Recommendation to approve Ordinance Number 2004-41, as amended, the Collier County Land Development Code, which established the comprehensive zoning regulations for the unincorporated area of Collier County, Florida, by amending the appropriate zoning atlas map or maps by changing the zoning classification of the herein described real property from a Rural Agricultural (A) Zoning District to a Residential Planned Unit Development (RPUD) Zoning District for the project to be known as Soluna RPUD, to allow construction of up to 108 dwelling units on property located southwest of the intersection of Tree Farm Road and Massey Street, in Section 35, Township 48 South, Range 26 East, consisting of 18.5± acres; and by providing an effective date. [PL20210000093] (District 5) (Staff’s Request) Note: Time Certain Items: 10/4/2021 12:57 PM 09/28/2021 EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners, acting as the Community Redevelopment Agency Board (CRA), approve a resolution renaming the Bayshore Gateway Triangle Site Improvement Grant Program to Single Family Improvement Grant Program and updating eligible activities and process; and placing the remaining residential grant programs in the Bayshore Gateway Triangle Community Redevelopment Area on hold until further notice. OBJECTIVE: To update the Residential Site Improvement Grant guidelines to reflect the current needs of the community and implement the objectives and strategies of the Community Redevelopment Plan, and specifically Objective 5 of Goal 5.3.4 of the BGTCRA Redevelopment Plan states: Incorporate protections in development efforts to enhance existing community character and support existing CRA area residents. Strategy 1 - Establish assistance programs and incentives to protect and enhance existing community-oriented uses and local neighborhood commercial and single-family neighborhoods off the main corridors. Assistance and incentives distribution might account for building age, structural quality, and means of property owners. The other three grant programs as noted below will be put on hold until further review and analysis can be completed and presented to the CRA. CONSIDERATIONS: Ordinance No. 2002-38, as amended authorizes seven grant programs for the BGTCRA. In 2002, the Board created two grant programs Site Improvement and Impact Fee Assistance. Over the years additional programs were established and by 2011 the seven grant programs were created. Funding for these grant programs stopped in 2012 until February 2020 when the Board approved funding the programs based on the following allocations. Five Site Improvement Grants totaling $34,981.83; and one Landscape Improvement Grant totaling $2,500 and one Shoreline Stabilization Grant totaling $5,000 (this award was reimbursed after the sale of the home shortly after the award was provided). No one has applied for the Sweat Equity Grant. In FY21 budget an additional $100,000 was allocated to this program. Since reinstating the residential grant programs, staff has identified several components of the grant program that merit change to better reflect the conditions of the community as well as process improvement. At the April 2021 Annual Meeting, revisions to the grant program were identified on the FY21 work program. 16.B.1 Packet Pg. 893 09/28/2021 The following highlights notable changes: 1. Renames grant program to Single Family Improvement Grant Program. 2. Increases maximum grant award to $15,000. Clarifies that once an applicant receives maximum award, the applicant is ineligible to apply again for three years. 3. Grant Award match is reduced from 67% to 50% 4. Only applies to Single Family Homes with residential Single-Family zoning outside of community associations or gated communities. 5. Establishes a maximum value of the homes that qualify for the grant based on length of ownership and value. Value must be at or below the most recent State Housing Initiatives Partnership Program (SHIP) purchase price for Collier County provided by Florida Housing Finance Corporation, which is currently at $400,307. For properties owned for less than 12 months the purchase price will determine qualifying value and for properties owned for 12 months or longer, the total assessed property value as determined by the Collier County Property Appraisal will be used to determine qualifying value. 6. Eligible Activities have been limited to the following: a. Replacement of roofs - 10 years or older b. Replacement of windows and doors - 10 years or older to current Florida Building Code Standards c. Flood Mitigation improvements - such as raising the home or flood proofing* d. Driveway Improvements (asphalt, concrete, or permeable pavers) provided drainage improvements are included such as the installation of culverts or regrading of swales. e. Purchase and installation of a new shed. Shed must be place behind the house and color and style should complement the architectural style of the house. * f. Exterior Façade Upgrade - must include pressure washing, rot and or stucco repair, painting, and one architectural enhancement consistent with residential design standards (shutters, decorative brackets, or front porch improvements) or decorative lighting. g. Establishment of Transitional Buffer between Residential and Commercial Uses - privacy fence and landscaping. The fence material can be vinyl composite, concrete block with stucco finish or metal or a combination. No chain link fence is allowed. Florida Friendly landscaping is required. * h. Exterior ADA Accessibility improvements. i. Front yard fence and gate. Must be decorative fence and meet all county codes. No chain link fence is permitted. * Exempt from the partially visible from the public right of way requirements. 7. Application has been removed from the resolution and is a separate document. This removal will allow for administrative changes to occur to keep the application current yet always consistent with the Board approved program. Revised application package is made part of back -up to this Item. 8. Miscellaneous: Removes inconsistencies and redundancies. FISCAL IMPACT: Funds are available in BGTCRA Fund 787, Residential Grant Project #50197. The 16.B.1 Packet Pg. 894 09/28/2021 estimated available funds for FY22 is $195,432 after reimbursement of approved grants and a FY22 budget allocation of $55,000. Residential Grant Agreements previous approved by the Board will not be impacted by these proposed changes and will be reimbursed as stipulated in the agreements. GROWTH MANAGEMENT IMPACT: This project meets the current Growth Management Plan and further the goals of the Community Redevelopment Plan. ADVISORY COMMITTEE RECOMMENDATIONS: At the August 30, 2021 Special Meeting of the Bayshore Gateway Triangle Local Redevelopment Advisory Board meeting, the Board recommended the maximum grant award be increased to $15,000 and unanimously recommended approval of the revisions to the program 7-0. LEGAL CONSIDERATIONS: Ordinance No. 2002-38 allows changes to the grant program to be made by resolution. To qualify the property must be located outside a community association or gated community. All property taxes must be paid to the current year. The SIG program funds only exterior improvements as a matching grant, requiring applicants to contribute a minimum of 50 percent of total project costs. The maximum dollar award under this program is $15,000. Grant approval is contingent on availability of funding and review and approval of the Board of County Commissioners, acting as Collier County Community Redevelopment Agency Board. Work must be completed within a year from the date of approval. Extensions may be granted on a case-by-case basis as noted below. All improvements must be at least partially visible from the public right-of-way unless otherwise noted. No purchase of materials or work associated with the grant funding and as outlined in the bid documents can begin prior to final approval by the Board of County Commissioners, acting as Collier County Community Redevelopment Agency Board (Board). Applicant Eligibility: Residential Properties The SIG program is designed to maintain the affordability of the area and to improve existing housing conditions related to health and safety. To qualify: 1. Property must be an existing single-family home located within the BGTCRA boundaries with the appropriate zoning. 2. Value of property must be equal to or less than the most recently published Florida Housing Finance Corporations State Housing Initiatives Partnership Program (SHIP) Purchase Price Limit for Collier County. Value of the property is determined by one of the following: a. Applicants that have purchased the property within the last 12 months from the date of the completed application, the purchase price will determine qualifying value. b. Bids for Work For each type of improvement to be funded, applicants must obtain a minimum of two cost estimates. For improvements to be performed by contractors, two official bids by licensed contractors are required. Each bid submitted should be similar in the detail or work being performed and materials used. Bids from unlicensed contractors will not be accepted for the SIG program. For “do-it-yourself” projects applicants must provide two official cost estimates with clear identification of vendors (CRA does not reimburse labor costs for “do-it-yourself” improvements). The amount of the grant will be determined by the lowest bid/lowest price estimate for each improvement though grantees may actually use any licensed contractor or any vendor. ANY WORK PERFORMED BY CONTRACTORS NOT LICENSED WILL NOT BE ELIGIBLE FOR REIMBURSEMENT. Project Requirements Eligible Activities Only exterior improvements are eligible for funding under this program. All improvements must be at least partially visible to the public, either from the public right- of-way or some other highly visible location, or to remove a threat to health, safety or welfare of persons in the general vicinity. Eligible improvements must result in one or more of the following: (1) increase the aesthetic appeal of the area; (2) improve the functionality of the premises; (3) remedy structural problems or code violations. Copies of all invoices and proof of payment - grantees must prove that payment for work was paid DIRECTLY to ACTIVELY LICENSED CONTRACTORS or VENDORS by personal check (Front and Back of all canceled checks) or credit card statement showing paid in-full of work completed in the name of the grantee, or in the name of the third-party entity designated and approved at the time of application Under no circumstance will payment to unlicensed contractors/subcontractors or undocumented vendors be reimbursed. Grantees must provide receipts or invoices with the payment amount indicated clearly. No reimbursement will be disbursed for work paid for with cash. Reimbursement is typically received within 45 days from completed reimbursement package. 3. Project Summary Report Change Orders and Time Extensions Change Orders to Increase Funding After a SIG agreement is executed, if a grantee discovers or is otherwise informed of flaws in the approved site, a change order may be issued to increase funding not to exceed the maximum award available. Change orders must be requested in time for staff to process the request and secure approval (allow a minimum of one month prior to expiration of grant). IMPORTANT: Change orders cannot be processed within the last two weeks of the grant period. Upon successfully completing work under the original SIG, grantees must wait three years and may then apply for additional funding for work unrelated to the original project[s]. Time Extensions The CRA understands that redevelopment projects can take more time to complete than is originally anticipated. For grantees who cannot complete their projects within one year, time extensions may be granted. Grantees needing extensions must request the extension within two months of grant expiration. No extensions can be granted within the last two weeks of the grant period. IMPORTANT: Grantees must verify that some activities associated with the improvements have been performed at least six months after execution of the agreement. All improvements must be at least partially visible to the public, either from the public right- of-way or some other highly visible location, or to remove a threat to health, safety or welfare of persons in the general vicinity. Eligible improvements must result in one or more of the following: (1) increase the aesthetic appeal of the area; (2) improve the functionality of the premises; (3) remedy structural problems or code violations . or (4) aid in business operation (for non-profit applicants). The grant recipient will be reimbursed at a rate of $1 from CRA for every $2 from applicant, up to a maximum award of $158,000 from the CRA. During the application process, the Grantee may agree to supply funds and receive reimbursement, or an agreement may be with a third-party private funding entity, as determined at time of application. The matching funds will be reimbursed to the same party, as identified in the application, that makes full payment to the vendor.The following are examples of improvements which would be eligible for grant funding All activities must comply with all applicable regulations and permit requirements including Collier County Right of Way if applicable. Eligible Activities: 1. Replacement of roofs – 10 years or older 2. Replacement of windows and front entry doors – 10 years or older to current Florida Building Code Standards 3. Flood Mitigation improvements – such as raising the home or flood proofing* 4. Driveway Improvements (asphalt, concrete, or permeable pavers) provided drainage improvements are included such as the installation of culverts or regrading of swales. 5. Purchase and installation of a new shed. Shed must be place behind the house and color and style should complement the architectural style of the house. A shed is considered an Accessory Structure in the Land Development Code and must meet requirements. * 6. Exterior Façade Upgrade – must include pressure washing, rot and or stucco repair, painting, and one architectural enhancement consistent with residential design standards (shutters, decorative brackets, or front porch improvements) or decorative lighting. 7. Establishment of Transitional Buffer between Residential and Commercial Uses – privacy fence and landscaping. The fence material can be vinyl composite, concrete block with stucco finish or metal or a combination. No chain link fence is allowed. Under no circumstance will payment to unlicensed contractors/subcontractors or undocumented vendors be reimbursed. Grantees must provide receipts or invoices with the payment amount indicated clearly. No reimbursement will be disbursed for work paid for with cash. Reimbursement is typically received within 45 days from completed reimbursement package. 3. Project Summary Report Change Orders and Time Extensions Change Orders to Increase Funding After a SIG agreement is executed, if a grantee discovers or is otherwise informed of flaws in the approved site, a change order may be issued to increase funding not to exceed the maximum award available. Change orders must be requested in time for staff to process the request and secure approval (allow a minimum of one month prior to expiration of grant). IMPORTANT: Change orders cannot be processed within the last two weeks of the grant period. Time Extensions The CRA understands that redevelopment projects can take more time to complete than is originally anticipated. For grantees who cannot complete their projects within one year, time extensions may be granted. Grantees needing extensions must request the extension within two months of grant expiration. No extensions can be granted within the last two weeks of the grant period. IMPORTANT: Grantees must verify that some activities associated with the improvements have been performed at least six months after execution of the agreement. Grant Agreement Once the application is completed and recommended for approval by the Bayshore Gateway Triangle Local Redevelopment Advisory Board, the applicant is required to sign a Grant Agreement between the Collier County Community Redevelopment Agency that outlines the terms of the grant award including the provision “should the property be transferred, sold, or the Grantee otherwise divested of its interest, or fail to maintain the improvements during the five-year period following receipt of grant funds, the CRA must be reimbursed the grant funds.” Once approved by the Board, this Agreement shall be recorded in the Public Records of Collier County, Florida.
