Agenda 11/09/2021 Item #17C (Ordinance - Confirming Hyde Park CDD District 1)11/09/2021 EXECUTIVE SUMMARY Recommendation to adopt an Ordinance ratifying and confirming Ordinance Number 2021 -11, which established Hyde Park Community Development District 1, to acknowledge and correct a scrivener’s error related to the Landowner’s Consent set forth in the Petition of Establishment. _____________________________________________________________________________________ OBJECTIVE: To have the Board of County Commissioners adopt an Ordinance ratifying and confirming Ordinance 2021-11, which established Hyde Park Community Development District 1; providing for retroactive applicability; providing for conflict and severability; providing for inclusion in the code of laws and ordinances; and providing an effective date. CONSIDERATIONS: Following the Board’s adoption of Ordinance 2021-11, it was determined that there was a scrivener’s error in the Landowner’s Consent to Establishment (“Consent”) included in the petition to establish Hyde Park Community Development District 1 (“District”). Neal Commun ities of Southwest Florida, LLC (“Neal SWFL”) was the petitioner that submitted the petition to establish the District to the Board of County Commissioners. The Consent was signed by James R. Schier on behalf of Neal SWFL. While the vast majority of the property in the District is owned by Neal SWFL, a small portion of the District property is owned by Hyde Park Land Holdings, LLC (“HPLH”). HPLH and Neal SWFL are affiliated entities with James R. Schier being the authorized signatory of each. Each is un der the umbrella of developer Neal Communities, Inc. James R. Schier has provided a scrivener’s error affidavit that he intended to sign the Consent on behalf of both Neal SWFL and HPLH. A corrected Consent has been provided to clarify the record for the District. FISCAL IMPACT: It should be noted that this Ordinance is only to ratify and confirm Ordinance 2021-11 that was approved by the Board. Therefore, this change by and of itself will have no fiscal impact on the County. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this action. LEGAL CONSIDERATIONS: This item has been reviewed as to form and legality and requires a majority vote for Board approval. -SAA RECOMMENDATION: The Board adopt the proposed Ordinance to ratify and confirm Ordinance 2021-11, which established Hyde Park Community Development District 1, to acknowledge and correct a scrivener’s error related to the Landowner’s Consent set forth in the Petition of Establishment and clarify the record. It came to our attention recently that there was a scrivener's error in the Landowner's Consent to Establishment of Hyde Park Community Development District 1 (the "Consent"). Neal Communities of Southwest Florida, LLC, a Florida limited liability company ("Neal Communities SWFL") was the petitioner that submitted the petition to establish the District to the Board of County Commissioners. Attached to this letter is an Affidavit of Intent and Scrivener's Error executed by James R. Schier summarizing the scrivener's error and reflecting that he intended to sign the Consent on behalf of both Neal Communities SWFL and Hyde Park LH. Included as an Exhibit `B" to the Affidavit is a corrected Consent form. Because under Chapter 190, Florida Statutes, one of the submittal requirements is the "documentation demonstrating that the petitioner has control by deed, trust agreement, contract, or option of 100 percent of the real property to be included in the district," out of an abundance of caution and to remove any question on the consent to the establishment, we thought it best to provide the corrected Consent form to the County and request that the County adopt a confirming Ordinance at a public hearing. All property in the District remains owned by Neal Communities SWFL and Hyde Park LH. Attached is a draft Ordinance for consideration and review. The adoption of the Ordinance would be advertised consistent with the procedures in Section 190.005, Florida Statutes. Back in August, the city-owned Or- lando Utilities Commission asked resi- dents to stop watering their lawns or washing their cars because liquid oxy- gen that is used for treating the city’s water was being diverted to hospitals for patients suffering from the virus. The utility made the decision as it faced the prospect of getting only half of its usual shipment of liquid oxygen used for water treatment. Around the same time, the Tampa Water Department started using chlo- rine instead of its usual liquid oxygen method to disinfect its water of viruses and bacteria because liquid oxygen was being diverted to local hospitals. Utility officials in Orlando said Tues- day that residents can resume their nor- mal water use, including irrigating their lawns and washing their cars.
