RESOLUTION NO. 2007 - 201
A FINAL RESOLUTION IN ACCORDANCE WITH
RESOLUTION 200S-383A OF THE BOARD OF
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
APPROVING THE FINAL ROLL AND ASSESSMENT
CONCERNING THE PROJECT TO RESTORE THE LAKE
BETWEEN 107TH AVENUE NORTH AND 108TH AVENUE
NORTH, TOGETHER WITH THE METHOD OF
PAYMENT OF THE FINAL ASSESSMENT OF THE
PROJECT.
WHEREAS, Article II of Section 122 of the Collier County Code of Laws and
Ordinances (hereinafter the "Code") sets forth the process for creation of a Municipal Services
Benefit Unit (MSBU) and provides that the Board of County Commissioners may determine to
establish an MSBU pursuant to a petition of property owners located within such a unit; and
WHEREAS, pursuant to Section 122-42(1) of the Code, in response to a petition signed
by a majority of property owners within the proposed unit, the Board of County Commissioners,
on July 26, 2005, adopted Resolution 2005-280, which created the Naples Park Lake Special
Assessment District (hereinafter "District"), and specified the lots and parcels specially benefited
and stated that the purpose of the District is to obtain advance funding in an amount not to
exceed $40,000.00 for restoration of the lake between 107th Avenue North and 108th Avenue
North; and
WHEREAS, pursuant to Section 122 ofthe Code a tentative assessment roll and plans for
the project were submitted to the Board of County Commissioners, and after consideration of
any objections, written or otherwise, the plans, specifications and cost estimates, and the
tentative assessment roll, upon a determination that the project served a public purpose, the
Board adopted Resolution 2005-383A approving the tentative assessment roll, plans,
specifications and estimated costs on November 1,2005; and
WHEREAS, all of the improvements and restoration work has now been completed and
all of the final costs and expenses have been determined to be $30,070.98, as set forth in Exhibit
A attached hereto; and
WHEREAS, a final assessment roll has been submitted, proportionately setting forth the
amount of each parcel's assessment, which is set forth in Exhibit B attached hereto; and
WHEREAS, the method of the billing of the final assessment is specified under
Resolution 2005-383A and it is in the public interest to now formulate and present that billing for
the final assessment pursuant to that direction.

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
I. The Collier County Board of County Commissioners hereby approves the
aforementioned final assessment roll and adopts the same for the purposes of assessing the lots
and parcels within the District and MSBU benefited by the lake restoration.
2. Within 30 days from the approval of this Final Resolution and the final
assessment roll, the County Manager shall send notice via U.S. mail to each of the parcel owners
of the special assessment amount due. Payment to the County of the special assessment shall be
due Thirty (30) days from the date each letter is mailed and postmarked. Thereafter, unpaid
assessments shall generate interest to the County in the amount of one (1 %) percent per calendar
month, or part thereof, compounded monthly. All such special assessments shall constitute a lien
upon the property so assessed from the date of adoption of this Resolution.
THIS RESOLUTION ADOPTED after motion, second, and majority vote favoring same
this 24th day of July, 2007.
