EXECUTIVE SUMMARY
Recommendation to approve the selection committee's final ranking for Request for Proposal
("RFP") No. 21-7924, "CMAR for Golden Gate Golf Course," and authorize staff to begin contract
negotiations with the top ranked firm Gates Group LLC d/b/a Gates Construction, so that a
proposed agreement can be brought back for the Board's consideration at a future meeting.
OBJECTIVE: To obtain professional Construction Management at Risk ("CMAR") services for the
development of the Golden Gate Golf Course.
CONSIDERATIONS: On August 26, 2021, the Procurement Services Division released notices for RFP
No. 21-7924, CMAR for Golden Gate Golf Course. The proposal due date was extended two times and
outreach was made in advance of the solicitation, and during the due date extension to firms that viewed
the RFP. The County received one proposal by the October 12, 2021, submission deadline. Staff found
the proposal to be responsive and responsible.
A selection committee met on October 27, 2021, scored the proposal, and ranked Gates Group LLC d/b/a
Gates Construction ("Gates" or the "firm") number one. The evaluation criteria used in scoring the
proposal included: the ability of professional personnel; whether the firm is a certified minority business
enterprise; past performance/references, project approach, willingness to meet time and budget
requirements, location; recent, current, and projected workloads of the firm; and financial strength and
liabilities of the firm. The firm provided at least three references from clients on projects of a similar size
for which the firm had provided services similar in scope and complexity.

Gates Group, LLC d/b/a Gates Construction is a Bonita Beach firm and has been in business since 2018.
Gates is a well-known local name with a 26-year presence in construction. Its related company Gates
Butz Institutional Construction LLC completed the Freedom Memorial, and Gates Group LLC is
currently on the Construction Management Services annual contract and has proposed/submitted on
previous County CMAR solicitations and bids.
Staff recommends that the Board approve the selection committee's final ranking and authorize staff to
begin contract negotiations with the top -ranked firm, Gates Group, LLC d/b/a Gates Construction. If an
agreement cannot be reached with the contractor, staff will consider resoliciting this RFP.
FISCAL IMPACT: Approval of this item does not result in a direct fiscal impact. The County's
obligation pursuant to the Big Shots contract is $7,000,000. This will be funded with exiting
appropriations or Reserves. A funding recommendation will be prepared and presented along with the
negotiated contract.
GROWTH MANAGEMENT IMPACT: There are no Growth Management Impacts associated with
this Executive Summary.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote
for Board approval. -SRT

INTRODUCTION
As requested by the Facilities Management Division (hereinafter, the "Division or Department"), the Collier County Board of County
Commissioners Procurement Services Division (hereinafter, "County") has issued this Construction Manager at Risk (CMAR)
Request for Proposal (RFP) Solicitation (hereinafter, "CMAR RFP") with the intent of obtaining proposals from interested and
qualified Construction Managers in accordance with the terms, conditions and specifications stated or attached. The Proposer, at a
minimum, must achieve the requirements of the Qualifications, Specifications, or Scope of Work stated.
It is Collier County's intent to develop a portion of the recently purchased Golden Gate Golf Course property, more specifically
described below and in the backup documentation on the online bidding system, for a Nicklaus endorsed 12-hole executive golf
course in addition to the development of the necessary infrastructure for further site development. The goal of this project is to
effectively redevelop the Golden Gate Golf Course while creating a sense of place for the community and provide opportunities for
individuals of all ages and skill levels to participate in and learn the game of golf.
BACKGROUND
The former Golden Gate Golf Course is approximately 167 acres that was developed as an 18-hole golf course between 1963 and 1973.
The property is located on the southwest corner of the intersection of Collier Boulevard and Golden Gate Parkway in Collier County within
the Golden Gate City Economic Development Zone. The County has a new amateur sports and entertainment complex less than a mile
away from this location. The location is also less than a mile from the intersection of I-75 and Collier Boulevard a major transportation
hub. The County took ownership of the former Golden Gate Golf Course on July 31, 2019 and chose not to continue golf operations while
maintaining the property in the interim. Currently, the County does not provide a public golf course or golf facility.
The Board approved a Long -Term Lease and Operating Agreement with CC BSG Naples, LLC ("BigShots") to operate and manage a
twelve -hole public golf course on the former Golden Gate Golf Course property, to lease land for the construction and operation of a
BigShots golf/entertainment facility to benefit the residents of Collier County and support the overall redevelopment plan for the property.
A portion of the eastern property line will be utilized for the Collier Boulevard widening project. As part of the widening project,
construction of sidewalks and pedestrian interconnects/crosswalks are planned and will provide connectivity from the subject property to
the Collier County Sports Complex, located within the City Gate Commerce Park PUD enhancing and improving pedestrian walkability
beyond the subject property and benefiting the community. The Collier Boulevard widening construction project is in the scope
development phase. The selected firm will need to coordinate with the County's Transportation Division and the resultant selected firm.
A greenway will border abutting residential properties, mature on -site trees will be preserved to the extent possible and existing lakes will
be reworked to enhance playability and address water management requirements.
The County is requesting proposals from qualified firms to work with the division and our contracted planning and engineering firm

(Davidson Engineering) with input from BigShots Naples, LLC for the development of a Nicklaus endorsed 12-hole execut 16.C.7.c
course in addition to the development of the necessary infrastructure for further site development. Through Request for Proposal
Services #19-7650, the County selected the planning and engineering firm, Davidson Engineering, to work with the County to identify
the property's potential for future utilization. These attached conceptual fit plans identify approximately 30 acres for an essential
services residential development that will be developed through a separate developer agreement. The conceptual fit plan also allocates
space for a State Veterans' Nursing Home, County Office Building, and potentially 10-acres for Commercial activity. The Collier
County Public Utilities Division will be installing a 24" water main that will connect to the Golf Course and the selected firm will M
need to coordinate with the appropriate parties. ,
The selected firm will work with the division through the pre -construction phase of the project to manage the project to receive the
best value and oversee construction of the project. One of the primary objectives would be for the selected firm to facilitate coordination
of design scopes with multiple disciplines, oversee design of the golf course, manage the course construction, and control construction
costs. The most qualified firm offering a proposal that is deemed to be in the County's best interest both economically and operationally
will move forward in negotiations for a final contract. The selected firm will be expected to complete their work in an expeditious manner
to meet the goals of the project.
Collier County fully expects the Construction Manager to work with the design teams and employ all creative methods necessary to
move the project forward to an on time and successful completion. Particular attention must be given to coordinating the designs of
the multiple engineers involved, including the Collier Boulevard widening project, and Collier Utility project.
TERM OF CONTRACT
County reserves the right to modify this scope during negotiations for budgetary reasons.
The contract term, if an award is made, will commence on the date of the Notice to Proceed and end upon acceptance and approval
of the final payment.
Surcharges will not be accepted in conjunction with this award, and such charges should be incorporated into the pricing structure.
DETAILED SCOPE OF WORK
The selected firm for this project will work with the engineer of record, Davidson Engineering, and its subconsultant, Nicklaus
Design, as the layout for golf course facilities is created and will help maintain budget and control costs through the design and
construction of the golf course. The construction of the golf course will require the development of typical golf course infrastructure.
While elements of the former course will likely be utilized, the current conditions of these elements will not be sufficient for full
course development. Golf tees, greens, fairways, bunkers, pathways, bridges, irrigation, lightning detection, water management
features and water hazards will need to be constructed and developed per plan. Structures will be required for development of the
golf course such as a clubhouse, starter shack, cart barn, maintenance building, restroom facilities, shade structures and parking.
Scope of these structures will be dependent on the services provided at the BigShots facility that is being developed by BigShots
Naples, LLC. The BigShots Facility will be developed separately from the golf course and will not fall under the purview of this
agreement. However, there will be significant coordination between the development of both projects since there will be a level of
integration between the two. The selected firm will also need to coordinate with Collier County Public Utilities Division as a 24"
water main that will connect to the Golf Course is installed and the Collier Boulevard widening project, impacting this project.
The Construction Manager's (CM) work may commence with pre -construction services phase as a part of the comprehensive
Construction Manager at Risk contract. Pre -construction services are included with the Construction Manager's responsibilities with
the design phase of the Project. Prior to commencing construction of the Project, the Construction Manager will assume the risk of
delivering the Project through a GMP contract amendment. The Construction Manager will be responsible for construction means
and methods and will be required to solicit bids from qualified subcontractors to perform the work. During the construction phase,
the Construction Manager shall be solely responsible for performance of the Project and shall function in the role of an independent
General Contractor. That role may include, but not be limited to, the following during each Phase as indicated below.

2. Pre -Construction Phase. The selected Construction Manager will participate in design reviews as the Consultant produces progress
sets of plans and specifications. Pre -Construction Phase is from award through design and engineering and concluding with the
acceptance of the GMP as evidenced by execution of amendment to the agreement for the Construction Phase. Pre -construction
services by the Construction Manager (CM) may include, but may not be limited to the following:
a) Provide detailed cost estimating and knowledge of marketplace conditions.
b) Provide project planning and scheduling for both design and construction phases.
c) Provide for construction phasing and scheduling that will minimize interruption to site operations and by means of a
comprehensive logistics plan.
d) Provide a site utilization plan for all construction activities.
e) Develop a scheduling process as requested by the County.
f) Provide preliminary and detailed scheduling analysis as needed throughout the Project.
g) Provide a Schedule of Values prior to finalization of the GMT including identifying prospective subcontractors,
suppliers and sub -trades acceptable to the County.
h) Provide recommendations on sub -contractors, materials, and amenities at the facility.
i) Provide alternate systems evaluation and constructability studies.
j) Advise the Project Team of ways to gain efficiencies in project delivery and reduce overall delivery time.
k) Provide long -lead procurement recommendations and identify items that have the potential to be procured by the
County.
1) The Project will be an open book. All savings, including unused Owner's Allowance, shall be returned to the County.
The CM shall competitively select all construction subcontracts and other work appropriate for the competitive
selection using cost and other factors.
m) Provide copies of bids and quotations solicited from prospective subcontractors, suppliers and sub -trades.
Note: The County will decide for when the Construction Manager will procure a minimum of three (3) bids or
demonstrate a good faith effort acceptable to the County that demonstrates attempts to obtain three (3) bids.
n) Single source or sole source recommended procurements shall be preapproved by the County.
o) Participate in regularly -scheduled project coordination meetings throughout the design phase of the Project.
p) Participate in constructability reviews throughout the design phase of Project.
q) Assist in the permitting processes. Collier County will pay for all required permit fees.
r) Provide value engineering throughout Project.
s) Continually evaluate quality, safety, and environmental factors. Develop requirements for safety, quality assurance,
and schedule adherence.
t) Advise County regarding green building materials and methods, as well as recommendations for building life span
and efficient operations.
u) Review final plans and specification for completeness and ADA compliance.
v) Provide estimating throughout the Project and as listed below.
w) Submit an estimated cost review and detailed by line item budget at the following stages or phases:
(1) At completion of the Design Development Phase 30%.
(2) At completion of 60% of the Construction Documents Phase.

x) Submit GMP for review and negotiation
y) Review all drawings, specifications and documents to ensure coordination between disciplines. Identify
constructability needs that may have an impact on Final Guaranteed Maximum Price (G.M.P).
z) Establish, implement and maintain quality control standards.
aa) Review and analyze long lead items and impact on design and construction schedules. Develop a `critical path
schedule' at each stage of the design.
bb) The CM shall make a genuine effort to stimulate interest in the project and maximize participation of potential
qualified subcontractors in the selection process with emphasis placed on recruiting and using local, small and/or
minority businesses.
cc) The CM shall monitor conditions in the construction market to identify factors that will or may affect costs and time
for completing the project; and make analysis as necessary to (i) determine and report on availability of labor,
materials, equipment, potential subcontractors and possible impact of any shortages or surpluses of labor or material,
and (ii) in light of such determination, make recommendations and take action as may be appropriate with respect to
long lead procurement, separation of construction into subcontractor packages, sequencing of work, use of alternative
materials, equipment or methods, other economies in design or construction and other matters that will promote cost
savings and completion within the schedule time.
3. Construction Phase. The cost of materials and services during the construction phase will be compensated based on a Guaranteed
Maximum Price to be negotiated by the County, or the County's designee, and Construction Manager following substantial
completion of design plans and specifications prepared by the Consultant and an Amendment to the resultant Agreement.
Construction services by the Construction Manager may include, but may not be limited to the following:
a) The County shall pay for all permits. The CM shall pull the Building Permit and shall be responsible for delivering
and posting the Building Permit at the Project Site prior to the commencement of construction. The County and
Consultant shall fully cooperate with the CM when and where necessary.
b) All projects require detailed code compliance inspection during construction in disciplines determined by the
Permitting Authority. These disciplines normally include, but are not necessarily limited to, structural, mechanical,
electrical, plumbing, and general building. The CM shall notify the appropriate inspector(s) and the County, no less
than 24 hours in advance that the work is ready for inspection and before the work is covered up. All inspection shall
be made for conformance with the applicable ordinances and building codes. Costs for all re -inspections of work
found defective and subsequently repaired shall not be included as Project costs and shall be borne by the CM or as
provided in the contract between CM and subcontractor.
c) The CM shall maintain sufficient off -site support staff and competent full-time staff at the Project Site authorized to
act on behalf of the CM to coordinate, inspect and provide general direction of the work and progress of the
subcontractors and the CM shall provide no less than those personnel during the respective phases of construction.
The CM shall not change any of those persons unless mutually agreed to by the County and CM. In such case, the
County shall have the right to approval of the qualifications of the replacement personnel. The County shall have the
right to request to replace the staff at the Project site at any time during the construction.
d) The CM shall continue to provide current scheduling information and provide direction and coordination regarding
beginning and finishing dates, responsibilities for performance and the relationships of the CMAR's work to the work
of its subcontractors and suppliers to enable them to perform their respective tasks so that the development of
construction progresses in a smooth and efficient manner in conformance with the overall Project Schedule. The
Project Schedule shall include all phases of procurement, approval of shop drawings, change orders in progress,
schedules for change orders, and performance testing requirements.
e) The CM shall hold job -site meetings at least biweekly with the Construction Team, or more frequently as required by
work progress, to review progress, discuss problems and their solutions and coordinate future work with all
subcontractors. The CM shall prepare and maintain a record of such meetings and distribute copies as necessary.
f) If directed by the County, the CM shall review the design for the purpose of identifying major equipment and/or
material purchases that may be advantageous for the County to purchase directly from suppliers as a tax cost saving
measure. Once items have been identified and quantified by the CM, and approved by the County for direct purchase,
the County will issue purchase orders and process payment for invoices approved by the CM. The CM shall prepare
and be responsible for all quantities, descriptions, specifications, guarantees, payment schedules, etc., and all other
required information to be included in the County issued purchase order.
g) The CM shall maintain files that adequately support the competitive solicitation process chosen and followed by the
CM. At minimum, the CM shall provide to the County assigned Project Manager a summary bid tabulation depicting

all bids received broken down by discipline and clear indication of the selected sub-contractor(s). Should the

select the lowest bidder in any instance, a written description as to why the lowest bidder was not selected must be
provided within the bid tabulation summary.

aa) Job Site Requirements. The CM shall provide each of the following activities as a part of its services hereunder:
(1) Maintain a log of daily activities, including manpower records, weather, delays, major decisions, etc.
(2) Maintain a roster of companies on the project with names and telephone numbers of key personnel.
(3) Establish and enforce job rules governing parking, clean-up, use of facilities and work discipline.
(4) Provide labor relationships management and equal opportunity employment for a harmonious productive
proj ect.
(5) Provide and administer a safety program for the project to meet OSHA requirements. Monitor for subcontractor
compliance without relieving them of responsibilities to perform work in accordance with best acceptable
practice.
(6) Provide quality control program.
(7) Provide miscellaneous office supplies that support the construction efforts which are consumed by its own
forces.
(8) Provide for travel to and from its home office to the Project Site and to those other places within County as
required by the project.

(9) Obtain Collier County vendor badges for all employees on site.
bb) Warranty and Warranty period:

(2) Coordinate the 11-month walk-through warranty inspection with the County

general warranty period.
CONSTRUCTION MANAGER AT RISK (CMAR) PROCESS
1.2 The selection process will involve a two-step proposal review to minimize Proposers' costs in preparing initial qualification
proposals and expediting the review process. The Proposers will initially submit a qualifications proposal which will be
scored based on the criteria in the Scoring Criteria for Development of Shortlist, which will be the basis for short -listing no
less than three (3) firms.
The Proposers will need to meet the minimum requirements outlined herein in order for their proposal to be evaluated and
scored by the County. The County will then issue an invitation for oral presentations (Step 2) to at least the top three short-
listed firms and produce a final ranking for approval by the Board of County Commissioners (BCC). Upon approval by the
BCC, the County will enter into negotiations with the top ranked firm(s) to establish cost for the services needed. With
successful negotiations, a contract will be developed with the selected firm, based on the negotiated price and technical
components. The County plans to include an Owner's Allowance in the contract for items such as changes in scope and
permit acquisition. The Owners' Allowance will be used only at the County's direction. The negotiated contract will then
be brought before the Board of County Commissioners for approval and award of contract at a Board of County Commission
Meeting.
Contact with County Staff including Commissioners and/or Selection Committee members: Upon advertisement of this
CMAR RFP, Proposers responding to this CMAR RFP and members of their team, are prohibited from contacting
Commissioners, members of County Staff or Selection Committee Members (including advisory members) regarding the
submittals for this project prior to presentation of a recommendation to the Board of County Commissioners (except as may
be necessary for contract negotiation purposes). All inquiries shall be directed to the Procurement Strategist or Procurement
Director or her designated representative.
1.3 The County will use a Selection Committee in the Construction Manager at Risk Request for Proposal (CMAR RFP)
selection process.
1.4 The intent of the Step 1 scoring of the qualifications -based proposal is for Proposer to indicate their interest, relevant
experience, financial capability, staffing and organizational structure.
1.5 Based upon a review of these qualification proposals, the short-listed firms will be requested to submit Step 2, to make oral
presentations.
1.6 The scores from the CMAR-RFP - Step 1 used for short -listing for this Project will not be carried forward for the Step 2 of
this selection process.
1.7 The intent of the Step 2 oral presentations is to provide the firms with a venue where they can conduct discussions with the
Selection Committee to clarify questions and concerns before providing a final rank.
1.8 After review of the Step 2 oral presentations, the County will rank the Proposers based on the discussion and clarifying
questions on their approach and related criteria, and then negotiate in good faith an Agreement with the top ranked Proposer.
1.9 If, in the sole judgment of the County, a contract cannot be successfully negotiated with the top -ranked firm, negotiations
with that firm will be formally terminated and negotiations shall begin with the firm ranked second. If a contract cannot be
successfully negotiated with the firm ranked second, negotiations with that firm will be formally terminated and negotiations
shall begin with the third ranked firm, and so on. The County reserves the right to negotiate any element of the proposals in
the best interest of the County.
SCORING CRITERIA FOR DEVELOPMENT OF SHORTLIST:
For the development of a shortlist, this evaluation criteria will be utilized by the County's Selection Committee to score each proposal.
Proposers are encouraged to keep their proposals concise and to include a minimum of marketing materials. Proposals must address

Tie Breaker: In the event of a tie at final ranking, award shall be made to the proposer with the lower volume of work
previously awarded by the County. Volume of work shall be calculated based upon total dollars paid to the proposer in the
twenty-four (24) months prior to the CMAR RFP submittal deadline. Payment information will be retrieved from the
County's financial system of record. The tie breaking procedure is only applied in the final ranking step of the selection
process. In the event a tie still exists, selection will be determined based on random selection by the Procurement Services
Director before at least three (3) witnesses.
Each criterion and methodology for scoring is further described below.
EVALUATION CRITERIA NO. 1: ABILITY OF PROFESSIONAL PERSONNEL (25 Total Points Available)
Ia. This criterion measures the ability of Proposer's team personnel as shown by their level of experience on projects of
similar type, size and complexity. This criterion measures how well the team is staffed to address all facets of the project.
It measures how well the team is organized to deliver the project for the County. Preference will be given to teams with
knowledge and experience with local construction and regulatory conditions and who demonstrate a strong commitment to
team collaboration proximate to the project site. Preference will also be given to teams (both individual within the teams
and the companies making up the team) that have worked together on successful delivery of similar projects. It measures
the overall level of the team's qualifications to successfully complete the project.
lb. Describe the organizations corporate structure, divisions, principals and corporate leadership, hierarchy, key personnel
by position, and job responsibilities. Indicate the office location in which the project will be managed from.
lc. Describe the proposed Project team. Provide resumes and history with the Proposer, as well as career history elsewhere
including dates of employment. Provide qualifications, relevant experience, and resumes for the Construction Manager and
all key staff to be assigned to this project. Identify roles of project Executive/Director, Preconstruction Manager, Project
Manager, and General Superintendent. Identify the longevity of employment of key staff of the Proposer.
i. Indicate Project Manager's experience in construction management at risk of similar types of projects.
ii. Indicate Project Superintendent's experience in similar project supervision. The superintendent shall be
assigned to this project full-time and be on -site during all construction.
iii. Indicate any Project on -site staff specializing in support of the technical requirements of the Project.
iv. Indicate qualified office support staff and equipment sufficient for project support and execution.

and complexity as this project along with evidence of satisfactory completion, both in time and within budget, for the past
ten (10) years. The Proposer's team will be evaluated on past services provided for projects of similar nature - projects of
the size and scope of this project, including the experience the team members proposed on this project have together on the
previous projects presented. Experience with all elements of the project scope as generally described herein will be
evaluated, with specific emphasis on experience addressing the technical, community and project delivery categories. The
Proposer's team's minimization of change orders will be an important consideration. Preference will be given to similar
services constructed within the last 5 years in proximity to the proposed project.
3b. The Proposer shall indicate successful Construction Manager at Risk experience with projects of similar size and scope.
The Proposer shall furnish a list of representative projects, with a minimum of three (3) having been performed for public
owners. The list shall include, as a minimum, the following information for each project listed:

as a part of their proposal. References to include no more than one Collier County project. Provide information on
the projects completed by the Proposer that best represent projects of similar size, scope and complexity of this project using
form provided in Attachment A — Form 4. Proposer may include two (2) additional pages for each project to illustrate
aspects of the completed project that provides the selection committee information to assess the experience of the Proposer
on relevant project work.
EVALUATION CRITERIA NO.4: LOCATION, PROJECT APPROACH, WILLINGNESS TO MEET TIME AND
BUDGET REOUIREMENTS (25 Total Points Available)
4a. The professional team's approach to management and execution of work with respect to location of various key project
team members will be evaluated under this criterion. The Proposer shall demonstrate from the project kick-off how they
will establish the project location in order to manage day-to-day or on -site information collection and distribution between
internal and external team members, and County staff, as well as other entities involved in the project.
4b. Written overview of the Proposer team's resources available to complete the services requested in the schedule outlined
in the scope of services. Describe the project approach to deliver successful pre -construction services to (indicate type of
project) or similar projects. Include topics such as cost estimating, value engineering, scheduling, best practices, BIM
Modeling, constructability review, permitting and bidding. Describe the Proposer's quality assurance, safety and closeout
programs. The Proposer should illustrate to the County how they propose to approach the project and assemble the resources
to meet each phase and each major element of the project. (Limit response to 3 pages)
4c. Describe the Proposers approach to deliver successful Construction Management services. Include topics such as
coordinating and constructing (describe type of project and aspects of project critical to successful completion as required
by Division). (Limit response to 2 pages)
4d. Describe Proposers subcontractor management and outreach plan. Describe Proposers approach for competitively
administering and evaluating bid packages. Identify a list of potential subcontractors within the major trades that have a
successful long-term business relationship with the Proposer. Identify specialty trades and list subcontractors specifically
and technically critical to the success of this project. Briefly describe each subcontractor's qualifications, experience and
past teamwork with the Proposer. (Limit response to 2 pages + listing of trade subcontractors that may be considered)
4e. A conceptual level schedule should be included as a separate page to illustrate concepts of design and permitting time,
sequencing of the major elements. (Limit schedule to 1 page, I V x 17" page size and 40 activities maximum)
4f. Written overview of Proposer team's concept and approach to managing the overall cost of the project. (Limit response
to 5 pages). Include in the 5-page response specific information on past project performance that demonstrates the Proposer's
ability to meet the County's budgets including change order history on similar projects.

5a. This criterion measures the team's proposed resources for the project and their availability to complete all elements of
this project with regards to the closeout of recent work, current workload, and projected projects that could impact the
completion of this project. List all completed and currently active projects that the Proposer has managed/is managing within
the past five (5) years.
5b. In addition, list all projected projects that Proposer will be working on. Projected projects will be defined as project(s)
that the Proposer has been awarded, but the Notice to Proceed has not been issued, and any future commitments. Identify
any project that the Proposer worked on concurrently. Describe Proposer's approach in managing these projects. Were there,

6a. Provide audited financial statements or certified by a Public Accountant for the last three years, current credit rating,
current net worth, leverage, profitability in relation to size, liquidity and overall financial stability. Any claim of
confidentiality on financial statements should be asserted at the time of submittal. The Proposer's failure to provide the
information as instructed may lead to the information becoming public.
6b. All Proposers and key firms of the Proposer's teams shall disclose and provide a written explanation regarding any and
all construction -related litigation, major disputes, contract defaults, and/or liens within the last 5 years, even if the provider
considers that such may have little or no significance to the County.
6c. The Proposer shall provide a summary of bonding value capacity, single project bonding value limits, value of current
bond commitments, and current available bonding capacity. The Proposer shall also identify the Proposer's history of any
and all Notice to Cure and/or Demand Notice on Performance and/or Payment Bonds.
6d. If the Proposer is a joint venture, the above information provided should encompass the joint venture and each of the
entities forming the joint venture.

Frank Subzda is an Independent Safety Consultant that
GATES has employed for the past 20 years. He provides
safety training for our staff and inspection services for most
of our larger projects. These services include compliance
audits, safety program management, construction safety
monitoring, and environmental safety management.
For more than 46 years Frank has been involved with
safety. His experience in construction, vocational training
and apprenticeship administration has given him a diverse
background in safety applications. In 1994, after receiving
his MS in Industrial Education, Frank opened U.S. Safety to
assist business owners looking to protect their employees
from work place hazards and to establish proactive safety
attitudes.
U.S. Safety has provided the basic 10/30 hour OSHA course
to thousands of participants and Competent Person training
to hundreds more. In 2011 we were presenters at the U.S.
Army Corps of Engineers' "Safety Pays" and we currently
teach the EM-385.1.1 (USACE Safety Manual) to Contractors
preparing to work on Federal or military projects.
U.S. Safety has earned the reputation of being a successful
negotiator when representing clients during OSHA

S/M/WBE OUTREACH
With three locations in Southwest Florida, GATES has an extensive
database of local, state-wide and regional contractors including small
business, minority disadvantaged, and service disabled veteran owned
small business subcontractors. GATES' S/M/WBE outreach includes
posting opportunities through SBA offices and building industry
associations local to the project as well as hosting workshops in the
local community. We offer assistance to these firms in completing
forms and other administrative tasks relative to working with GATES
where necessary to ensure they have subcontracting opportunities with
our firm.
We design our bid packages to permit the maximum possible
participation of S/M/WBE businesses. For example, splitting bid
packages into individual trades/vendors such as purchasing the concrete,
rebar, and post tensioning materials directly, and labor separately for
the formwork, placing of the concrete, and finishing of the concrete.
Our database is constantly updated with new S/M/WBE businesses
as well as recording award information to document our compliance

There maybe no more complex municipal golf
course project than New York City's Department
of Parks and Recreation's Ferry Point Park golf
course. In 2008 Sanford Golf Design and their 12
sub -consultants began work on an 18-hole golf
course and its ancillary buildings atop a landfill
adjacent to the East River and Whitestone
Bridge. As with any golf course there are
special challenges, such as, public input, permit
approvals, infrastructure, erosion control,
water quality, soils, etc. At Ferry Point things
were made more complex by landfill closure
requirements, methane monitoring/venting,
differential settlement, importing 2,400,000
cubic yards of fill, changing regulations during
design and construction phases.
Among its many accolades the golf course was
named one of the "Top 10 Municipal Golf Course
in America" by Golf Magazine and Since opening
in 2015 the golf course continues to be one of
the most spectacular and successful municipal
golf courses in the United States.

4b/c. PROJECT APPROACH
A PLAN FOR SUCCESS
Communication is the key to success. GATES as the prime General Contractor communicates and directs the
subcontractors to ensure there is timely coordination and consistency between the design elements and the
construction on site. This includes the approval of any shop drawings, efficient coordination of project elements, ie,
golf course construction, irrigation, landscaping, testing as required and final approval of work as it progresses. GATES
and Sanford Golf Design will work together to ensure design and construction is completed efficiently and finished to
the highest quality.
Prior to work commencing, GATES will develop a detailed project schedule which will become an essential tool for
all team members and key stakeholders as the project progresses to ensure milestone dates, overall timing and
costs are met. We will identify any long lead items such as underground pipe and storm structures, trusses, roof
systems, HVAC equipment, switchgear, lighting (interior & exterior) and equipment. We will work with subcontractors
to establish a Material Status Report to plan, track, and ensure a smooth and timely flow of material and equipment to
the site. GATES will also work with all subcontractors with regards to scheduling of construction tasks to assure there
is adequate trades available to complete the work according to the construction schedule. Our team will be in close
contact with the local authorities having jurisdiction (Collier County building inspectors, Fire Department inspectors,
etc.). During this time, we will also coordinate with the local power company to facilitate temporary and permanent
power requirements.
Weekly meetings between all necessary key team members and Collier County staff will address work completed, look
ahead at work to be completed, any project issues that may arise, and their planned resolution. It is vitally important
that these weekly meetings are attended and recorded minutes distributed to maintain ongoing communication
between all team members. A successful project is based on the team's implementation of all desired and included
design features completed on time and on budget.
DESIGN AND DOCUMENT REVIEW
Our team has worked side -by -side with some of the most respected architects (including Nicklaus Design), renovated
classic layouts and played great courses around the world. We have deep respect for the history of the game and the
courses it is played on.
The first step to building a sustainable golf course is to gain an understand of the project goals and objectives. The
GATES team will work diligently with Nicklaus Design to refine the design and plan documents. We will also spend time
on site reviewing topography, vegetation, drainage, existing features and general conditions. These critical components
form the design's foundation and will shape the project's success.

PRE -CONSTRUCTION
A full and complete understanding of the project plans and specifications is critical to buying out all of the components
of thejob. GATES' exacting attention to the smallest details prevents major delays if any items in question have long lead
times or require custom fabrication. Our preconstruction services start with our core team —the Estimator, the Project
Manager, and the Superintendent. We kick off each project with a team meeting that establishes an environment of
open communication and inclusiveness, conveying to each person that they are a valued member of the team.

CONSTRUCTABILITY ANALYSIS AND VALUE ENGINEERING
Our in-house experts, along with our local market relationships and knowledge, will ensure the most economically
feasible project while still meeting all of the project goals for the owner. The goal is to provide a quality project within
the budget. We will work with the team to provide an in-depth constructability review along with a Value Engineering
Analysis. Having been actively involved in construction in the state of Florida for over 28 years, we understand the
requirements to be successful in this environment and are experienced working with all of the agencies involved.
We will review all aspects of the building systems and components in a team effort with the designers to help provide
the most efficient and cost-effective design. GATES will provide alternative ideas on how to meet programmatic or
design needs while maintaining the desired project scope. We will focus on areas that will be more cost effective
and easier to construct, and will provide superior performance, including material and design substitutions. We will
provide the information required for the owner to make timely, value -based decisions for each of the alternatives.
GUARANTEED MAXIMUM PRICE (GMP)
We will use our in-house expertise along with our local market knowledge to attentively review the conceptual plans
and the preliminary master schedule and provide the most accurate conceptual estimate. We typically have four stages
of budgeting/estimating for a project: design development (30% at completion) 60%, 90% and 100% at completion of
construction documents. The Guaranteed Maximum Price (GMP) is established following the third and final evaluation
and Project Team review. Each budget/estimate contains a detailed take -off and unit pricing for each trade category.
This internal estimate helps us dissect the systems and establish quantities. Through collaboration with our skilled
trade professionals, each budget/estimate also includes current subcontractor/vendor (trade partner) participation
and input on design, constructability and cost.

BIDDING
An efficient bidding and subcontracting process is a critical part of a project's overall cost and quality control. GATES has
an extensive and successful track record within the Florida market. We fully manage the entire bid process, ensuring
maximum response, subcontractor qualification, and contract conformance. Additional information regarding our
subcontractor management and outreach plan is detailed in Section 4C.
PERMITTING
GATES recognizes the importance of efficient project permitting and code compliance. Our team of in-house Permit
Expeditors have a working knowledge of regulatory and permitting systems; long-standing relationships with
government agencies; experience with the local business environment and marketplace; and linkages across all stages
of the project development. GATES excels at defining the most efficient regulatory paths for our clients. Our Permit
Expeditors have years of permitting experience and standard procedures with Collier County and are able to save
time and money by providing the information reviewers need to make timely permit decisions. We are successful in
identifying and resolving permit issues before they become permit problems.
LOGISTICS PLAN
Construction access will be maintained to assure minimal disruption to traffic and public safety with an approved
Maintenance of Traffic plan. The construction access road will utilize the existing roadways where practical and keep
construction traffic away from public areas.
Based on a preliminary site visit, we propose that construction access be off of Golden Gate Parkway, with a secondary
access off of Collier Boulevard as the project progresses. Dirt and debris will be contained within the construction
site with silt fencing and a rock pad near the construction exits. Any materials spilled or tracked from vehicles onto
roadways will be cleaned up immediately or no later than the end of the workday.
Upon completion of the site clearing and
grading, the deep excavation for the site
drainage and utilities will commence, followed
by the construction of the golf course, golf
course structures, and parking lots. Parking
lots and bus loop will be constructed to a
final grade ready for final surface to facilitate
movement of construction machinery and
vehicles.
Final construction activities will include Collier
Boulevard access aprons, parking spaces,
dumpster enclosure, curbing, site concrete,
paving, striping, lighting, landscaping, and

CONSTRUCTION APPROACH
Great golf courses are a result of the design and
construction team spending time on site to oversee
construction. We pride ourselves on working'in the dirt'.
From clearing to grassing, we are intimately involved in
every facet of the course's construction.
Construction implementation hinges upon having
systems in place. The first being a detailed construction
schedule that forecasts task completions and helps
coordinate ordering and delivery of construction
materials, equipment, turf, landscape plantings, etc.
The first month of construction is often the most creative
part of the process and the character of the golf course
begins to take shape. Since every hole is unique, with
its own issues to solve, each visit will be a collaborative
effort with the project team and County staff.

Rough shaping must be approved prior to installing infrastructure (drainage and irrigation) and detailed finish work
will be reviewed and approved prior to grassing. During this very important approval process the following items are
reviewed; grades are checked for conformance with documents, landscape plantings are placed properly, bunker sand
lines are painted, cart path tie-ins checked, and green slopes are verified with our digital equipment.
Our team will work in collaboration to ensure all construction work is completed per design, specification and to the
highest quality for all components. This process protects the overall quality work as well as minimizing any deficiencies
to complete after substantial completion. The team is also committed to addressing any warranty items that may arise
after completion to ensure complete client satisfaction.
In addition to construction inspections, we review all golf course related change orders, monthly pay requests, shop
drawings, samples, and other submissions of the golf course subcontractor for conformance with the design concept
and compliance with the construction documents.
Construction schedules and projected budgets will be updated throughout the construction process. Upon substantial
completion a punch list will be developed and final inspections will be conducted.
QUALITY CONTROL
Quality Control is a daily responsibility of the Senior Project Manager and Senior Superintendent. We utilize a
continuous step review process where each construction phase, subcontractor work product and material supplied
is inspected and any deficiencies discovered are addressed immediately, not at the end of the project. Not only does
this insure a quality finish product, but it minimizes the need for future warranty requests while improving longevity
and durability. Our quality policy and approach coincides with our philosophy and procedures regarding 'punch lists'.
We utilize a progressive/continuous procedure whereby a punch list is generated continuously and daily at each stage
of the project.
During construction Sanford Golf Design will participate in weekly construction meetings and work in partnership
with GATES to review construction progress to safeguard the design intent and check the work for its compliance with
the construction drawings and specifications, make grading adjustments to fit field conditions and monitor project
progress. Following each visit we will prepare a report summarizing meetings, site review, and prepare sketches as
needed.

SAFETY
In the firm's 28-year history, GATES has had NO OSHA citations and NO safety related litigation. Our firm also enjoys an
outstanding track record of working safely in active environments.
GATES is committed to maintaining a safe & healthy working environment on all of our jobsites. Part of our safety
program involves our Injury -Free Environment (IFE) program. IFE is the shared corporate and individual belief that
safety is a value, not compromised by cost or schedule. Everyone has the right to go home safe at the end of the day.
Our safety program provides training in the following areas at minimum:
• Safety training to all newly hired employees, prior to the commencement of job assignments
• Special training on safe methods to perform particular job assignments
• Special training for employees who may work with hazardous materials, machinery, or equipment
• Special training on the use of safety equipment or apparel for specific job assignments
All of our Project Managers and Superintendents are 10- or 30-Hour OSHA Certified. In addition, we utilize an
Independent Third -Party Safety Consultant, who may be drawn upon for additional assessments or training. GATES
staff and our subcontractors actively engage in daily pre -task safety plans to analyze the work that is being performed
and what safety precautions need to be taken to ensure worker safety.
COVID-19 PLAN
In response to early reports of COVID-19, GATES took a proactive approach and immediately established a plan to
protect its staff, subcontractors, clients and site visitors. Our COVID-19 Plan is based on current CDC and local health
department information and guidelines. As part of the preconstruction process, we take pride in working with our
clients to share current trends relative to health and safety.
On each of our jobsites, there is a gate sized 'Prevent the Spread' sign posted at the main entrance, along with site
safety rules. By the port-o-lets there is a handwash sink or sinks with antibacterial soap, and signage regarding safe
work practices for COVID-19. Depending on the size of the jobsite, there may be multiple signs posting safe work
practices. Social distancing is encouraged, and face masks are required when working in close proximity to others.

4f. COST CONTROL
GATES' project cost control management begins with a unique pre -construction process that utilizes multiple budget
exercises, starting at the conceptual state, and followed by budgets presented at 33% and 66% levels of drawing
completion. During these three budget exercises, we will be evaluating constructability, reviewing current building
conditions and looking for value engineering opportunities. After the budget/constructability process, we will then
publicly bid the project to to establish a Guaranteed Maximum Price.
GATES utilizes Viewpoint, a construction management software for project
management and cost accounting. The program captures and organizes project VIEWPOINT
information and generates reports that help the project team stay on top of
day-to-day schedule and cost control management.
A project summary report is submitted monthly to document the project's maximum cost and anticipated completion
date. The Financial Status Summary, Financial Status Detail Report, and the Cost Event Log / Cost Event Detail are
additional financial reports that are prepared for monitoring and controlling of costs.

CHANGE ORDER MINIMIZATION PROGRAM
Our goal is to remain change order free. However, knowing change orders are requested during most projects,
we have taken a proactive approach to minimize them as much as possible. Being engaged in the design process
and working closely with the owner, architect and engineer(s) throughout the budgeting phase will help develop a
complete scope of work and in turn, eliminate the need for unjustified change orders.
Our Change Order Minimization Program includes the following:
• Encourage open communication and transparency with all team members - not only throughout the entire
construction process but more critically, during bidding and in advance of subcontracting.
• Work with entire design team to establish clear and complete design documents and fill in the "gaps" via
coordination between disciplines.

• Collaborate with Architect and Engineering team to help prevent design conflicts and ensure all building
components have the resources shown that they each need to fully function and operate correctly.
• Clearly outline change order process within contract documents to prevent unauthorized change orders and
disputes. All subcontractors are bound by the same benchmark of terms, conditions, drawings and specs that
the master contract is comprised of so that all parties are on the same page when it comes to responsibilities
and commitments.
• Establish steps to take following the identification of a potential change order. These procedures run through
GATES management first for evaluation, justification, and back -calculation of costs before being presented to
Ownership for review and discussion.
• Provide subcontractors with a clear statement of work (SOW), including performance and material deliverables.
Ancillary items such as logistics planning, schedule commitments, temporary responsibilities and construction
interaction are all firmly set as part of Subcontract commitments during subcontract negotiations and prior to
agreeing to terms.
• Utilize a constantly evolving and improving library of boilerplate scope (SOW) terms that:
a) Fills in common "gaps" in construction management that have been experienced in the past
b) Includes administrative expectations such as payment terms, application timing, managements and backup
requirements for change order support details
c) Contains trade -specific terms that addresses responsibility for common requirements per installation element
• Ensure subcontractors meet or exceed established SOW requirements
GATES also performs our due diligence prior to subcontractor buy-out through field investigations verifying site
conditions, structural conditions, systems interface issues, site infrastructure conditions, electrical capacities,
mechanical systems condition and building envelope conditions prior to determining:
• Space Requirements
• Special Equipment
• Engineering Systems
• Site Utilization
• Adjacencies
• Quality of Space
• Expansion Requirements
• Drainage Requirements
Finally, GATES requests detailed unit prices in the original subcontract. When changes are requested, originally
quoted unit prices hold true throughout the project.
PROJECT CLOSE-OUT
The managing of contract documents and operational systems begins in the design phase and is reinforced at all
phases of the project. No final payments will be made until the full contract is completed, punch lists are signed off
on, and final documents are received. When each job is complete, we supply the owner with accurate, easy -to -follow
digital and hard copy Project Close -Out Books.
