EXECUTIVE SUMMARY
Recommendation to accept the conveyance of a sidewalk easement (Parcels 105SWE1, 105SWE2)
to facilitate Collier County’s maintenance of the public sidewalk along the south side of Mainsail
Drive.
OBJECTIVE: To maintain those portions of the public sidewalk along the south side of Mainsail Drive
that meander outside the public right-of-way.
CONSIDERATIONS: Collier County’s Road Maintenance Division currently maintains the public
right-of-way known as Mainsail Drive. Along the south si de of the street is a sidewalk that stretches
roughly 1½ miles, from Collier Blvd to its terminus at the Marco Island Executive Airport. Various
sections of the sidewalk are currently in need of repair, and accordingly Road Maintenance is planning to
undertake comprehensive repair work on the sidewalk beginning sometime after October 1, 2021. A
recent property survey revealed that various sections of the sidewalk meander outside the Mainsail Drive
public right-of-way onto adjoining private property. The County has contacted each affected property
owner to request the donation of a sidewalk easement, to establish the County’s right to legally enter upon
such properties for the purpose of performing the work. One such property owner, Fairways II at Marco
Shores Condominium Association, Inc., has agreed to donate a sidewalk easement to the County over two
narrow portions of its property (Parcels 105SWE1, 105SWE2) and has executed a proposed Sidewalk
Easement.
FISCAL IMPACT: Funds for miscellaneous closing and recording fees of approximately $100 will be
required. The funding source for such fees is Road Maintenance’s sidewalk maintenance budget within
Transportation Fund (101), Road Maintenance Cost Center (163620).
The sections of the sidewalk located within the subject parcels are currently in good repair and therefore
no sidewalk repair work will be performed within the subject parcels later this year (in other words, the
cost of the initial sidewalk repair work, as allocated to the subject parcels, is $0). At such time in the
future as the sections of the sidewalk located within Parcels 105SWE1, 105SWE2 (approx. 0.11 mile)
begin to deteriorate, the anticipated maintenance costs are approximately $232 annually.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a
majority vote for Board approval. - JAB
RECOMMENDATION:
. Accept the conveyance of Parcels 105SWE1 and 105SWE2, and authorize the County Manager or his
designee to record the conveyance instrument in the public records of Collier County, Florida; and
. Authorize the payment of all costs and expenses necessary to close the aforesaid transaction.
