Recommendation to approve Petition VAC-PL20210000472, to disclaim, renounce and vacate the County and the public interest in a portion of the Drainage Easements, Public Utility Easements, Access Easements and Ave Maria Utility Easements located in Tract "U" of Ave Maria Unit 17, as recorded in Plat Book 49, Page 17 of the public records of Collier County, Florida, in Section 5, Township 48 South, Range 29 East, Collier County, Florida. OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in a portion of the Drainage Easements, Public Utility Easements, Access Easements and Ave Maria Utility Easements located in Tract "U" of Ave Maria Unit 17, as recorded in Plat Book 49, Page 17 of the public records of Collier County, Florida, in Section 5, Township 48 South, Range 29 East, Collier County, Florida, being more specifically shown in Exhibit "A". CONSIDERATIONS: Petition VAC-PL20210000472 has been received by the Development Review Division, Growth Management Department from Michael J. Delate, P.E., of Q. Grady Minor & Associates, Inc., as agent for the property owner, to vacate a portion of the Drainage Easements, Public Utility Easements, Access Easements and Ave Maria Utility Easements located in Tract "U" of Ave Maria Unit 17, as recorded in Plat Book 49, Page 17 of the public records of Collier County, Florida, in Section 5, Township 48 South, Range 29 East, Collier County, Florida. The aforementioned easements need to be vacated to allow the property owner to fully utilize the site. The use of the land has changed from what was originally planned. The easements are no longer necessary. The public will benefit by not having any easements with no intended use. This will allow full development of the parcel for use by the University and subsequently for public enjoyment of functions on the developed site that will be open to the public at large. The Development Review Division has reviewed this petition and found no reason for objection. FISCAL IMPACT: Growth Management Department, Development Review Division staff has collected a $2,000 "Petition to Vacate" fee from the petitioner which covers the County's cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this action. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. --DDP RECOMMENDATION: Approves the attached Resolution, relating to Petition VAC-PL20210000472, which will vacate the County and the public interest in a portion of the Drainage Easements, Public Utility Easements, Access Easements and Ave Maria Utility Easements located in Tract "U" of Ave Maria Unit 17, as recorded in Plat Book 49, Page 17 of the public records of Collier County, Florida, in Section 5, Township 48 South, Range 29 East, Collier County, Florida, being more specifically shown in Exhibit "A", and directs the Clerk to the Board to record a certified copy of the Resolution in the public records and to make proper notation of this Resolution on the plat of Ave Maria Unit 17, as recorded in Plat Book 49, Page 17, of the public records of Collier County, Florida. Gino, In response to the question of compensating for the DE vacation, it is proposed that in the future when new facilities in the site would require the installation of drainage facilities a replacement DE(s) would be provided. Currently the site does not contain any drainage facilities (pipes or inlets). The area sheetflows to the surrounding existing roadside drainage system. There is no stormwater conveyed through the site from surrounding areas. Attached is the site plan depicting the easements to be vacated and the proposed gyms and parking. Also attached is master drainage plan for the area. Originally this area was going to have other university facilities. Those did not come to fruition. Then later the area was platted with the idea of duplicating dorms/univ bldgs. similar to the areas to the north. The plat included what in essence are alleys that exist to the north (and they included Packet Pg. 1979 17.F.d DEs, AEs, PUEs, etc.). That plan did not come to fruition either. The plan now is to construct the gyms and the easements are no longer needed at this time. As you can see in the old master plan, all of the drainage from the surrounding areas drain through existing large diameter trunk mains in existing DEs. None of those are located on the site but on the roads nearby. They are not affected by this. Note too that the valid public purpose is the continued development of the university.
