EXECUTIVE SUMMARY
Recommendation to execute “Subordination of County Utility Interests” (Subordination
Agreement) as requested by the Florida Department of Transportation (FDOT) to comply with
FDOT easement requirements.
OBJECTIVE: To subordinate the Collier County Water-Sewer District’s (CCWSD) utility easement
rights in an approximately 105’ x 15’ section of land at the entrance of the Fronterra development
community that FDOT has accepted as a donation.
CONSIDERATIONS: Per FDOT, it is their standard policy to get subordinations for any utility
interests in lands that have been accepted by FDOT as a maintenance donation.
The attached Subordination Agreement (“Agreement”) is FDOT’s standard form document that is used
for all Florida Counties and Florida Power and Light (FPL). Collier County has collaborated with FDOT
under FDOT’s Agreement on various road projects in the County. Real Property is unaware of any issues
or detriment to past projects in using this Agreement.
Note in the Agreement, that in the event of conflict between the County’s easement rights and FDOT
improvements, FDOT is willing to pay to have the utility facilities relocated and to acquire additional
easements if necessary.
FISCAL IMPACT: There is no financial impact to the County. FDOT will pay all recording fees,
reimbursable costs for relocation of utilities and reimbursable costs for easement acquisition as necessary.
LEGAL CONSIDERATIONS: The sovereign immunity limitations set forth in Section 768.28, Florida
Statutes, apply whether they are expressly referenced in the indemnification terms of any given contract
with a County. As such, this item is approved as to form and legality and requires a majority vote for
Board approval. - JAB
GROWTH MANAGEMENT IMPACT: There is no impact to the Collier County Growth
Management Plan.
RECOMMENDATION: That the Board, acting as the ex officio governing board of the CCWSD:
1. In the spirit of cooperation with FDOT, agree to subordinate the utility interest in those lands
described in the attached Subordination Agreement and authorize the Chair to execute the
Subordination Agreement.
2. To return the signed Subordination Agreement to FDOT for them to record it in the Public
Records of Collier County, Florida.
