WIT N E SSE T H:
WHEREAS, County is the fee simple owner of the area described in Exhibit
"AU; and
WHEREAS, pursuant to the terms and conditions contained in the Quit-Claim
Deed from Coral Ridge-Collier Properties, Inc. to County recorded in Official Records
Book 966, page 1841, the Declaration of Restrictions recorded in Official Records Book
966, page 1830, and the Grant of Easement from Westinghouse Communities of
Naples, Inc. to Bay Colony Community Association, Inc, recorded in Official Records
Book 1381, page 365, WCI is holder and owner of certain rights over, under, and across
the area more particularly described in Exhibit "A"; and
WHEREAS, County wishes to give a perpetual, non-exclusive Grant of
Easement to the BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY,
FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY AND AS EX-OFFICIO
THE GOVERNING BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT,
its successors and assigns, (hereinafter referred to as "CCWSD"), for utility and access
purposes, including but not limited to right to enter upon said land, excavate, and place
or remove materials for the purpose of constructing, operating, and maintaining utility
facilities, over, under, upon, and across a portion of the area legally described in Exhibit
"A", attached hereto and incorporated herein by virtue of this reference, (which
premises are herein referred to as the "Easement"); and
WHEREAS, County has requested that WCI consent to the granting of the
Easement to CCWSD and WCI has so agreed.
NOW, THEREFORE in consideration of Ten Dollars ($10.00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, WCI does hereby consent to the granting of the above-referenced
Easement by County to CCWSD.
IN WITNESS WHEREOF, WCI has executed this Consent to Grant of Easement
on the day and year first above written.
