EXECUTIVE SUMMARY
Recommendation to approve the release of a code enforcement lien, with an accrued value of
$42,059.28 for payment of $5,000 in the code enforcement action titled, Board of County
Commissioners v. Tam Thanh Nguyen and Tammy Nguyen, relating to property located at 5175
Green Blvd, Collier County, Florida.
OBJECTIVE: That the Board of County Commissioners accept an offer to release a code enforcement
lien with an accrued value of $42,059.28 for payment of $5,000, in relation to Code Enforcement Board
Case No. CEAU20170016724.
CONSIDERATIONS: The Code Enforcement Board ordered the imposition of a lien against Tam
Thanh Nguyen and Tammy Nguyen, in Case No. CEAU20170016724, for a code violation at 5175 Green
Blvd. The violation consisted of an unmaintained and dilapidated wood fence that was installed on the
property without a permit. The lien was recorded on May 10, 2021, at O.R. Book 5944, Page 1404. The
current lien amount is $42,059.28, based on 420 days of accrued fines ($100 per day from March 25,
2020, through May 18, 2021) totaling $42,000, plus $59.28 in operational costs. The property was
brought into compliance on May 18, 2021.
Pursuant to Resolution No. 2012-46, a request for waiver of fines may be considered when full payment
of the full lien amount would impose a severe financial hardship on the property owner. Fines accrued by
an existing owner would be considered for a waiver as long as the existing owner has diligently pursued
abatement and compliance has been achieved. When Tam Thanh Nguyen and Tammy Nguyen became
aware of the code violation, they began to bring the property into compliance as quickly as possible. The
process was longer than anticipated due to the Covid-19 Pandemic and a sharp decrease in tourism which
forced them to temporarily close their small “Mom & Pop” business. Still struggling to recoup losses and
keep their business afloat, the Nguyen’s have spent a significant amount of time and resources to come
into compliance. The owners have paid $5,000 in settlement of fines and are requesting the remaining
$37,059.28 in accrued fines be waived; see attached hardship letter as required. There are no known code
violations at this time.
FISCAL IMPACT: Payment of $5,000 in settlement of fines has been made. If approved by the Board,
accrued fines in the amount of $37,059.28 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46. - CAK
RECOMMENDATION: To waive the fines in the amount of $37,059.28, accept payment amount of
$5,000, and authorize the Chairperson to sign the attached release and satisfaction of lien for recording in
the Official Public Records.

lf, however, there is a financial hardship you may request a reduction of fines. Attached please find Resolution20!2-46,
which allows the Code Enforcement Director to recommend settlement of code enforcement liens, for Board of County
Commissioners approval, using specified criteria.
To request a reduction of fines please forward a letter (emailto me is acceptable), addressed to the Board of County
Commissioners, requesting a reduction of fines. The letter must detail a severe financial hardship, circumstances and/or
expenses that may have contributed to delays in compliance, expenses in obtaining compliance , andf or any other details
wished to be considered and an offer of settlement for consideration. Please note that costs incurred by the county arenot reduced.
The request is reviewed at Code Enforcement. lf accepted, we will contact you for the settlement payment. After the
settlement is paid we proceed with seeking Board of County Commissioners' approval in their next available meeting
agenda. As Cristina advised in her email below, the Commissioners have a summer break, therefore, the next available
meeting agendas begin again in September 2021,.

Mr. Nguyen,
Following up on our conversation regarding the code case for the fence. The case has been closed, the fines stopped
accruing but there is a lien on the property.
As discussed, there is an option to pay the amount of the lien. Resolving this completely may also take 30-60 days for a
satisfaction of lien to be issued.
Additionally, you may submit a request for a reduction of the fines, but as mentioned do to summer time and
prescheduled Board of County Commissioner meetings this may take up to possibly September to receive a final
response and then additional time to finalize the satisfaction of lien. Mrs. Burgos will provide a follow up email with
instruction on how to proceed.
lf the buyer and yourself would agree to placing funds in an escroll account in order to sell the property, the County has
no input or objection that is a private decision amongst yourselves.

Good afternoon Robert,
It was a pleasure speaking with you earlier about the orders related to 5175 Green Blvd. As we discussed, there are two
code cases with orders recorded in public records:
For case CEPM20190006547 , a second hearing took place, and the order states that the violation was abated, that there
are no fines/costs imposed and an imposition of fines/liens was denied. Attached please find the order; we are now in
process of recording it in public records.
As for CEAU2017001.6724, fence violation (OR 5749 PG 339L), the case went before the Code Enforcement Board on
4123/21and the lien was granted. lt is in process, not recorded yet. The respondents were ordered to pay 539,559.28.
The total lien will continue to accrue at S100/day until the violation is abated). ln order to obtain a release of lien, the
violation must be abated and the fine paid in full (up to date of abatement).
lf a partial lien release is requested by the respondent for the sale of another property, then we will need a letter from
the owner, (email to me is acceptable), addressed to the Board of County Commissioners (BCC) requesting a partial
release. The letter should detail any circumstances they wish to be considered and include a settlement offer for
consideration.
The request is reviewed usually within two weeks with the Code Enforcement Director and, if accepted, we contact the
requestor for payment.
Once the payment is received, we proceed with scheduling the approval at the next available BCC meeting. We are
currently working on June BCC meetings.
