Agenda 09/14/2021 Item #16B 3 (Budget Amendment to recognize carryforward in the Bayshore CRA and Immokalee CRA Funds)09/14/2021 EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners, acting as the Community Redevelopment Agency Board, authorize necessary budget amendments to recognize carryforward in Bayshore CRA Fund (187) and Immokalee CRA Fund (186) and transfer those moneys along with capital reserve balances into Bayshore CRA Capital Fund (787) and Immokalee CRA Capital Fund (786), and appropriate those funds plus the reserves in Bayshore CRA Capital Project Fund (787) into specific projects pursuant to the Community Redevelopment Plan. OBJECTIVE: To ensure compliance with 163.387(7) Florida Statutes by appropriating funds to specific projects pursuant to the approved community redevelopment plan for the Bayshore Gateway Triangle Community Redevelopment Area (Bayshore CRA) and Immokalee Community Redevelopment Area (CRA). CONSIDERATIONS: Section 163.387(7), Florida Statutes, requires that on the last day of a CRA’s fiscal year, any moneys remaining in the CRA’s trust fund after the payment of expenses pursuant to State law shall be: • Returned to each taxing authority which paid the increment in the proportion that the amount of the payment of such taxing authority bears to the total amount paid into the trust fund by all taxing authorities for that year. • Used to reduce the amount of any indebtedness to which increment revenues are pledged. • Deposited into an escrow account for the purpose of later reducing any indebtedness to which increment revenues are pledged. • Appropriated to a specific redevelopment project pursuant to an approved community redevelopment plan. The funds appropriated for such project may not be changed unless the project is amended, redesigned, or delayed, in which case the funds must be reappropriated pursuant to the next annual budget adopted by the Board of Commissioners of the community redevelopment agency. Appropriating funds to specific redevelopment plan projects pursuant to the approved community redevelopment plan will assist in achieving compliance with Section 163.387(7), Florida Statutes and allow the continued implementation of the community redevelopment plan. FISCAL IMPACT: Bayshore CRA Fund (787) and Immokalee CRA Fund (786) have been established to budget for Collier County CRA projects. The budget actions will allocate funds to projects consistent with the approved redevelopment plan. For Immokalee CRA, in Fund (186) reserves of $974,300 and unappropriated carry forward of $477,400 totaling $1,451,700 will be transferred to Immokalee Capital Fund (786) and budgeted as follows: Project/Program Budget Main Street Corridor 423,700 Stormwater 278,000 South Immokalee Sidewalk 250,000 First Street Corridor 250,000 Neighborhood Revitalization Community Safety 100,000 Parks and Recreation Partnership 50,000 Commercial Rehab Grants 100,000 16.B.3 Packet Pg. 1703 09/14/2021 Total 1,451,700 For Bayshore CRA, in Fund (187) reserves of $1,380,500 and unappropriated carry forward of $1,649,800 totaling $3,030,300 will be transferred to Bayshore Capital Fund (787). That $3,030,300 transfer along with reserves of $1,500,000 in Bayshore Capital Fund (787) will be budgeted in projects as follows: Project/Program Budget 17 Acre Site 1,698,000 Linewood Beautification 450,000 North Bayshore Dr Renovation 750,000 General Road Improvements 500,000 Public Art Funding - art pieces and events 100,000 Stormwater Program 1,032,300 Total 4,530,300 LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved for form and legality and requires a majority vote for Board acceptance. -JAK GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan.
