EXECUTIVE SUMMARY
Recommendation to approve the release of a code enforcement lien with an accrued value of
$66,100 for payment of $1,550 in the code enforcement action titled Board of County
Commissioners v. Rafael Barrios Montero, Tomas B. Avila Reyes, and Ricardo Abril, relating to
property located at 1281 25th St SW, Collier County, Florida.
OBJECTIVE: For the Board of County Commissioners to accept an offer to release a code enforcement
lien, with an accrued value of $66,100, for payment of $1,550 in relation to Code Enforcement Board
Case No. CESD20130011211.
CONSIDERATIONS: When the subject property was owned by Rafael Barrios Montero, Tomas B.
Avila Reyes, and Ricardo Abril, the Code Enforcement Board ordered the imposition of a code lien on the
property, due to various code violations. The lien was for code violations consisting of an unpermitted
shed, fence and two aluminum structures at the residence. The lien was recorded on September 23, 2014,
at O.R. Book 5078, Page 3443. The current lien amount is $66,100, based on 444 days of accrued fines
($150 per day from July 13, 2014, through September 29, 2015) totaling $66,600 and $63.29 in
operational costs, minus prior payment of $563.29 received on April 26, 2019. The property was brought
into compliance on September 29, 2015.
Pursuant to Resolution No. 2012-46, a request for waiver of fines may be considered when full payment
of the full lien amount would impose a severe financial hardship on the property owner. Fines accrued by
an existing owner would be considered for a waiver as long as the existing owner has diligently pursued
abatement and compliance has been achieved. When Rafael Barrios Montero went into contract to sell
the property to Tomas Avila and Ricardo Abril, he provided blueprints and advised that two tent
structures would require permits. Unfortunately, Mr. Avila and Mr. Abril failed to obtain the permits and
did not fulfill their contract. On July 21, 2021, after a Motion for Contempt and Enforcement of
Judgment was granted and recorded, Mr. Montero was able to take back the property, inheriting accruing
fines and over $17,000 in unpaid mortgage expense. There was a substantial amount of time and money
spent for repairs, past due mortgage payments, and legal expense for the property. The property is
actively maintained, and the owner has paid $1,550 in settlement of fines and requesting the remaining
$64,550 in accrued fines be waived. There are no known code violations remaining on the property.
FISCAL IMPACT: Payment of $1,550 in settlement of fines has been received. If approved by the
Board, accrued fines in the amount of $64,550 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46. -CAK
RECOMMENDATION: To waive the fines in the amount of $64,550, accept payment amount of
$1,550, release the lien, and authorize the Chairman to sign the attached release and satisfaction of lien
for recording in the Official Public Records.

Gentlemen
ln 2012 I built a fence in the property 1281 25th st sw Naples Florida 34117 which I had permits for.
ln May 2013 I built two tents with roofs and I received a notification by the city that I had to legalize
them. I did the blueprints for both tents but in June 2013 I went under contract with Mr Tomas Avila
and Ricardo Abril. ln accordance to the contract Ricardo and Tomas had to pay the mortgage of the
home and they had to buy the house in 1 year and 6 months. Before I left the property I told them
that they had to legalize the two tents that I had built, I left the blueprints for both tents, they only
had to take out the permits. After the 1 year and 6 months passed they did not comply with the
contract of buying the property. From then on a legal process started with the court since they were
not paying the mortgage or buying the property. This legal process lasted 6 years and during this
time I had to pay the lawyers and the mortgage of the propety in occasions. During this time they
removed both tents from the property and sold them and never payed the fines.
ln the year 2O2O I was informed of the fees that were being charged of USD 566,000.00 that were
late for 444 days. At the time I immediatly went to your offices and spoke with Ms. llieana Burgo,
lleana explained to me the situation about the fines and that Mr.Avila had been there trying to
remove the fines since he was responsible for those fines. lleana explained to me that the fees were
not removed for Mr.Avila because he had an open case with another property he owned. I
presented the documents of the fines to Mr. Judge Hayes and all the proofs that Mr.Avila was not
paying the mortgage or buying the property. This caused me to have financial hardships and my
credit was ruined. Mr Judge Hayes gave the order to Remove Mr. Tomas from the title of the home
and ordered Mr. Tomas to leave the property immediately.
I went to your offices with the order from the judge to remove Mr Avila from the property and asked
what could I do to fix these fines. Ms. lleana explained that I had to write a letter explaining the
whole situation since I was not responsible for those fines. I did the letter explaining everything and
that I could pay USD S550.00 since l'm having financial hardships at the moment and I have to pay
the rent where I currently live and the mortgage of the home. My son could help me to pay an
additional USD S1000.00 which would make it USD S1550.00 in order to have this situation fixed.
I also have a debt of USD 517,977.74 with the bank since Mr. Avila did not pay the mortgage for 11
months.
