EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners discuss the management of County -
owned public lands with the Collier Mosquito Control District, as requested.
OBJECTIVE: To discuss an approach to the management of County -owned public lands with the
Collier Mosquito Control District (CMCD).
CONSIDERATIONS: At their July 13, 2021 meeting, the Board adopted a resolution approving the
expansion of the boundaries of the CMCD, pursuant to Section 388.211, Florida Statutes. At their
September 28, 2021 meeting, under Staff and Commission General Communications, the Board asked to
discuss the management of County -owned public lands at a future meeting and requested that the CMCD
be asked to attend to provide information on their public outreach and approach to this matter. The Board
also requested that the County Attorney's Office (CAO) provide research on any statute or other legal
requirements related to the management of public lands.
Per the CAO:
The State statutory and regulatory framework is that the Mosquito Control District utilizes its
discretion as to the treatment ofpublic and private lands. If the owner of the public lands wishes
to be involved in the process, that government agency would contact Mosquito Control and the
two agencies would then work together to formulate a "Public Lands Control Plan. "
It is my understanding that the Collier Mosquito Control District has never received any requests
from Conservation Collier requesting establishment of an Arthropod Management Plan for any
of their properties.
The issue has also been raised as to whether a Public Lands Control Plan could also be instituted
for SSA properties. For privately held lands such as SSAs, Fla. Admin Code 5E-13.039 provides
only that mosquito control operations "shall be conducted in a manner to protect the
environmental and ecological integrity of the lands and waters. " The process set forth for public
lands does not appear to be extended to privately held lands and the Mosquito Control District
seems to have broad discretion as to how to approach privately held lands.
Since the meeting on September 28, 2021, staff from Conservation Collier has met with the CMCD. Both
parties agreed that, should District expansion be successful, Conservation Collier and CMCD will
collaboratively establish an Arthropod Management Plan as acquisition cycles continue and will keep the
Board apprised of their development.
FISCAL IMPACT: There is no fiscal impact associated with this particular item.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
particular item.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal
issues at this time and requires majority vote for Board action. -JAK
RECOMMENDATION: That the Board of County Commissioners discuss the management of County -
owned public lands with the Collier Mosquito Control District, as requested.

MR. KLATZKOW: Nothing from me, ma'am.
CHAIRMAN TAYLOR: Mr. Miller?
MR. MILLER: I've got a green -screen -of -death problem to fix,
but other than that I'll be good.
CHAIRMAN TAYLOR: Commissioner Solis.
COMMISSIONER SOLIS: One thing. I would bring back an

update from the TDC meeting yesterday. I think it was yesterday.
It seems like a long time ago. A continued great news on the TDC
side but a huge shout -out I'd like to make to Jack Wert, who is
retiring. Yesterday was his last TDC meeting. He's been the
executive director for 18 years? Eighteen years. I can't say enough
about what he was able to do and his staff in terms of all of the
minute by -- moment -by -moment pivoting that they did during the
pandemic to make sure that Collier County was putting its best foot
forward in terms of marketing it as a destination.
So congratulations to Jack, and thanks for everything you did for
the county over the last 18 years.
CHAIRMAN TAYLOR: That's very nice. Thank you.
COMMISSIONER SOLIS: That's it.
COMMISSIONER LoCASTRO: I have nothing.
CHAIRMAN TAYLOR: Commissioner Saunders.

We had discussed a Mosquito Control workshop or meeting. I
remember, sir, that you talked about a follow-up. Commissioner
McDaniel, I remember you talked about a workshop, and I don't
know what the will of the Board is. Do we want a workshop, or do
we want a meeting? Understanding we need to do it pretty soon.
COMMISSIONER McDANIEL: Well, my only comment was
was I didn't want to take comments from folks that came to us and
spoke about items not on that day's agenda but coming up
potentially -- you know, this goes back to the rule that we were
talking about this morning. I just didn't want us to be making a
knee-jerk reaction without both sides being present and having the

community, in fact, involved.
CHAIRMAN TAYLOR: Okay. So you don't care what the
format?
COMMISSIONER McDANIEL: So how we get there doesn't
really matter. I mean, the issue with the workshop is, as you know,
we spent -- we spend time on something and then don't make any
decisions. We can't vote at a workshop. If we have it as an actual
agenda item, if there is someone who wishes to change their mind
with regard to the support for the Mosquito Control District's
expansion, we could actually do it.
CHAIRMAN TAYLOR: That's true. That's true.
So, Commissioner Saunders.
COMMISSIONER SAUNDERS: I think it's a fairly narrow
subject, so I don't think we need to set aside a workshop for that. If
we -- if we do set aside a workshop at some point in time, I think
things like the CRA that we talked about today, which is a much
larger issue, would be something to talk about, but we should have
more than just one item on a workshop. But I think this issue is
small enough or concise enough that we really don't need a workshop
to do that.
CHAIRMAN TAYLOR: Okay.
COMMISSIONER SAUNDERS: So I'd rather have it at a
regular meeting and make decisions at that time.
CHAIRMAN TAYLOR: All right.
COMMISSIONER LoCASTRO: Concur.
CHAIRMAN TAYLOR: So let it be a meeting, and I'll let you
schedule it accordingly, but it should probably be in October.
MR. CALLAHAN: Just to give you an update, we had -- our
staff and the staff from the Mosquito Control District recently met.
We talked about how to bring that forward, and I think we'll be
prepared to when the time's right.
