FIRST AMENDMENT TO AGREEMENT# 18-7416
FOR
PUBLIC UTILITIES LIME SLUDGE POND CLEANING
THIS AMENDMENT is made and entered into on this I R* day of etIdCrer
2021, by and between PROLIME CORPORATION, a Michigan corporation authorized to do
business in the State of Florida(the"Contractor")and Collier County,a political subdivision of the
State of Florida,(the "County")(collectively,the"Parties").
WHEREAS, on September 25, 2018, (Agenda Item 16.C.2), the County entered into an
Agreement with Contractor(the"Agreement") to provide cost-effective removal and disposal of non-
processed lime sludge generated at the South County Regional Water Treatment Plant and located in
the holding pond; and
WHEREAS, the Parties recognize the initial term of the Agreement will be ending
September 24,2021,and acknowledge the first renewal through September 24,2024. Pursuant to the
solicitation, ITB # 18-7416, the Contractor held pricing for the initial term and has requested a price
adjustment effective with the start of the renewal term on September 25, 2021. The County has
reviewed the price adjustment and finds it to be reflective of the market, recent bids on similar
agreements,and the Parties desire to amend the Agreement to revise Exhibit B,Fee Schedule,to reflect
a price increase.
NOW, THEREFORE, in consideration of the mutual promises and covenants herein
contained, it is agreed by the Parties as follows:

A. Exhibit B to the Agreement, Fee Schedule, is hereby deleted in its entirety and replaced
with the attached Exhibit B.
B. All other terms and conditions of the Agreement shall remain in full force and effect.
