10/26/2021 EXECUTIVE SUMMARY Recommendation to approve the release of a code enforcement lien, with an accrued value of $51,818.63, for payment of $2,118.63 in the code enforcement action titled Board of County Commissioners v. Sylvie E. Nutten, relating to property located at 496 Willet Ave, Collier County, Florida. OBJECTIVE: For the Board of County Commissioners to accept an offer to release a code enforcement lien with an accrued value of $51,818.63 for payment of $2,118.63 in relation to Code Enforcement Board Case No. CEAU20190005915. CONSIDERATIONS: The Code Enforcement Board ordered the imposition of a lien against Sylvie E. Nutten, in Case No. CEAU20190005915 for code violation the property located at 496 Willet Ave, Collier County, Florida. The violation consisted of having an unpermitted and damaged privacy wall located on the property. The lien was recorded on March 20, 2020, at O.R. Book 5742, Page 261. The current lien amount of $51,818.63 is based on 517 days of accrued fines ($100 per day from January 24, 2020, through June 23, 2021) totaling $51,700, plus $118.63 in operational costs. The property was brought into compliance on June 23, 2021. Fort Naples LLC., acquired the property via Warranty Deed recorded on April 3, 2021. Pursuant to Resolution No. 2012-46, a request for reduction of fines may be considered, in part, when a lien encumbers property under new ownership and the new owner has diligently pursued abatement and achieved compliance, and/or when payment of the lien would impose a severe financial hardship on the owner. The new owners spent a substantial amount of time and money, approximately $8,510, for payment of permit fees, inspections, and installation of a new privacy wall to bring the property into compliance. The property is actively maintained, the owner has paid $2,118.63 in settlement of fines, and is requesting the remaining $49,700 in accrued fines be waived. There are no known code violations remaining on the property. FISCAL IMPACT: Payment of $2,118.63 has been made, representing $2,000 in fines, plus $118.63 in operational costs. If approved by the Board, accrued fines in the amount of $49,700 would be waived. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board's policy contained in Resolution 2012-46. -CAK RECOMMENDATION: To waive the remaining fines in the amount of $49,700, accept payment amount of $2,118.63, and authorize the Chair to sign the attached releases and satisfaction of liens for recording in the Official Public Records. Hello Iliana, As a follow up to our last email, I wanted to point out that the cost of the privacy wall was $8510.00 completed and painted.
