10/12/2021 EXECUTIVE SUMMARY Recommendation to award Invitation to Bid (“ITB”) No. 21-7923, “Collier Beach Renourishment 2021-2022,” to Phillips and Jordan, Inc., in the amount of $4,987,323.21, authorize the Chair to sign the attached Agreement, and make a finding that this item promotes tourism (Project Nos. 90066, 90068, and 50126). OBJECTIVE: To proceed with truck haul beach renourishment of Naples Beach from Lowdermilk Park to Naples Pier, Vanderbilt Beach from south of Delnor Wiggins State Park to approximately one-half mile south of Vanderbilt Beach Road, and Pelican Bay Beach from FDEP Reference monument R -34 to R-36 in the Fall of 2021. CONSIDERATIONS: Staff is asking that funding and that an award for ITB No. 21-7923 be approved for a 268,500-ton truck haul beach renourishment project for Naples Beach from just south of Lowdermilk Park to just north of Naples Pier, Vanderbilt Beach from south of Delnor Wiggins State Park to approximately one-half mile south of Vanderbilt Beach Road, and Pelican Bay Beach fr om FDEP R- monument R-34 to R-36 (hereafter the “Project”) for a contract amount of $4,987,323.21, which shall include the following: • Transportation from the sand mine to multiple beach unloading sites • Sand distribution and placement on the beach • Turbidity monitoring • Maintenance of Traffic and Weight Ticket Tracking • Construction layout The project will utilize the 3rd Avenue North and Vanderbilt Beach Road beach access points to place the sand. Mobilization will begin in late October 2021, with an anticipated completion date of January 15, 2022. On August 11, 2021, the Procurement Services Division posted ITB No. 21-7923, the Collier Beach Renourishment 2021-2022 project. Phillips and Jordan, Inc. founded in 1952, is headquartered in Knoxville, Tennessee, with a regional office in San Antonio, Florida. The 11.A Packet Pg. 190 10/12/2021 company performed a major truck haul renourishment of Naples and Park Shore beaches in 2013, and another renourishment of Naples beach in 2014. Staff and the engineering consultant, Coastal Protection Engineering, determined the lowest bid is fair and reasonable and recommends awarding the contract to Phillips and Jordan, Inc. The engineer consultant evaluated references and deemed them acceptable to determine the contractor’s experience on work of a similar magnitude judged within the last five years, its skill and business standing, and its ability to conduct the work as completely and timely as required under the terms of the Agreement. The bid is approximately 5% below the engineer consultant’s $5,232,100.00 opinion of probable cost. The Procurement Services Division concluded bidding was competitive and representative of market conditions. The bid tabulation, bid analysis, engineer’s letter of recommendation (DELORA), the Notice of Recommended Award (NORA) and agreement are attached. The contract amount of $4,987,323.21 will not exceed the approved budget of $7,302,924.50 (May 11, 2021, Agenda Item 11F). Sand for the project will be paid for separately under contract 21-7827 with Stewart Materials. Pre-construction surveys performed in the weeks prior to construction will determine the amount of sand needed, but the quantity can be adjusted up to 25% if necessary, per the terms of the contract. Pelican Bay Services Division will incur all construction costs associated with the renourishment of Pelican Bay Beach on a pro-rata, per ton basis. ADVISORY COMMITTEE RECOMMENDATIONS: At the April 8, 2021, Coastal Advisory Committee, the fall truck haul beach renourishment project item was unanimously recommended for approval by a 9 to 0 vote. At the April 26, 2021, Tourist Development Council meeting, the fall truck haul beach renourishment project item was unanimously recommended for approval by a 9 to 0 vote. GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to this action. FISCAL IMPACT: Funding for this project is available in the FY 2022 budget within the Tourist Development Tax Fund 195, Project Nos. 90066, 90068, and 50126. Partial funding for this project will be requested for reimbursement from The Florida Department of Environmental Protection (FDEP). The scope of the Collier Beach Renourishment 2021‐2022 project includes hauling beach compatible material from Stewart Material’s Immokalee Sand Mine, with placement and grading of the fill material within three sections of Collier County’s beaches: Naples, Vanderbilt, and Pelican Bay beaches. Collier County Purchasing Division determined Phillips & Jordan, Incorporated (P&J) to be the low bidder with a bid amount of $4,987,323.21, which is approximately 5% less than the project’s Opinion of Probable Cost (OPC) amount of $5,232,100.00. During the bid review process, it was determined that P&J provided a complete bid response and a bid form free of summation errors. P&J is a contractor that specializes in heavy civil construction, right of way infrastructure construction and disaster response; they have performed similar beach restoration construction within Collier County in 2013 and 2014. The projects provided by P&J as references are for a variety of earthwork projects including a recent beach restoration in Indian River County ranging in value from $1.1M to $14.3M. CPE contacted the provided references to discuss how the work performed by P&J was similar in nature to the proposed Collier Beach Renourishment 2021‐2022 and to see if P&J performed acceptably on the projects. We received responses from the following as summarized below, with accompanying vendor reference logs provided as attachment: 1) Indian River County, Sebastian Inlet District, FL – CPE contacted the Sebastian Inlet District reference and was directed to Executive Director James Gray who had worked with P&J on their 11.A.3 Packet Pg. 195 Attachment: 09.10.21 - DELORA - CPE (20116 : Recommendation to award ITB No. 21-7923 to Phillips & Jordan, Inc.) James provided highly positive feedback on his experience with P&J and confirmed that the scope of work included truck hauling of material with placement on a beach site using off road trucks and heavy equipment. Their project limited sand placement to the dry beach so turbidity monitoring was not conducted as part of this work. 2) Barton Malow – Teddy Chase, project manager from Barton Malow provided a reference for previous experience with P&J on an earthwork project in Lake Buena Vista, FL. The project involved a large quantity of muck removal from a drainage pond and installation of a drainage line. Teddy provided overall positive feedback of P&J based on his experience. 3) The Haskell Company – Trevor Bradley (project manager). Trevor provided a reference for P&J’s work from a land development project with Blue Origin in Cape Canaveral, FL. The project involved full civil engineering site development: clearing, grading, roadway design and installation, storm/waste/freshwater installation systems. Trevor stated overall positive experiences with P&J, noting that they are a repeat subcontractor for Haskell. 4) NUCOR Steel Florida – CPE spoke with Donnie Johnson from NUCOR Florida regarding his experience with P&J during their Frostproof Project. The project involved extensive site work/land development: clearing 480 acres, grading, and installation of fencing, roadways, stormwater systems, and excavation for stormwater ponds. Donnie gave overall positive feedback of P&J’s work, noting that P&J maintained a safe construction area and good project oversight. He recommended P&J for future work. 5) Black & Veatch – Barry Clegg from Black & Veatch (B&V) provided a reference for P&J’s work as a subcontractor to him on the 2020 Dania Beach Energy Center. P&J performed a variety of earthwork and stormwater tasks for B&V on this job. Barry provided positive feedback and indicated that they would definitely use P&J on future work as they were a quality subcontractor. 6) Florida Power and Light (FPL) – Mark Sawyer. CPE spoke with Mike regarding his experience with P&J during an earthwork project in Biscayne National Park, FL. The project involved decreasing the depth in the Intracoastal Waterway in the Park in an area of low flow rate. Depth was decreased from ‐30’ to ‐15’ by placement of suitable material within very tight specifications. Turbidity monitoring was conducted as part of this work. Mark stated that he had an overall positive experience with P&J. While only one of the contacted references were for projects requiring hauling of sand from an upland source with delivery and placement on a beach site, all projects included use of heavy equipment and the FPL project showed additional experience of working within the coastal zone with environmental requirements such as turbidity monitoring. Each contacted reference provided positive feedback on P&J’s work, safety and submittal quality. Describe below. Yes. P&J were responsive and proactively dealt with any issues that came up during construction. The District was impressed by P&J’s relationship with the trucking broker, which resulted in additional drivers and trucks being added quickly to address the project’s needs. 5. Complete applications for payment were submitted allowing the District’s engineer to review without challenge. Lien requests, certifications etc. were turned around quickly to release retainage. 6. The client on this project was very demanding and there were many design and owner directed changes.
