EXECUTIVE SUMMARY
Recommendation to approve the after -the -fact electronic submittal of an FY22 Federal Transit
Administration Section 5311 American Rescue Plan Grant Application in the amount of $1,105,900
to support transit operations; and approve the associated Resolution.
OBJECTIVE: To provide ongoing support for public transit operations for the residents of Collier
County.
CONSIDERATIONS: On September 3, 2021, the Florida Department of Transportation (FDOT)
announced available grant funding provided to the Federal Transit Administration (FTA) through the
American Rescue Plan (ARP). Collier County, a designated Community Transportation Coordinator and
provider of mass transportation to individuals residing in non -urbanized areas throughout the County and
is eligible to apply for FTA Section 5311 ARP funding to provide support for transit operations in the
rural area.
The 5311 ARP operation grant application request is essential to continuing the existing level of service
being provided for the non -urbanized areas of the County. The 5311 grant helps fund six (6) non-
urbanized/rural routes: Routes 19 and 28 (providing transportation to and from the Immokalee area to the
Intermodal Transfer Station), Route 121 (providing early morning and late evening express service
between Immokalee and Marco Island), Route 22 and Route 23 (providing a circulator within the rural
Immokalee community), and Route 24 (providing transportation to and from the Charlee Estates area to
the Intermodal Transfer Station). This service will continue to provide access to employment for rural
area residents. There is no match required for the FTA Section 5311 ARP Grant Program.
Funding became available on September 3, 2021 with a due date of October 4, 2021. Due to the short
turn around, CMA #5330 authorizes the County Manager to approve the submittal of grant applications,
followed by after -the -fact approval by the Board of County Commissioners at the next available Board
meeting. The County Manager approved the submittal of the grant application on October 4, 2021.
FISCAL IMPACT: There is no Fiscal Impact associated with this Item at this time. The total funding
request is $1,105,900 and it will be utilized to provide transit services in the non -urbanized areas of
Collier County. If awarded, a grant agreement and Budget Amendment will be brought to the Board of
County Commissioners for approval at a future Board meeting. There is no match required for this grant
program.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this
Item.
LEGAL CONSIDERATIONS: This Item is approved for form and legality and requires a majority vote
for Board action. -JAB

FDOT Certification and Assurances
(Collier County Board of County Commissioners) certifies and assures to the Florida
Department of Transportation regarding its Application under U.S.C. Section 5311 dated 4th

1 It shall adhere to all Certifications and Assurances made to the federal government in
its Application.
2 It shall comply with Florida Statues:
• Section 341.051-Administration and financing of public transit and intercity bus service
programs and projects
• Section 341.061 (2)-Transit Safety Standards; Inspections and System Safety Reviews
• Section 252.42 - Government equipment, services and facilities: In the event of any
emergency, the division may make available any equipment, services, or facilities
owned or organized by the state or its political subdivisions for use in the affected area
upon request of the duly constituted authority of the area or upon the request of any
recognized and accredited relief agency through such duly constituted authority.
3 It shall comply with Florida Administrative Code:

8 It will maintain project vehicles/equipment in good working order for the useful life of
the vehicles/equipment.

9 It will return project vehicles/equipment to FDOT if, for any reason, they are no longer
needed or used for the purpose intended.
10 It recognizes FDOT's authority to remove vehicles/equipment from its premises, at no
cost to FDOT, if FDOT determines the vehicles/equipment are not used for the purpose
intended, improperly maintained, uninsured, or operated unsafely.
11 It will not enter into any (ease of project vehicles/equipment or contract for
transportation services with any third party without prior approval of FDOT.
12 It will notify FDOT within 24 hours of any accident or casualty involving project
vehicles/ equipment, and submit related reports as required by FDOT.
13 It will notify FDOT and request assistance if a vehicle should become unserviceable.
14 It will submit an annual financial audit report to FDOT
(FDOTSingleAudit@dot.state.fl.us), if required.
15 Itwill undergo a triennial review and inspection by FDOTto determine compliance with
the baseline requirements. If found not in compliance, it must send a progress reportto
the local FDOT District office on a quarterly basis outlining the agency's progress
towards compliance.

comply with the labor protection provisions of 49 U.S.C. 5333(b) by one of the following actions: (1) signing the
Special Warranty forthe Rural Area Program (see FTA Circular C 9040.IG, Chapter VI 11 (2) agreeing to alternative
comparable arrangements approved by the (Department of Labor (Doi); or (3) obtaining a waiver from the DOL.)

The Public Transit & Neighborhood Enhancement Division is submitting the 2022 Federal Transit
Administration 5311 American Rescue Plan grant application to the Florida Department of
Transportation (FDOT) to provide support for Collier Area Transit System transit operations in the
rural area. This grant funding will help fund six (6) non-urbanized/rural routes.
The total grant application request is in the amount of $1,105,900. There is no match required
for this grant.
The Florida Department of Transportation announced funding availability on September 3, 2021
with applications due no later than October 4, 2021, Due to the short turnaround, we are asking
for your approval to submit the application followed by an After the Fact approval by the Board of
County Commissioners at the October 26, 2021 BCC meeting.
