Agenda 12/14/2021 Item #11B (Resolution - Collier County Park & Recreation Facilities and Outdoor Areas License and Fee Policy)12/14/2021 EXECUTIVE SUMMARY Recommendation to adopt a Resolution repealing all previous resolutions establishing and amending parts of the Collier County Parks and Recreation Division Facilities and Outdoor Areas License and Fee Policy to update parking fees, boat launch fees, boat launch permit fees, and establishing new fees and requirements for both recreational and commercial users in order to support management strategy implementation for Collier County Parks and Recreation Facilities. (Estimated Fiscal Impact $1,017,291, General Fund 001) OBJECTIVE: To adopt an amended Collier County Parks and Recreation Division License and Fee Policy that provides funding for the Parks and Recreation Division to support current maintenance and management operations. CONSIDERATIONS: On November 9, 2021 (Item #11D) the Board of County Commissioners (Board) of Collier County, Florida, approved proposed Boat Ramp Park Management Strategies for Collier County Boat Ramp Parks in order to address boat ramp park oversight, parking, acquisition, and development of additional facilities. The Collier County Parks and Recreation Division License and Fee Policy has now been updated to reflect the strategies discussed by the Board and are further detailed in this Executive Summary. The Policy has also been updated to include the fee increases recommended by Staff and discussed by the Board. The Parks and Recreation Division performed a market analysis of certain fees to determine parity with other parks systems in the state. Fee data for several counties and cities were reviewed including Broward, Lee, Miami -Dade, Palm Beach, Sarasota, Naples, and Key West. Based upon this analysis and the Board's direction, staff makes the following recommendations. Pursuant to Board's direction on November 9, 2021, to develop fee change recommendations to help offset costs associated with the maintenance and operation of parks, staff makes the following recommendations. Beach Parking Fee Staff recommends an increase of the Beach Parking Fee from $8 ($7.48 + Tax) to $10 ($9.35 + Tax) per day. Staff research revealed that $10/day is the beach parking fee in Broward, Palm Beach, and Sarasota counties. This fee increase will generate an estimated $494,556 in additional proceeds annually. Collier County residents with Beach Parking Stickers will not be charged for beach parking. The beach parking fee is the largest revenue stream in the parks system. Non -Resident Recreational Boat Launch Annual Permit Fee Staff recommends that the Board establish a non-resident recreational boat launch permit fee. Currently, recreational boat launch permits are issued to both county and non -county residents for $107 ($100 + Tax) annually for motorized launches and $53.50 ($50 + Tax) annually for non -motorized launches; recreational permit holders are not required to pay for individual boat launches. The updated fee schedule provides that Collier County residents will continue to be able to purchase a recreational boat launch permit for $107 annually. Non -Collier County residents will be required to pay $267 ($250 + Tax) annually for motorized launches and $133.75 ($125 + Tax) annually for non -motorized launches. A total of 939 motorized and 59 non -motorized recreational boater annual permits were sold in 2021; approximately ten percent (10%) of permit holders were non -county residents. This fee will generate an estimated $14,460 in additional proceeds annually. Packet Pg. 513 12/14/2021 Commercial Boat Launch Fees and Restrictions on Annual Permits On November 9, 2021, the Board reviewed the Commercial Boat Launch Fee and Restriction recommendations of the Parks and Recreation Advisory Board. The Board provided feedback and directed staff to develop a proposal in keeping with their guidance. Staff, therefore, recommends an increase to commercial boat launch permits, which are currently $107 ($100 + Tax) annually. The proposed Fee Policy includes an escalating, tiered commercial boat launch fee where the first permit will be $267.50 ($250 + Tax) annually, the second permit will be $374.50 ($350 + Tax) annually, and the third or subsequent permit will be $481.50 ($450 + Tax) annually. These changes will generate an estimated $39,450 in additional proceeds annually. The proposed Fee Policy also caps the total number of Commercial Launch Permits to 180 per year, consistent with the Board's direction. Only companies that were issued a permit in 2021 will be issued commercial launch permits. Each company will be issued no additional commercial launch permits annually than the total number they were issued in 2021. Additional requirements pursuant to direction from the Board have also been added. Commercial trailers that carry more than 4 motorized vessels may no longer park in a Collier County boat ramp park. Commercial permit holders are now required to carry active liability insurance and indemnify the County, required coverage and limits have been coordinated with the County's Risk Management Division. All vehicles and boat trailers must park within designated parking areas. Motorized Boat Launch Fees and Non -Motorized Boat Launch Fees Pursuant to Board's feedback and direction on November 9, 2021, to implement a strategy to develop fee change recommendations; staff developed this proposed fee increase to support the ongoing maintenance and operation of Parks. To provide the resources to better meet public demand, staff recommends an increase to the motorized boat launch fee from $8 ($7.48 + Tax) to $10 ($9.35 + Tax) per launch, as a nominal increase to be in line with other jurisdictions. The non -motorized launch fee will be increased from $4 ($3.74 + Tax) to $5 ($4.67 +Tax) per launch. $10/day is the motorized boat launch fee in Broward, Lee, Palm Beach, Sarasota, and Miami -Dade counties, as well as the City of Naples. These fee increases will generate an estimated $213,491 in additional proceeds annually. Boat Launch Parkine Fee The proposed Fee Policy incorporates a parking fee at County boat launch parks in the amount of $10 ($9.35 + Tax) per day for those boat launch users without a resident beach parking sticker. This proposed fee will bring the Collier County fee policy into line with other jurisdictions that are charging fees for parking at boat launches. Our sister municipalities have similar parking fees, but those rates are, in most cases, higher than the proposed $10/day rate. Once these fees are approved by the Board, they can be implemented and collected via the meters already installed and ready for use at the boat launches. Staff has estimated that this fee will generate an estimated $255,334 in additional proceeds annually, based on FY2019 data showing there were 109,283 vehicles parked at boat launches. These additional funds will be used to partially offset the costs of additional staffing and maintenance at county boat launches. Collier County residents with Beach Parking Stickers will have the same existing arrangement at boat launch parks as they have at beach parking lots and will not pay for daily boat launch parking. These fee policy changes shall be effective January 1, 2022. Packet Pg. 514 12/14/2021 FISCAL IMPACT: Operating and sustaining the premiere Parks system that we have in Collier County requires significant ongoing facilities and amenities related funding. The adoption of the proposed License and Fee adjustments will generate additional estimated General Fund (001) revenue of $1,017,291 annually. The additional funding will be used to support the ongoing maintenance and preservation of Collier County Parks and Recreation Facilities. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for Board approval. -SAA GROWTH MANAGEMENT IMPACT: Providing a better balance of recreational and commercial use at Collier County public boat ramp facilities is consistent with and supports Policy 1.3.2 in the Recreation and Open Space Element of the Collier County Growth Management Plan - Collier County shall continue to ensure that access to beaches, shores and waterways remains available to the public. RECOMMENDATION: To adopt the proposed Resolution repealing all previous resolutions establishing and amending parts of the Collier County Parks and Recreation Division Facilities and Outdoor Areas License and Fee Policy, updating parking fees, boat launch fees, boat launch permit fees, and establishing new fees and requirements for both recreational and commercial users. Packet Pg. 517 11.B.1 NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY THAT: PURPOSE The purpose of these policies is to ensure appropriate and maximum use of facilities, outdoor areas and programs in Collier County, to include Conservation Collier Preserve Lands, and provide equitable fees and charges collected from users of such facilities, outdoor areas, programs, and Preserve Lands, II. LIMITATIONS The Parks and Recreation Director, or his designee, may waive enforcement or application of any of these regulations or restrictions with respect to any facility, outdoor areas, or program, or with respect to any Preserve Lands, provided such waiver does not harm the natural resources or interfere with public safety or enjoyment. No fees may be waived. The Board of County Commissioners shall set fees and charges for all facilities and programs. Fees for County - sponsored special events shall be set by the Board prior to the event. Those fees not identified in the fee policy are approved by the Board of County Commissioners through the budgeting process (the division will identify those fees each year as they are created and applied to the budget). Consistent with Collier County's policy of ensuring all citizens equal opportunity to participate in programs, any resident requesting special consideration must substantiate to the Parks and Recreation Director proof of financial need for child care programs. All information provided is not confidential but will be used only for the purpose of establishing reduced or waived program fees. Rates and charges can be modified on a case -by -case basis if approved by the Parks and Recreation Director for special promotional sales, and advertisements, contractors working on park property, volunteer organizations participating in Keep Collier Beautiful, Bay Days, and related clean-up events, visiting investigators conducting research on park property, and schools, colleges and universities participating in field based education programs that provide a valid public purpose or stimulate increased utilization of programs. III. LICENSE AND FEE POLICIES. a. The County Parks and Recreation Division Facilities and Outdoor Areas License and Fee Policy is hereby re-established as set forth in Exhibit A to this Resolution. b. The Conservation Collier Preserve Lands License and Fee Policy is hereby established as set forth in Exhibit B to this Resolution. C. The Golden Gate Community Center Nees are set forth in Exhibit C to this Resolution. IV. EFFECTIVE DATE. This Resolution shall become effective January 1, 2022. B. User Categories -- Applicable to all indoor and outdoor areas Governmental entities are not subject to fees. All other facility users shall have fees determined by the category of the entity. Note: All parks shall remain open to the public. The two categories are: Category I — Federal Income Tax Exempt Entities, Registered Charities, Not -for -Profit Groups. a a. Federal Income Tax Exempt Entities U_ U) Y L Groups that are exempt from taxation under any subsection of Section a 501(c) of the Internal Revenue Code. Specified Sales Tax Exempt Entities Those entities that are exempt from Florida sales taxes pursuant to Subsection 212.08 (7), Florida Statutes such as a home for the aged, nursing home, hospice, or an organization whose primary purpose is to provide special educational, cultural, recreational, or social benefits to minors, or is a religious, charitable, scientific, educational, or veterans' organization. Local Not -for -Profit Groups or Non -Profit Groups Entities, irrespective of tax exempt status, which are not -for -profit corporations, organizations or other not -for -profit entities that are of Collier County origin, have their principal location in Collier County, and of which fifty per cent (50%) of the group's membership are residents of Collier County, with a primary purpose to provide social services to others or to protect interests outside of the group, such as the environment, endangered animals, disadvantaged persons, or some other similar external interest. Collier County residents may obtain a beach parking permit at no charge. Permits will be valid for one year. Vehicles with permits will be exempt from daily parking fees at all beach parking facilities. This permit will be permanently affixed on the bottom, inside, driver's side of the windshield. b. Commercial entities and organizations operating excursion or shuttle services, delivering equipment or off -site non -contracted (exclusive) beach amenities, may purchase commercial beach parking permits for $1500 annually, which shall be valid for one year from the date purchased. In the alternative, the same commercial entity or organization may pay a daily fee of two times the per vehicle day fee. Additionally, permit holders will be required to pay the applicable daily launch fee per vessel per launch for motorized and non -motorized vessels directly involved in commercial activity. All commercial permits expire December 31 st regardless of date of purchase. Fees will not be prorated. f. Commercial trailers that carry more than 4 motorized vessels may not park at a Collier County boat ramp park. Commercial launch permit holders shall encourage and promote ridesharing and shuttling of commercial customers to County boat ramp parks. Packet Pg. 541 11.B.1 2 IV. V. Offsite Preservation Fees pursuant to Land Development Code Section 3.05.07 HA J. vi.a.and b. 1. Monetary payment alternative. Applicants shall make monetary payment to Collier County. Such funds shall be used by the County for the purchase and management of off -site conservation lands within the County. The monetary payment amount shall be based on the post development appraisal value per acre multiplied by the preserve requirement, then multiplied by 1.25 to establish the endowment amount. 2. Land donation alternative. In lieu of monetary payment, applicants may choose to donate land for conservation purposes at a ratio of 4:1 to Collier County or another government agency. Lands donated to Collier County must include a cash endowment for management of the land at a ratio of 4:1 of the acreage of the lands donated, and at a cost of $130,000 per acre or portions thereof, 3. Fee for initial exotic vegetation removal for lands donated to Conservation Collier - $16,000 per acre or portions thereof. CONCESSION FEES. A. For each Category II concession booth/location a $20.00 fee per event or 20% of gross revenues per day will be charged, whichever is greater, for each concession booth/location. B. Concessionaires contracted by the County to serve the general public will pay a negotiated fee in lieu of the general fee schedule. C. Category I users may conduct fundraising activities and/or sell merchandise without fees at Collier County co -sponsored events for the express purpose of fundraising for their organization. SALE/SERVICE OF ALCOHOLIC BEVERAGES. The sale/service of alcoholic beverages is prohibited at all Collier County Preserve Lands. REQUIREMENTS CONCERNING USE OF GROUNDS AND FACILITIES. A. The user shall be responsible for submitting plans for security, crowd control, traffic, refuse, garbage, debris, and sewage disposal before, during and after operation of the event. Such plans should be submitted to the County Manager or his designee, for review and approval. B. The user shall clean up all debris, extinguish all fires when such fires are permitted, and leave the premises in good order, and the facilities in a neat and sanitary condition. No person shall dump, deposit, or leave any bottles, broken glass, ashes, paper or other trash anywhere on the ground of the preserves other than in proper receptacles provided therefore, and no such refuse or trash shall be [21-P[J B-00060/ 1685239/11 26 V 0 a U- Y L a. co I- W 0 N. While receptacles are provided, all rubbish or waste generated by the event shall be carried away from Collier County Preserve lands by the person responsible for its presence, and properly disposed of elsewhere. C. If sanitary service is not available at Preserve Lands, the user will be responsible for hiring a licensed sewage disposal business. D. The user shall be responsible for hiring necessary personnel to handle security, crowd control and traffic. E. Estimated attendance with groups of 30 or more must have $300,000 liability insurance and Board of Collier County Commissioners must be named as co-insured. F, If the facility and/or grounds are not returned in the condition they were o found, the security deposit will be retained up to the amount necessary to return the facility to the condition found.
