Agenda 11/09/2021 Item #10A (Amplified Sound Permit Requirements & Penalities)11/09/2021 EXECUTIVE SUMMARY Recommendation to amend Ordinance 2008-68 establishing amplified sound permit requirements and penalties in unincorporated Collier County. _____________________________________________________________________________________ OBJECTIVE: To have the County Manager or designee collect information regarding best practices for the issuance of amplified sound and outdoor entertainment permits and conditions of approval throughout the State of Florida, and to make recommendations to the Board of County Commissioners regarding amending amplified sound permit requirements and penalties for violations. CONSIDERATIONS: During the September 28, 2021, Board of County Commissioners meeting, the Board directed the County Manager to continue to identify development standards and improvements that will best accommodate community concerns, ensuring minimum disruptions and the quiet enjoyment of neighborhoods. The Board hereby finds that amplified sound and outdoor entertainment may create community impa cts, including, but not limited to, excessive noise and diminished public safety; that to lessen these impacts and to protect the quiet enjoyment of neighboring residential units it is necessary to enhance conditions of approval, the length of time a permit is valid, and penalties for amplified sound and outdoor entertainment permit violations. FISCAL IMPACT: There is no impact to the General Fund. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this action. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issues at this time and requires majority vote for approval. -JAK RECOMMENDATION: To have the County Manager or designee collect information regarding best practices for the issuance of amplified sound and outdoor entertainment permits and conditions of approval throughout the State of Florida, and to make recommendations to the Board of County Commissioners regarding amending amplified sound permit requirements and penalties for violations.
