EXECUTIVE SUMMARY
Recommendation to approve the release of a code enforcement lien with an accrued value of
$141,034.74 for payment of $500 in the code enforcement action titled Board of County
Commissioners v. Terry Dilozir, relating to property located at 4913 18' Ave SW, Collier County,
Florida.
OBJECTIVE: That the Board of County Commissioners accept an offer to release a code enforcement
lien with an accrued value of $141,034.74 for payment of $500, in relation to Code Enforcement Special
Magistrate Case No. CEPM20180010711.
CONSIDERATIONS: When the subject property was owned by Terry Dilozir, the Code Enforcement
Special Magistrate ordered the imposition of a lien on the property, due to code violations consisting of a
soffit and roof in a state of disrepair. The lien was recorded on August 20, 2019, at O.R. Book 5664,
Page 3423. The lien amount of $260,473.65, based on 1,041 days of accrued fines ($250 per day from
December 15, 2018, through October 20, 2021), totaling $260,250 and $223.65 in operational costs. Mr.
Dilozor's property was sold via Tax Deed Sale and surplus funds in the amount of $119,438.91 were
applied to the recorded lien, leaving a balance of $141,034.74. The property was brought into compliance
on October 20, 2021.
Miguel Garcia acquired the property via Tax Deed recorded on September 28, 2021. Pursuant to
Resolution No. 2012-46, a request for reduction of fines may be considered, in part, when a lien
encumbers property under new ownership and the new owner has diligently pursued abatement and
achieved compliance. Mr. Garcia, a U.S. citizen who immigrated from Mexico in pursuit of the
American Dream, took title to this property unaware of an uncorrected code violation. In less than 30
days after taking title, Mr. Garcia replaced the roof, repaired the fascia, and cleaned up the property
surrounding his family's new forever home. It took substantial amounts of time and money, including
over $100,000 in repairs to make the home livable, and to achieve compliance. The property is actively
maintained, and the owner has paid $500 in settlement of fines and requests the remaining $140,534.74 in
accrued fines be waived. There are no known code violations remaining on the property.
FISCAL IMPACT: Payment of $500 in settlement of fines has been received. If approved by the
Board, accrued fines in the amount of $140,534.74 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board's
policy contained in Resolution 2012-46. -CAK
RECOMMENDATION: To waive the remaining fines in the amount of $140,534.74, accept payment
amount of $500, and authorize the Chair to sign the attached release and satisfaction of lien for recording
in the Official Public Records.

1. On December 7, 2018, Respondent*iVas-itiof violation of Collier County Code of Laws

My name is Miguel Garcia I have purchased a property located in 4913 18'" ave SW, in golden
gate city, I am a U5 citizen who immigrated from Mexico pursuing the American dream, I have worked
hard over the years to be able to have dream come true and buy home for my family so over the years
saved my money and finally was able to buy a home, the house needs about $100,000 to make it livable,
I am a working class individual just working for a living, the house needed yard clean up, new roof, and
the entire inside need to be fixed all the drywall needs to be replaced, so you see I'm going to have to
spend a lot of money to be able to make it livable , then I found that the house has some county fees,
and it had code enforcement violations like the yard clean up and the roof which I corrected with 30
days to be in compliance with the county, so I want to make a settlement offer of $500 (Five Hundred
Dollars)) and have all fees waved and get a clean title, so I am able to continue fixing and finish our

soffit of the house on his property.
2. This violation occurred on property owned by the Respondent and located at 4913 181 Avenue
SW, Naples, Florida 34116, Folio No. 36129040009.
3. Respondent was ordered to abate the violation on or before December 15, 2018 or a fine of
$250.00 per day would be assessed for each day the violations continued thereafter until
abatement could be confirmed. (A copy of the Order is recorded at OR 5593, PG 3843).
4. The violation was not abated by the Respondent as of July 5, 2019, and fines have accrued from
December 14, 2018 to July 5, 2019 at $250.00 per day for a total amount of $50,750.00.
5. Previously assessed operational costs of $111.90 incurred by the County in the original
prosecution of this case have not been paid.
Respondent, having been duly noticed for the public hearing regarding the County's Motion, was
not present at the public hearing.

8. Due to a scrivener's error regarding the beginning date of accrual of the daily fines, this Amended
Order was entered to correct the error. All remaining contents of the original Order remain unchanged
and in effect since the date of entry of the original Order.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority
granted in Chapter 162, Florida Statutes, and Collier County Ordinance No. 07-44, as amended,
IT IS HEREBY ORDERED:
A. Petitioner's Motion for Imposition of Fines/Liens is GRANTED.
B. Respondent is assessed and ordered to pay fines at the rate of $250.00 per day for the period
from December 15, 2018 to July 5, 2019 (203 days) for a total fine amount of $50,750.00.
