Agenda 10/12/2021 Item #16A 8 (CEV20120016482)10/12/2021 EXECUTIVE SUMMARY Recommendation to approve the release of a code enforcement lien with an accrued value of $37,562.03 for payment of $2,512.03 in the code enforcement action titled, Board of County Commissioners v. Peter A. Helff, Code Enforcement Case No. CEV20120016482 relating to property located at 2080 21st St SW, Collier County, Florida. OBJECTIVE: For the Board of County Commissioners to accept an offer to release a code enforcement lien with an accrued value of $37,562.03 for payment of $2,512.03 in relation to Code Enforcement Special Magistrate Case No. CEV20120016482. CONSIDERATIONS: As a result of a code violation, the Code Enforcement Special Magistrate ordered the imposition of a lien against Peter A. Helff, in Case No. CEV20120016482, for a code violation located at 2080 21st St SW, consisting of an inoperable travel trailer being stored and repaired on the property without a valid tag. The lien was recorded in the Official Records on March 20, 2013, at O.R. Book 4898, Page 2916. The lien amount of $37,562.03 is based on 749 days of accrued fines ($50 per day from January 8, 2013, through January 26, 2015) $37,450 plus $112.03 in operational costs. The property was brought into compliance on January 26, 2015. Pursuant to Resolution No. 2012-46, a request for waiver of fines may be considered when full payment of the full lien amount would impose a severe financial hardship on the property owner. Fines accrued by an existing owner would be considered for a waiver as long as the existing owner has diligently pursued abatement and compliance has been achieved. In 2013, Mr. Helff reluctantly agreed to allow temporary storage of a camper on his property. When he returned from out-of-town employment the following month, he discovered Jason Roberts, owner of the camper, was living on the property as a squatter. After spending more than two years dealing with failed eviction attempts, the camper was removed. The actions of Mr. Roberts have caused thousands of dollars in fines to accrue against the Helff family home, which now must be sold to allow for the care of a terminally ill parent. The property is being actively maintained and $2,512.03 has been paid in settlement of fines. The owner is requesting a waiver of $35,050 in accrued fines and the required hardship letter is attached. There are no known violations at this time. FISCAL IMPACT: Payment of $2,512.03 in settlement of fines has been made, representing $2,400 in fines and $112.03 in operational costs. If approved by the Board, accrued fines in the amount of $35,050 would be waived. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution 2012-46. -CAK RECOMMENDATION: To waive the fines in the amount of $35,050, accept payment amount of $2,512.03, release the lien, and authorize the Chairman to sign the attached release and satisfaction of lien for recording in the Official Public Records. No support and no family down here in Naples,his mother was nowhere to be found. He is my pride and joy. Back in 2013 he was 13 years old and had a friend named Jake. One day Jake's father called me who I barely knew and told me he was in a pinch. He was being evicted from where he lives and since I am a couple blocks away could he please park his camper on my property for a couple days till he can get it to a proper storage facility. lfelt bad for him and said yes, this wound up being the worst mistake of my life. After he dropped it in my yard he said he broke something underneath it and will need a couple weeks to fix it. I had no choice and the weeks turned into a couple months. I reminded him that he cannot stay here especially since I go away during my summers. I go to Lake Placid and take care of Randy Smith's (Owner of Naples Trolley) home, this way I can work and keep my son safe at the same time. Of course by the time I left for the summer, the camper was still here. I was told it would be gone in less than a week. I came back home a month later and of course the camper was still here, but now Jason Roberts (campers owner) was now living in the camper, stealing electricity from my home. I told him he cannot stay here and the police were called. When they arrived, they informed me that they know him very well. Along with his criminal activity he has squatted at several different places over the years, and is very good at getting away with squatting somewhere. The police also informed me they could not remove him because he had been staying there (even without permission) and it was now a civil matter. Over the months he was stealing items from my garage. My sons motorcycle,television, tools, he even stripped all the copper wiring from the electrical in my garage. While in Lake Placid my home was also burglarized and many personal items were stolen from my son and myself. (See attached police report) the police knew Jason did it, but couldn't prove it. I tried to have him evicted but was informed by the county that I cannot evict him from his own personal camper, even though illegally parked on my property. Over time his mess grew bigger, my son and I were threatened with violence and the police were called many times for many reasons, and sadly every time they came out they were unable to do anything because it was a civil matter. I tried to have a tow truck remove the camper but Jason would leave his small dog in it so they were unable to tow it away. I got together with my next-door neighbor, Dan Trip (owner of superior propane) we declded our next step should be to call the county and get code enforcement involved, and force him out that way. Mr. Roberts told me the county came by and told him to put a tag on his camper, and it was now legal. This man made my home a very uncomfortable place. he took away any peace of mind I had in a home I lived in for more than a decade. He was a horrible person who made my son and myself feel unsafe in our own home. We were threatened with violence many times and Jason Roberts had spent many years in jail and was not afraid to go back. We heard 50 different times 50 different reasons why he was unable to remove the camper yet. He would plug into my outlets, so I would have to turn off my circuit breakers to stop him from stealing electricity. So he started running a generator day and night. The police were still unable to make him stop. I even found a buried cable to the crawlspace of my home where he had hooked into my electrical system. He had plenty of time to do whatever he wanted while I worked and he had no job. One day I received a certified letter that I needed to pick up at the post office, and it stated I had a court date about the camper on.,anuary 22,20L5.1 figured finally the county was going to do something to help me. This is when I was informed the county had been trying many times to contact me. Looking back.Jason Roberts was very skilled and was stealing any mail that was sent to my home by the county. The first letter I received was the certified one that I needed to pick up at the post office. I also found out the county was trying to get rid of the camper just like I was for many many months. This court date found me guilty of having the camper on my property I was Siven a 51200 fine and 565 Court cost. Helff) because of a squatter that had ruined my life for nearly 2 years. I went to the county for help and was only fined. I was also given till February 22 to have the camper removed or a S50 a day fine would start. I had already tried many many different routes to get rid of this camper. This is when I realized nobody was going to help me. Out of fear of a S50 a day fine, I got together with my next-door neighbor Dan who owned a large bucket loader, and one day when Jason was out we literally draged the camper to the curb and blocked my driveway with a car. Jason came home and of course called the police and told the police to demand that I move the car so he can bring the camper back to my house. I looked at the officer and told him no disrespect, but this now looks like a civil matter. The same thing I had heard from them many many times. I told them I would not remove the car from the driveway. So the police officer told Jason he cannot leave the camper in the road and he needed to take it somewhere. He called a friend with a larg truck, and down the road it went never to be seen again. This was on January 26,201.5 four days after the court hearing. That court hearing stated that I had till February 22 to get rid of the camper, or the fines would start. I remove the camper well before February 22 it was gone on January 26, and the county has that documented. Well before any fines started. (See attached court documents) lt is now many years later and my father has fallen ill. He had a quadruple bypass a few years ago. Then his hip needed to be replaced, and he also needed a double stent after his quadruple bypass. And now he has fallen very sick with cancer and has limited time. My home was badly damaged by hurricane lrma and I need to sell it to move and help my father with what time he has left. Because ofthe hurricane damage and I wanted to sell it very quick because time is of the essence, I took a huge loss. I found a buyer and was going to close on July 9. So plans were made to help my father move back home and get to safety, and now it's completely ruined because a fine popped up for 537,000 because of this camper that a squatter had made next to impossible for me to remove.So the squatter who had taken away any peace of mind I had in my home was now responsible for taking away the last little bit of time I have left with my father. I do not know where the 537,000 came from because the camper was removed before the $50A day fine started. This is a horrible thing that could not have shown up at the worst possible time. I was fully prepared to pay the 51200 in court costs that I knew were there. I am hoping that the county can help me help my father and please except double what lthought lowed and pay 52400 plus I have 5241 operational costs. This way lcan sell my home and help my father out. I am asking you to please not let this man who really did a number on my life to not completely ruined me. The only thing I have is what little I am going to get for my home. lt is a small amount, but will allow me to be able to take care of my father. I was trying to get rid of the camper for a year and a half. I turned to the county for help. Now with such a fine imposed on my home I will be unable to sell it, and will be forced to have strangers take care of my father and his last weeks or months.
