EXECUTIVE SUMMARY
Recommendation to approve the documents necessary to terminate a portion of an existing
Collier County Utility Easement to JDA Courthouse Shadows, LLC, a South Carolina
limited liability company, associated with the development at Courthouse Shadows.
OBJECTIVE: To terminate the utility easement which had previously been conveyed for sanitary sewer
utility facilities to the County.
CONSIDERATIONS: On September 22, 1987, Agenda Item 14D4, the Collier County Board of County
Commissioners (Board) accepted the sewer facilities to serve Courthouse Shadows. The Utility Facility
Warranty Deed, Bill of Sale and Easement, were recorded on September 23, 1987, in Official Records
Book 1297, Page 1156, which conveyed sanitary sewer utility facilities located within Courthouse
Shadows to the Board of County Commissioners of Collier County, Florida, as the Governing Board of
the Collier County Water-Sewer District (County).
These conveyance documents were recorded after preliminary acceptance of the utility facilities for the
project, in accordance with the Utility Facility Standards and Procedures Ordinance No. 2004-31. The
purpose of the attached Termination of Easement is to reconvey back to the current property owner, to
JDA Courthouse Shadows, LLC, a South Carolina limited liability company (JDA), the County’s interest
in any sanitary sewer utility facilities that may exist within the subject property so JDA can develop their
property and relocate the existing sewer utility facilities.
Final acceptance of utilities for PL20200000554 Courthouse Shadows Utility Relocation (SDPA) is
prerequisite to termination of this easement because the Dunkin Donuts at 3440 TAMIAMI TRL E is
served by the existing sewer running through this easement but will be connected to the new sewer
constructed along the reverse frontage road under this permit.
FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval - JAB
RECOMMENDATION: To approve and authorize the Chairman to sign the Termination of Easement
between County and JDA in order to reconvey to JDA, the County’s interest in any sanitary sewer utility
facilities and utility easements associated with the development at the Courthouse Shadows project, which
were previously conveyed to the County.

BILL OF SALE OF SANITARY SEWER FACILITIES
This Bill of Sale is executed this _________ day of _______________, 2021, on behalf
of the BOARD OF COUNTY COMMISISIONERS OF COLLIER COUNTY, FLORIDA, AS THE
GOVERNING BODY OF COLLIER COUNTY AND AS EX-OFFICIO THE GOVERNING
BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT, (“Grantor”) to JDA
COURTHOUSE SHADOWS, LLC, a South Carolina limited liability company, its
successors and assigns, (“GRANTEE”).
GRANTOR, for and in consideration of Ten Dollars ($10.00) and other good and
valuable consideration from GRANTEE to GRANTOR, receipt of which is hereby
acknowledged, GRANTOR herby CONVEYS to GRANTEE, its successors and assigns
forever, ownership in and to any and all pipe, fittings, and any other infrastructure or
improvements appurtenant thereto or thereunder, associated therewith and/or connected
thereto, for GRANTEE’S operation, replacement, repairs, maintenance, and/or relocation, lying
and being in Collier County, Florida, as follows:
(Exhibit “A” and Exhibit “B” attached hereto is a sketch or other graphic representation
that depicts the physical location of items being conveyed by this Bill of Sale.)
At this time, only the easement described in Exhibit “A” is being vacated, but upon the
recordation of the new gravity sewer, the easement described in Exhibit “B” shall automatically
be terminated.
GRANTEE shall be liable for continuing sewer service to all existing customers
currently being served until the new gravity sewer is accepted and placed in service.
IN WITNESS WHEREOF, Grantor has caused this Bill of Sale to be executed the date
and year first above written as authorized by the Board of County Commissioners as the
governing body of Collier County and as ex-officio the governing board of the Collier County
Water-Sewer District.
