Agenda 11/09/2021 Item #16A11 (Purchase Parcel 157FEE - Lake Kelly Outfall Maintenance)11/09/2021 EXECUTIVE SUMMARY Recommendation to approve the purchase of a property (Parcel 157FEE) required for maintenance of the Lake Kelly Outfall east of Bayshore Drive with an estimated fiscal impact of $52,500 from within the Stormwater Capital Improvement Fund (325) and approve the required budget amendments. (Project No. 50169) OBJECTIVE: To acquire the property necessary for maintenance of the Lake Kelly Outfall. CONSIDERATIONS: Located off Bayshore Drive at the end of Barrett Avenue, the subject property (Parcel 157FEE) consists of approximately 9600 sq. ft. and is ideally situated for use as a staging area for the ongoing maintenance of the Lake Kelly Outfall. The Valuation Memorandum prepared by the Transportation Division’s in-house appraiser, Harry Henderson, estimates the value of Parcel 157FEE to be $52,300. The owner, Reid Sammons, as Trustee of the Reid Sammons Revocable Trust, has agreed to sell the property to the County at that price. Staff is recommending that the Board approve the attached agreement and authorize the purchase of this property. FISCAL IMPACT: The estimated fiscal impact associated with this item is $52,500 and includes the purchase price of $52,300 plus recording and miscellaneous closing costs estimated not to exceed $200. Funds are available in Project No. 50169 within the Stormwater Capital Improvement Fund 325. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - JAB GROWTH MANAGEMENT IMPACT: This Project is in accordance with the goals, objectives, and policies of all applicable sections of the Stormwater Management and the Conservation and Coastal Management elements of the Growth Management Plan. RECOMMENDATION: (1) Approve the attached Purchase Agreement for Parcel 157FEE and authorize the Board’s Chairman to execute same on behalf of the Board; (2) Accept the conveyance of Parcel 157FEE to Collier County and authorize the County Manager or his designee to record the conveyance instrument in the public records of Collier County, Florida; (3) Authorize the payment of all costs and expenses necessary to close this transaction; (4) Authorize the County Manager or his designee to take the necessary measures to ensure the County’s performance in accordance with the terms and conditions of the agreement; and (5) Approve any and all budget amendments which may be required to carry out the collective will of the Board.
