Second by Mr. Ricardo. Carried unanimously 5 - 0. III.Approval of Minutes – Meeting of July 20, 2020 Dr. Ritter moved to approve the minutes of the July 20, 2020 meeting as presented. Second by Mr. Ricardo. Carried unanimously 5 - 0. IV.Items Requiring Action by Authority A. Final Order 2021-01 – Annual Price Index Mr. Kovensky presented Final Order 2021-01 for consideration. He noted the request is for the Authority to approve the Final Order which establishes a 2021 Price Index of 1.17 percent for investor-owned water and wastewater utilities operating in Collier County and the City of Marco Island. County Ordinance 96-6, as amended, requires the Authority to adopt each year the Annual Price Index established by the Florida Public Service Commission. The Florida Public Service Commission established and approved its 2021 Annual Price Index of 1.17. Mr. Kovensky provided an update on the Authority’s request for information at the July 20, 2020 meeting by noting that the Florida Public Service Commission uses the Federal GDP in its price index calculation. Ms. Arora moved to approve Final Order 2021-01, establishing the 2021 Price Index of 1.17 percent for investor-owned water and wastewater utilities operating in unincorporated Collier County and the City of Marco Island. Second by Dr. Ritter. Carried unanimously 5 – 0. B.Annual Election of Officers Ms. Arora nominated Patricia Sherry as Chairman of the Collier County Water and Wastewater Authority. Second by Dr. Ritter. Carried unanimously 5 – 0. Dr. Ritter nominated Eloy Ricardo as Vice-Chairman of the Collier County Water and Wastewater Authority. Second by Ms. Arora. Carried unanimously 5 – 0. V.Staff Discussion A.Ave Maria Utility Company Developer Agreements Mr. Kovensky provided copies of Ave Maria Developer Agreements for the record. The agreements are required to ensure the utility has the capacity to provide service to new construction. No action is required by the Authority, and the item is for informational purposes. Mr. Kovensky noted that in response to the Authority request at the July 20, 2020 meeting, staff created a summary sheet of the Ave Maria Developer Agreements which is provided in the agenda packet. During Authority discussion, the Authority requested Staff: 2 1. Contact Ave Maria Utility Company to determine if the Max daily MGD for Water can be greater than the Max Daily MGD for Wastewater and if the data on pg. 74 of the Agenda packet showing the Max Daily MGD for Water is less than the Max Daily MGD for Wastewater is correct or a typo by Ave Maria Utility Company. 2.Provide the technical definitions, if any, for the following terms – Capacity Reserved Water MGD, Capacity Reserved Wastewater MGD, Max Daily Flow for Water, and Max Daily Flow for Wastewater. B.Follow up on requests from meeting of July 20, 2020 Mr. Kovensky provided an update on Authority requests for information at the July 20, 2020 meeting by noting he contacted the Ave Maria Utility Company and received the following information in an email response (a copy will be forwarded to Members for their records): •The Utility currently serves 2,600 homes with another 700 under contract for sale. •The total number of planned homes is 9,700; however, this number will be increased to 11,000 as additional lands are permitted within the franchise area. •The current permitted capacities are 0.999 MGD for water and 0.90 MGD for wastewater (WW). •Rated capacities are 1.67 MGD for water and 1.25 MGD for WW (if needed). •In 2020, the average daily flow was 0.517 MGD for water and 0.464 MGD for WW. •In January of 2021 the average daily flow was 0.524 MGD for water and 0.494 MGD for WW. •In February of 2021 the average daily flow was 0.555 MGD for water and 0.494 MGD for WW. During discussion, it was noted the design usage is calculated on the highest flow anticipated for the system, not the volume of wastewater treated by the facility. REQUESTED APPROVAL: Based on staff’s review of the attached application and its supporting documentation, staff finds this request consistent with Collier County Ordinance No. 96-6, as amended, and seeks action by the AUTHORITY. REPORT: By letter dated August 16, 2021 (attachment “G”), AMUC filed a petition “Ave Maria Utility Company, LLLP – revisions to miscellaneous service charges and meter installation fees” with the Utility Regulation Section to a) change all meter installation fees to “actual cost,” b) increase backflow prevention violation fees, c) increase meter tampering fees, d) increase unauthorized water use fees, and e) add additional plan review fees. 4 Meter Installation Fee AMUC is proposing to change how they charge for meter installations due to current material and labor cost increases. Currently, only meters over two inches are charged at “actual cost,” while all other meter sizes have defined set costs spelled out in the tariff. Upon approval, AMUC will charge all meter sizes at “actual cost.” Flow Test/Bench Test Fee In the original petition (attachment “G”), AMUC proposed adding a flow test fee and charging $165 for the service. After subsequent correspondence between County staff and AMUC, it was determined that this service was already covered in the tariff and referred to as a “bench test.” The bench test is currently charged at “actual cost” and AMUC does not wish to change the fee. The bench test fee is found in the original location on the “First Revised Sheet No. 10.0” and was added to the “Third Revised Sheet 16.1.” Backflow Prevention Violations/Disconnection Fee Meter Tampering Fee Unauthorized Water Use Fee AMUC is proposing to increase the fees for each of these services from $75 to $250, citing the current fee does not cover the costs for staff to provide these services. Furthermore, they hope the increase in fees will help discourage these violations from occurring, as they cite the increasing volume of backflow violations and unauthorized use. They are adding the increase to meter tampering fees to keep costs similar across like fees. Plan Review Fee Plan Review fees are allowed to be charged for engineering plans or designs for the construction of facilities by AMUC’s customers per the Collier County Supplemental Rules (“Rules”) (section 7.15 “Inspection Fees”) to Collier County Ordinance 96-6, as amended. Currently, AMUC charges up to 3% for the review fee, although the Rules (section 7.5 “Agreements for Service; Performance Under Agreements”) allow for up to 10%. As developers have been revising their site development plans, site improvement plans, and project phasing, AMUC proposes adding a new charge for an “Insubstantial Change to SDP or SIP” and an additional charge for “Project Phasing.” They propose adopting the same charges Collier County charges their customers for similar services as defined in the Growth Management Department Development Services Fee Schedule. Miscellaneous Fees Aligning Wastewater with Water During correspondence between County staff and AMUC, it was discovered that the original tariffs for water and wastewater miscellaneous charges were not aligned. Consistent with Ave Maria’s 2014 petition for changes to miscellaneous charges, please provide a strike‐through  and underlined version of the tariff sheets. This will help the Authority members have visibility to the changes  you are requesting.  2. For the meter installation fees, what do the abbreviations “mtr” and “mxu” mean in the Schedule of Meter  Installation Costs. It looks like the actual costs for the ¾”, 1”, 1.5”, and 2” represent increases over the current  tariff of 14%, 3%, 76%, and 52%, respectively, at current rates. Based on your labor rate, it appears it takes 2.5  hours to install a meter. Please confirm.   MTR = Meter   MXU = also called an ERT, this is the device connected to the meter that allows the meter to communicate.   It takes approximately 2.5 hours of labor from request to installation. This includes accepting the request,  processing the request, creating/charging the customer, field work to install, process install paperwork, notify  customer of install and backflow due.  3. The flow test fee looks like it is a new charge. How did AMUC charge for this service up to now, and what was  the charge? It is not listed on the current tariff. – original sheet 10, section 23.0 refers to testing, our tariff refers  to it as a bench test, we use a 3rd party testing company, to be clear, we have never used this to date, however,  we recently had to do this for the irrigation side of the house which is why we know the actual cost of the test  from Mars and needed to get it in place and accurate pricing before it is needed.  a. Please add the flow test fee to the definitions on the Water Sixth Revised Sheet NO. 16.0 and the  Wastewater Fifth Revised Sheet NO. 16.0.  b. We believe the Water “Second Revised Sheet 17.0 Cancels First Revised Sheet NO. 17.0” should read  “Third Revised Sheet 16.1 Cancels Second Revised Sheet NO. 16.1” based on the updates from the 2014  petition. “Continued on Sheet No. 16.1” should be added at the bottom of the sheet.  16 2 c. Regarding the Wastewater changes, it is difficult to reconcile the sheet changes from current to  proposed. We will review after a strike‐through and underlined version is provided.  1. The backflow violation, meter tampering, and unauthorized fees are increasing 233% (from $75 to $250). – Yes  this was done to hopefully influence behavior as we are experiencing high volumes of backflow violations and  unauthorized use. We like to keep all the fees around the same cost which is why meter tampering was  included.  2. For the plan review charges, where is it documented that AMUC is allowed to charge a 3% plan review fee? The  Rules (section 7.15) state that “…the utility shall charge an inspection fee and plan review fee based upon the  actual cost to the utility for that review of such plans and inspections of said facilities constructed by the  developer.” Additionally, for both the water and wastewater tariffs, under Original Sheet NO. 27.0, 11.0 Plan  Review Fees, actual costs are specified for the plan review fees. What justification is there to adopt the County’s  Fee Schedule rates? This one I am struggling with, this was more to get control over what is being submitted and  how, less phasing, etc. – Jason can you weigh in on this one….. Sorry for the delay. I think Tammy got back to you quickly on most of your questions. I will try to address the remainder;  (1) As to type and strike. I am afraid we did not save it that way so it is impossible to reconstruct in that manner  without retyping the tariff sheets. As you can see the old water and wastewater sheets were significantly  different. Since they deal with the same subject we thought they should be uniform. The Water Sheets were  more complete so we first converted the 3 Wastewater tariff sheets to look exactly like the 3 Water Tariffs. Then  from there I have tried to highlight where the changes are to the tariffs. These highlighted pages are attached. .  (2) In order to avoid confusion and the need for an additional definition for the “flow test fee” I have instead  changed this in the attached Revised tariffs to “Bench Test Fee” which is already defined within the tariff. We  are talking about the same thing and therefore do not want to introduce a new term into the tariff for no  reason. . Since “Bench Test” term is already defined on Tariff Sheet 10.0 Section 23.0, I have not put the  redundant definition on Sheet 16.0. I do think this requires changing “Actual Cost” on Sheet 10.0 for the 5/8” x  ¾” meter to the proposed $165. So I have added that small revision to the attached tariff pages. .   (3) I have corrected the page numbering as you requested and have added the “(continued on sheet 16.1)”  language to the bottom of both sheets 16.0.  (4) As far as the magnitude of the proposed changes to the backflow violation, meter tampering, and unauthorized  use fees, as noted by Tammy, we are trying to discourage these intentional or negligent violations and to avoid  the inevitable consequence of the general body of rate payers footing the bill when they do occur and the fees  charged are insufficient. As you might imagine the work of the utility in dealing with them can vary from case to  case and we felt these uniform discouraging charges could best accomplish the goal.   (5) Finally as to the “Plan review” and “Insubstantial Change and “Phasing” charges proposed, I offer the following  explanation and justification;  The 3% charge came about as a result of the need to go away from flat charges and to avoid estimating “actual  cost” in each unique case. As you are probably aware the provisions of Rule 7.5 specifically allow up to a 10%  fee. The PSC has an almost identical rule. In my experience with PSC regulated systems most of my clients have  always charged the 10% fee up front. The PSC has never required an accounting of that charge in my 45 years . I  assume because they realize it is a reasonable estimate of the utilities actual costs. Recognizing that this is an  authority granted by rule, the PSC does not require that the charge accessed be outlined in the tariff. AMUC has  never chosen to require a full 10% fee. Apparently they had felt that 3% was sufficient. Obviously by our filing  we believe that in cases where there are changes proposed by the developer the 3% has proven to be  inadequate. Thus our proposed changes. Rather than increase the fees to 10% but still not burden the general  body of ratepayers with costs related to changes by developers, the Utility wanted to add relatively small  supplemental charges to developers who make changes to their development plans or request to Phase those  plans. We believe this will still not approach the 10% we are authorized by rule to access . As far as using the  county charges, we felt like rather than attempt to estimate the actual costs for each unique case we would  utilize the county developed charges for these same functions since we assumed that those were based on the  23 2 county’s estimate of actual cost for those functions. We believe that our proposal is well within the rules under  sections 7.15 and 7.5 and our existing tariff, and would be cheaper for developers than accessing the 10% while  still protecting the general body of ratepayers from subsidizing these developers. The flow test fee looks like it is a new charge. How did AMUC charge for this service up to now, and what was  the charge? It is not listed on the current tariff.  a. Please add the flow test fee to the definitions on the Water Sixth Revised Sheet NO. 16.0 and the  Wastewater Fifth Revised Sheet NO. 16.0.  b. We believe the Water “Second Revised Sheet 17.0 Cancels First Revised Sheet NO. 17.0” should read  “Third Revised Sheet 16.1 Cancels Second Revised Sheet NO. 16.1” based on the updates from the 2014  petition. “Continued on Sheet No. 16.1” should be added at the bottom of the sheet.  c. For the plan review charges, where is it documented that AMUC is allowed to charge a 3% plan review fee? The actual cost to the utility for that review of such plans and inspections of said facilities constructed by the makes sense to avoid updating the charge when outside contractors change it again. This is carried over to sheet 16.1 of  the Water tariff. So the only update on Water 10.0 is to change the revision number and issuing officer. Water Pages  16.1 and 17.0 have been otherwise updated as we agreed.     The wastewater tariffs have been revised to eliminate 16.1 and consolidate the relevant aspects of 16.0 and what we  originally filed as 16.1 into page 16.0. Page 17.0 is revised as we agreed. No temporary pipes, nipples or spaces are permitted and under no circumstances are connections allowed that may permit water to by-pass the meter or metering equipment. 22.0 ADJUSTMENT OF BILLS - If a customer has been overcharged or undercharged as a result of an incorrect application of the rate schedule, incorrect reading of the meter, incorrect connection of the meter or other similar reasons, the amount overcharged or undercharged, may be refunded or credited to the Customer’s bill, in the Company’s discretion, as the case may be. 23.0 ADJUSTMENT OF BILLS FOR METER ERROR - When meter tests are made by the Authority or by the Company, the accuracy of registration of the meter and its performance will be Judged by its average error. The average meter error will be considered to be the average of the errors at the test rates of flow. FAST METERS - Whenever a tested meter is found to register fast, in excess of the tolerance provided in the Meter Accuracy Requirements of this Tariff, the Company will refund to the Customer the amount billed in error for one-half of the period since the last test; however, the one-half period may not exceed six months. If, however, it is shown that the error was due to a specifically identifiable cause, the date of which can be fixed, the overcharge will be computed to, but not beyond, such date. The refund, however, will not include any part of any minimum charge. METER ACCURACY REQUIREMENTS - All meters used for measuring the quantity of water delivered to a Customer will be in good mechanical condition and will be adequate in size and design for the type of service that they measure. This request is part of a phased increase to water and wastewater rates over five years for the Utility’s customers in Collier County that was previously approved by the Authority under Final Order No. 2017-01 (Attachment “B”). On August 16, 2021, in response to staff’s request for more information needed to validate the petition, the Utility submitted updated calculations and a revised tariff sheet, resulting in a change to the Regulatory Assessment Fee for Gallonage Charge Construction on the Water Rate Schedule GS from $0.11 to $0.12 (Attachment “C”). In the original application to the Authority, filed on March 4, 2016, and approved by Final Order 2017-01 and adopted on March 31, 2017, the Utility requested a phased annual revenue increase for five years, based on a combination of three factors: (1) a 5% annual increase; (2) a percentage increase based on the annual Florida Public Service Commission price index; and (3) 25% of the cost of preparing and going through the rate case process for the first four yearly phases. Even though the original petition to increase rates had been previously approved for the five-year period, the Utility is still required to submit an application each year to reflect the current adopted Florida Public Service Commission price index. The Authority adopted Final Order No. 2021-01 (Attachment “D”) on April 19, 2021, establishing the 2021 Price Index of 1.17%. Staff reviewed the petition which reflected the Utility’s requested increase to rates in the fifth year of the five-year approved period. This review included ensuring the required documents were filed, the methodology used was appropriate, the calculations were correct, and the revised tariff sheets reflected the approved rate increases. Staff is satisfied all requirements were met. The petition resulted in rate increases of 5.66% for water service and 5.58% for wastewater service.
