retail shops for folks to gather and shop. Ms. Kielty remembers at the time of the Redevelopment Plan update that the 17 acres was put on hold, but she doesn’t remember that everyone did not want any residential on the property, her recollection is a mixed use idea was the plan for that property. Maurice Gutierrez remembers that the staff had to return grant money to build the pathway because it would interfere with the development of the property and investors would not be interested due to the pathway being in the way and he does not want to see that happen again, he would like to see the pathway being built and let everything else come after. Kathi Kilburn noted she bought into the district specifically because it was an arts district and has sold many properties on that premise that it was an arts district. She also stated she had gathered 95 surveys in 24 hours that supported developing the property for the community with some commercial and arts-oriented development and that people didn’t want more residential. Mike Sherman provided some information on the diversity in the area and recommends staff continue with the connection and worry about the other parcels later. Maurice Gutierrez agrees with moving forward with giving something back to the community as well. 4. WHEREAS, pursuant to Chapter 125, Florida Statutes, the Board of County Commissioners may adopt ordinances and resolutions necessary to preserve the health, safety and welfare of the residents of Collier County, except where prohibited by law; and WHEREAS, short-term vacation rentals situated in single-family residential neighborhoods is a growing interest; and WHEREAS, these regulations do not regulate duration or frequency of rentals, but are intended to address the impacts of transient occupants on established residential neighborhoods; and WHEREAS, the Board finds that the measures required by this Ordinance will help maintain residential use and enjoyment for Collier County citizens and residents. NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: Section One: Title This Ordinance shall be known and cited as "The Collier County Short-Term Vacation Rental Registration Ordinance." Section Two: Legislative Findings and Intent The Board hereby finds that the use of residential dwellings for short-term vacation rentals in established residential neighborhoods may create community impacts, including, but not limited to, excessive noise, accumulation of trash, on-street parking and diminished public safety; that to lessen these impacts and to protect the quiet enjoyment of neighboring residential units it is necessary to have a known, responsible person to contact who can reasonably address issues that may arise from the use of short-term vacation rentals, many of which are owned by non-residents; and that some owners of short-term vacation rentals may not properly remit required taxes and fees. Section Three: Definitions The following words, terms, and phrases, when used in this Ordinance, shall have the meanings set forth herein: Designated Responsible Party. The term "Designated Responsible Party" means any person eighteen (18) years of age or older designated by the Owner, tasked with responding to requests or complaints and other problems relating to or emanating from the Short-Term Vacation Rental. An Owner may retain a private property management company to serve as the Designated Responsible Party. The Designated Responsible Party shall be the agent of the Owner authorized to accept County-issued citations and notices of violation arising from the use of the Short-Term Vacation Rental. Owner. The term "Owner," shall mean the person or entity holding legal title to the short-term vacation rental property, as reflected in the Collier County Tax Collector's records. Short-Term Vacation Rental. A "Short-Term Vacation Rental" means the rental of any habitable space, including a room, apartment, living quarters, in any residential building, including but not limited to condominiums, single-family or multi-family homes, for a term of six months or less, as provided in F.S. § 125.0104(3)(a), as amended, unless such person rents, leases, or lets for consideration any living quarters or accommodations which are exempt according to the provisions of F .S. Ch. 212. Any Owner who is not required to register with the Florida Department of Business and Professional Regulation, as defined by F .S. Ch. 509, is exempt from this ordinance. Section Four: Short-term Vacation Rental Requirements Prior to commencing any Short-Term Vacation Rental, it is the affirmative duty of the Owner to: 1. Register with the Florida Department of Business and Professional Regulation and the Collier County Tax Collector. 2. Obtain a Collier County Registration Certificate for each Short-Term Vacation Rental unit owned. The Certificate must identify that unit's Designated Responsible Party and current contact information. The Owner must notify the County in writing of any changes in ownership or of the Designated Responsible Party within ten ( 10) business days of such change. 3. Inform all guests prior to occupancy of the Short-Term Vacation Rental unit of all applicable Collier County ordinances, including noise, parking, and garbage. 2 Item 10b 5.A.2 Packet Pg. 99 Attachment: BGTCRA Agenda Packet-12-07-2021 (20829 : Bayshore Gateway Triangle CRA Local Advisory Board - December 7, 2021) 4. Maintain all Short-Tenn Vacation Rental units under their control in compliance with the occupancy limits, as specified in the Collier County Code of Ordinances, Collier County Land Development Code, Florida Building Code, and Florida Fire Prevention Code. 5. Be available in person or by telephone or have the Designated Responsible Party available in person or by telephone twenty-four (24) hours a day, seven (7) days a week to address any law enforcement action, emergency response, or County ordinance violation arising from the rental of the Short-Tenn Vacation Rental unit and be willing and able to be onsite to address violations within the next day of notification. 6. Maintain the Short-Tenn Vacation Rental unit as specified in the Collier County Property Maintenance Code (Ord. No. 2010-02, as amended). 7. Include the Collier County Rental Registration Number of the Short-Tenn Vacation Rental unit m all advertising of the availability of accommodations for the Short-Tenn Vacation Rental unit. Advertising includes, but is not limited to print, radio, video, online, social media, and sharing economy platfonns. Section Five: Penalty for Violations. Any violations of this Ordinance may be prosecuted and shall be punishable as provided by the Collier County Consolidated Code Enforcement Ordinance (Ord. No. 2010-04, as amended), and shall be subject to a fine or civil citation up to $500 per violation per day for ongoing repeating violations. Each day of renting a Short-Tenn Vacation Rental unit without having a valid County Registration Certificate issued pursuant to this Ordinance shall constitute a separate and distinct violation of this Ordinance. Guestsand Owners of Short-Term Vacation Rental units may be prosecuted separately and concurrently for a violation of any Collier County Ordinance, including but not limited to noise, parking, and garbage violations. Section Six: Conflict and Severability. No residential use. An access boardwalk to Sugden Park across the lake from Bayshore Drive in the East Naples community. No residential use. Fringe retail/commercial. And absolutely no residential use. They said it again Wednesday before the CRA advisory committee voted to begin turning the gears on boardwalk design. The property in question, an L- shaped trio of parcels with frontage on Bayshore Drive, has received attention for everything from an arts center to an opera house to an FGCU research center to condominiums. In September two new proposals came up: h A mixed-use commercial and resi- dential development, from Rebecca Maddox, owner of nearby Market 360 and Celebration Park. She would pay $2.8 million, plus contribute to the cost of the boardwalk to Sugden. h The idea of an outdoor amphithe- ater and park that Opera Naples is ex- ploring on part of the land. It is looking for a public-private partnership, howev- er. Around 36 people in a mix of Zoom and in-person attendees came to a spe- cial CRA advisory committee meeting for public input on the two proposals. Nearly every person who spoke asked that it not become another residential area. While one speaker acknowledged an Opera Naples amphitheater would bring traffic, it would not be like the daily in- and-out of residential traffic, he said. Even CRA committee member Karen Beatty brought statistics that say the area is rife with planned and potential housing elsewhere. From her study of developers’ plans and new ownership of large parcels, she estimated Bayshore currently has 2,437 units of known, planned inventory and 22.8 acres with development potential. “I bought in this district because I was told it was going to be an arts dis- trict,” said Realtor Kathi Kilburn, a new member on the committee. She brought in a petition with 93 signatures taken in just 24 hours supporting the results of its previous community survey. “That sentiment has not changed. They don’t want more residential. They want more arts. They want places to go to, to walk to. The community is speak- ing up again,” she declared, receiving applause from those in the room. Only Graham Lausterer, who spoke as a native of the city, said that if the Collier County Board of Comissioners — which is the final authority on the land’s future — does allow housing, perhaps it would be a good spot for affordable housing. Beatty and former county commissioner Donna Fiala quickly re- sponded that there are plenty of places available now. And Fiala said the entities searching for affordable housing should find it within their own districts: “We shouldn’t be taking care of anyone else’s workforce.” Lausterer, like the other speakers, did emphasize that the boardwalk — which would give the Bayshore neighborhood foot access to Sugden Park across sever- al stretches of lake from it — needs to be built. Committee member Steve Main echoed that sentiment: “What have we got to do to get the damn boardwalk built?” As it turned out, all they had to do — or could do — was vote to accept the proposal of Stantec, a community de- sign firm with offices in Naples. The company has come recommended by the county planning employees with its maximum $750,000 bid for a mas- ter plan. That plan would include boardwalk design, stormwater/inva- sives remediation/endangered spe- cies analysis, surveys of the Bayshore Drive parcels and permitting and bid- ding services for the walkway. Its proposal, which passed the ad- visory committee unanimously, still will have to be approved by Collier commissioners, as the agency’s board. CRA Director Debrah Forester ex- plained that the time to be determin- ing what happens to the land would be best held until Stantec determines what it can actually hold. Even putting out bids for the board- walk is probably a year away if it passes at the county level, she warned. The waiting game was clearly frus- trating to all the speakers last night. Kilburn had a suggestion: “Could we at least put a sign up on the property, so people know we’re planning this?” Forester said she would see what could be done.
