Agenda 10/12/2021 Item #16A 1 (Easement Agreement Folio #38169760004)10/12/2021 EXECUTIVE SUMMARY Recommendation to approve an Easement Agreement for the sale of an access easement over County property located on the southwest corner of Santa Barbara Boulevard and Painted Leaf Lane. OBJECTIVE: To sell a 30-foot access easement over County property. CONSIDERATIONS: Collier County is the owner of an unimproved parcel of land located on the southwest corner of Santa Barbara Boulevard and Painted Leaf Lane. The County purchased this property during 2009 as part of the ‘Santa Barbara Boulevard Road Widening Project’ (Project No. 62081). The entire property was purchased to avoid a claim for substantial severance damages to the remainder property arising from the proximity of the new right-of-way line to the home, which has since been demolished. The proposed easement will enable the adjacent property owners, Ronen Graziani and LeeAnne W. Graziani, to construct a driveway off Painted Leaf Lane to their property, thereby eliminating the need for a new driveway off Santa Barbara Boulevard and improving traffic safety in this location. An aerial map depicting the location of the County property, the Graziani property and the proposed access easement is attached. The attached agreement is the result of amicable negotiations and provides for the sale of this easement to Mr. and Mrs. Graziani for $21,500. Please refer in this regard to the valuation memorandum dated July 29, 2021, prepared by the Growth Management Department’s Review Appraiser, Harry Henderson, confirming that the sale price represents the fair market value of the easement. Staff recommends that the Board of County Commissioners (the Board) approve the agreement. FISCAL IMPACT: Funds in the amount of $21,500 will be received by Collier County at closing. Recording and other costs will be borne by Mr. and Mrs. Graziani. Funds will go back to Impact Fee District 4 Fund (336), project 62081. GROWTH MANAGEMENT IMPACT: None. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - JAB . RECOMMENDATION: Approve the attached agreement and authorize the Chairman to execute same on behalf of the Board; . Authorize the Board's Chairman to execute the access easement in a form approved by the Office of the County Attorney; and . Authorize the County Manager or his designee to execute any such other closing documents needed to effectuate the grant of this access easement, after approval by the Office of the County Attorney.
