EXECUTIVE SUMMARY
Recommendation to approve and execute documents necessary for the conveyance of a Utility
Facilities Warranty Deed and Bill of Sale and Utility Easement for potable water and sewer
infrastructure on County owned property located at the proposed Heritage Bay Government
Center site to the Collier County Water-Sewer District, at a cost not to exceed $100.
OBJECTIVE: To convey a Utility Facilities Warranty Deed and Bill of Sale and Utility Easement to the
Collier County Water-Sewer District (District) for potable water and sewer infrastructure installed on
County owned property.
CONSIDERATION: Collier County owns 7.73 acres of land (Site) located north of the intersection of
Collier Boulevard (C.R. 951) and Immokalee Road within the Heritage Bay Planned Unt Development
(PUD). A Location Map is attached for reference. The Site was dedicated to the County as “Tract ‘G’
(Government Purposes)” on the plat of Heritage Bay Commons recorded June 8, 2005.
On November 12, 2019, under Agenda Item 16C1, the Board of County Commissioners (Board)
approved the selection committee’s ranking selection for RPS No. 19-7634 for the design, permitting and
construction of the proposed Heritage Bay Government Center. The construction of the facilities is now
nearly complete and in preparation for the final completion and obtaining the final Certificates of
Occupancy, we must meet the requirements of the District.
The District is the water and wastewater utility service provider in the Heritage Bay area an d will be
providing water and wastewater utility service to the Heritage Bay Government Center site. Recording of
appropriate documents will be done by the Growth Management Department (GMD) once all District
requirements have been met for Preliminary Approval.
FISCAL IMPACT: The Government Service Center is funded by the Collier County Tax Collector’s
Office and the related contract for that portion of the work has been negotiated separately between the
Tax Collector and the contractor. The total cost for recording of the Utility Facilities Warranty Deed and
Bill of Sale will not exceed $100.00, which is available in Facilities Capital Projects Fund (301), Project
No. 52525.
GROWTH MANAGEMENT IMPACT: There are no Growth Management Impacts associated with
this action.
LEGAL CONSIDERATIONS: The conveyance documents have been reviewed and approved for form
and legality and requires a majority vote for Board action. - JAB
RECOMMENDATION: That the Board:
1. Approve and authorize the Chairman to execute the documents necessary for the conveyance of the
utility facilities, including the attached Utility Facility Warranty Deed and Bill of Sale, Utility
Easement, and Owner’s Affidavit.
2. Acting as Ex-Officio the Governing Board of the District to accept the attached Utility Facility
Warranty Deed and Bill of Sale, and Utility Easement; and
3. Direct the County Manager or his designee to proceed to follow all appropriate closing procedures
and to record the aforementioned documents in the Public Records of Collier County, Florida.

BEFORE ME, the undersigned authority, personally appeared PENNY TAYLOR, who
to me is well known, and having been duly sworn and under oath, deposes and

1 . My name is PENNY TAYLOR, I am over the age of twenty-one (21) years, am sui
juris, and have personal knowledge of the facts asserted herein.
2. COLLIER COUNTY is the owner of said real property located at 15456 Collier Blvd
and known as Heritage Bay Government Center, and described on Exhibit A, which
shows the location of the subject utility facilities being conveyed.
3. AII persons, firms, and corporations, including the general contractor, all laborers,
subcontractors and sub-subcontractors, materialmen and suppliers who have
furnished services, labor or materials according to plans and specifications, or extra
items, used in the construction, installation and/or repair of water and wastewater
utility system(s) or portion(s) thereof on the real estate hereinafter described, have
been paid in full and that such work has been fully completed and unconditionally
accepted by the current owner of such facilities.
4. No claims have been made to the owner, nor is any suit now pending on behalf of
any contractor, subcontractor, sub-subcontractor, supplier, laborer or material-men,
and no chattel mortgages or conditional bills of sale have been given or are now
outstanding as to the subject utility system(s) or portion(s) thereof placed upon or
installed in or on the aforesaid premises.
5. Title to the subject utility system(s) or portion(s) thereof and/or easement(s), if any,
being conveyed to the County is not encumbered by any recorded mortgage,
recorded assignment of rents or profits, by any recorded Uniform Commercial Code
Financing Statement, or by any other recorded document that imposes a security
interest that could negatively affect conveyance of marketable title to the utility
system(s) or portion(s) thereof and/or any easement being conveyed to the County.
6. As and on behalf of the owner of the subject utility system(s) or portion(s) thereof,
does for valuable consideration hereby agree and guarantee, to hold the Board of
County Commissioners of Collier County, Florida, as the governing body of Collier
County and as the Ex-Officio Governing Board of the Collier County Water-Sewer
District harmless against any lien, claim or suit by any general contractor,
subcontractor, sub-subcontractor, supplier, mechanic, material-man' or laborer, and
against chattel mortgages, security interests or repair of the subject utility system(s) or
