Hello Angela, I was contacted by our lender today that they are going to begin cancelling our pool loan as we were not able to begin the project. I will be contacting the Pool builder and let them know that we will not be building the pool. I have contacted my Attorney at Glantz Law regarding this issue and he advised that he must file an action as he has neverseen An abandoned 70 year old easement not removed from a parcel unless the County was using the Easements as a means to generate Illicit Gains. He also advised that I should have the drainage Easement removed as well as that is also degrading the property. I have attached what he found on county records. I, as well as most of my neighbors have a 70 year old 10 foot abandon Utility Easement located in the rear of all of our properties in Gulf Harbor. I found out when applying for a pool permit. I contacted Marc Berman at the Collier County Surveyors office and he instructed me to file a vacate of easement for $2,700.00. 1 also contacted the Land Records Department and they have no recorded Easement showing who owns the Easement, it's purpose or anything regarding this. I then contacted my Attorney and he stated that since the community was platted in 1955 it was probably never recorded and therefore does not exist although it shows on the plat (attached). Now instead of simply removing the easement the County Surveyor wants each individual property owner to pay 2,700.00 to have this removed. My Attorney suggested I contact you as you will probably find this ludicrous and maybe illegal as the easement should have been removed years ago as it was never used. And to force an entire community to pay thousands of dollars to remove a 10 foot 70 year old easement is simply un-acceptable. Please review and make a suggestion. Now instead of simply removing the easement the County Surveyor wants each individual property owner to pay 2,700.00 to have this removed. I will be contacting the Pool builder and let them know that we will not be building the pool. I have contacted my Attorney at Glantz Law regarding this issue and he advised that he must file an action as he has neverseen An abandoned 70 year old easement not removed from a parcel unless the County was using the Easements as a means to generate Illicit Gains. He also advised that I should have the drainage Easement removed as well as that is also degrading the property. I have attached what he found on county records. Adding a church would certainly cause an increase in commuters, exacerbating what is already a heavily trafficked neighborhood. This raises a number of concerns regarding safety, commuting time, and my next item: our privacy. I am writing to you formally objecting the construction of the church. Not only due to traffic concerns, but also due to the destruction of our beloved wooded home. The residents of the Estates move here for quiet and the peaceful esthetics. Meeting over by 7:00 pm- got home at 7:30 PM. The placed was packed even had to set up extra chairs. We were told 60 people are current members and that the new church would have 250 seats built on two lots. Attached pre -plans of church - will -if reading correctly be 5.15 Acres Zoned residential. It got a bit heated as the pastor of the church stated that a church is good for a community, to this there was no disagreement. The disagreement is that it will open the door for more commercial building within the Estates and not on just the fringe. More congested traffic on a road already congested especially to those living 1000 feet from it. Other Comments : moved to the Estates to get away from city noise and traffic congesting. A church does not belong in a residential area, if it did there would be no need to rezone. One lady said her church was approved and built in a residential area they built a wall around it, but still constantly get complaints from the residents. The meeting was adjourned by the speaker - as it was really going no where. Those that wanted to build the church saw it a great idea. They just could not "hear" or understand that those that live near it do not want the traffic Congestion or opening the door to commercial building within the Estates. What I got from the meeting is the church really needs more space, but the residents that live in the area and nearby- myself included, do not approve of where they want to build it. We do not want a church being built in a Residential area, it opens up other rezoning for projects that otherwise would not be approved.. I am one of many that disapprove of the area chosen for this church project - it should be on a main road, not on a residential road. While I realize Randall Boulevard will soon be a major roadway containing commercial buildings along Randall and 8th St, NE, finding another location for the church along Randall or Immokalee Road containing ample intersection access is appropriate. The residential interior of the rural estates in Golden Gate Estates is not the right fit for this church to be constructed. The Golden Gate Master Plan was recently revised in 2019 and designates major intersections for non- residential zoning, and the proposed lot where this church is to be constructed is not one of them. Religious buildings sometimes are not ideal neighbors, especially in residential districts. Consider a few recent examples: In New York City, the Fifth Avenue Presbyterian Church has been housing a number of homeless persons every night, in close proximity to private residences; residents' alleged use of the church violates local zoning laws. In Castle Hills, Texas, the Castle Hills Baptist Church has sought a special use permit to add a parking lot and a fourth story to a church building. The city denied the permit, but the church is fighting the decision in court. Meanwhile, in Abington, Pennsylvania, a Jewish congregation has purchased 10 acres of land in a residential neighborhood for use not only as a worship center but also as a wedding and bar mitzvah facility; the land had previously been used as a convent and then a monastery. The Township is challenging the proposed new uses. These conflicts are interesting because they track the changing nature of the way religious buildings and land are used in our country. There was a time when such buildings were solely "houses of worship," as many local codes still identify them. Dear Commissioners: I am a resident of Golden Gate Estates and implore that you VOTE NO on the Conditional Use Application and the Growth Management Plan Amendment, which would allow a Conditional Use at 8th Street NE and 22nd Ave NE. Permitting any Conditional Use at this location contradicts the intent, goals, policies and objectives of the Rural Golden Gate Estates Subelement of the Golden Gate Area Master Plan ("Subelement"). The Subelement, which was recently adopted on September 24, 2019, specifically provides as a Goal, the following: GOAL 4: TO PRESERVE THE AREA'S RURAL CHARACTER, AS DEFINED BY LARGE WOODED LOTS, THE KEEPING OF LIVESTOCK, THE ABILITY TO GROW CROPS, WILDLIFE ACTIVITY, ENVIRONMENTAL STEWARDSHIP, LOW -DENSITY RESIDENTIAL DEVELOPMENT, AND LIMITATIONS ON COMMERCIAL AND CONDITIONAL USES. (emphasis added). The Subelement states in Policy 4.2.3: Rural character shall be further protected by resisting site -specific Master Plan changes that are out of scale or character with the rural quality of Golden Gate Estates. This proposed conditional use would change the character of the immediate area, which consists solely of single family homes and undeveloped lots. The Subelement has already designated the areas where conditional uses, including churches, may be permitted. Those are The Neighborhood Center Subdistricts. A lot of time and effort went into identifying the appropriate locations for these Neighborhood Center Subdistricts. The Subelement states at B.I.A.2. that the Neighborhood Centers are located along major roadways and are distributed within Rural Golden Gate Estates according to commercial demand estimates. (See Rural Golden Gate Estates Neighborhood Centers Map). The centers are designed to concentrate all new commercial zoning, and conditional uses, as allowed in the Estates Zoning District, in locations where traffic impacts can be readily accommodated and to avoid strip and disorganized patterns of commercial and conditional use development. Approval of this Application at the subject site, a solely residential area, would initiate, create and promote disorganized patterns of development, contrary to the intent, goals, objectives and policies of the Subelement. Furthermore, the Subelement provides that Conditional Uses may also be permitted on lots adjacent to the Neighborhood Center Subdistricts, i.e., as a transitional conditional use. Under B.1.A.3.b. of the Subelement, Neighborhood Center Transitional Conditional Use Provisions: Conditional uses shall be allowed immediately adjacent to designated Neighborhood Centers subject to the following criteria: 1. We also have a newer congregation in Golden Gate Estates which has been renting and operating from a commercial location for several years. For the honor and glory of Christ, the Golden Gate branch membership has outgrown its facility. Consequently, we decided that it was time to build our own congregation facility with ample space to comfortably worship and serve the community without negatively impacting the existing dynamics or harmony of the area. We quickly became aware that the permitting would be a very complex and expensive process, however we really didn't expect opposition given the benevolent nature of our works and the integral part of residential communities that churches have historically served. I would like to correct some misinformation propagated in the news, social media, and communications pertaining to the Neighborhood Information Meeting schedule and the project details. Additionally, I would like to provide some insight related to the concerns that I am hearing or reading primarily related to traffic, location, and "setting a zoning precedent" that would pave the way for allowing gasoline stations among other uses. We are seeking Conditional Use and Growth Management Plan Amendment approval in residential zoning since it is historically compatible within this zoning and since commercial property is cost prohibitive for a small congregation which is self -supported. Collier County has dozens of churches located within residential zoning with conditional uses located throughout, hence this project would not set a precedent since there are already many throughout the county that have been constructed under the same circumstances. Our congregation is a small non-profit organization that simply does not have the funds, financial support, or credit to purchase a commercial location and spend millions of dollars. As custodians of God's money, we are looking to do things as financially sound as possible within what the Lord has blessed our congregation. Without this zoning accommodation the existing Growth Management Plan limits us from owning our own temple in the Golden Gate Estates area. We have not found any churches in Golden Gate Estates that have been constructed on commercial property whereby the total cost was less than $1 million dollars. More importantly, we're not looking to build a huge multimillion -dollar church which would represent a traffic impact. We are simply looking to build a small community church which only meets twice a week for a few hours. We should not be compared to lucrative organizations which operate every day and can pose concerns for residents in terms of noise, traffic, and crime. Although few people have voiced concerns about potential noise, we would like to provide some peace of mind by sharing details about our current operations. Currently, the congregation meets regularly at the rented commercial location at 13260 Immokalee Rd., Suite 7 in Naples. This congregation location shares common walls with multiple businesses and abuts the residential lots on 24th Ave NE. Throughout all the years that we have rented at this location, we have not received any complaints or noise ordinance violations. The same can be expected at our proposed facility at the corner of 22nd Ave NE and 8TH ST NE. We are not in the business of upsetting or impacting our community. We strive to be respectful, peaceful, integral, and honorable members of the community. One of the most controversial topics appears to be related to traffic concerns. I'm convinced that people opposing the construction of our temple are not aware of the county's project to build an overpass with multiple lanes on the corner of Randall Blvd and Immokalee Rd which will improve traffic flow immensely. A few years ago the County constructed the 8th St NE bridge which joined Randall Blvd. with Golden Gate Blvd to facilitate traffic and emergency services response time. The same traffic concerns were voiced by the community at the time when this bridge was proposed. However, this bridge has been a benefit to the community just as the proposed church will be a benefit. You can now exit North or South bound from 22nd Ave NE. Additionally, the county has plans to intersect 8th ST NE via Vanderbilt Beach Road. I'm confident that all the upcoming growth plans will mitigate potential traffic concerns which may be posed by uninformed members of the community. Our congregation will only meet twice a week (Wednesday and Sunday) for a few hours resulting in negligible traffic impact during non -peak hours. Finally, I would like to correct the following misinformation that has been disseminated via multiple news and social media sources about our project: 1. We're not building a three (3) story church. 2. The project DOES include a sound barrier. 3. The congregation is small with only 108 parking spaces (including a buffer for growth). 4. The plans demonstrated on NBC2 were outdated plans. 5.
