Agenda 09/14/2021 Item #16A 2 (Final Acceptance for Abaco Pointe Phase 1 PL20190002237)09/14/2021 EXECUTIVE SUMMARY Recommendation to approve final acceptance and accept the conveyance of the potable water and sewer utility facilities for Abaco Pointe Phase 1, PL20190002237 and authorize the County Manager, or his designee, to release the Final Obligation Bond in the total amount of $4,000 to the Project Engineer or the Developer’s designated agent. OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the Collier County Water-Sewer District, approve final acceptance and accept the conveyance of these potable water and sewer facilities and to release the Final Obligation Bond in the total amount of $4,000, in accordance with the Collier County Utility Standards and Procedures, Ordinance No. 2004-31. CONSIDERATIONS: 1) The Developer of Abaco Pointe Phase 1, has constructed the potable water and sewer facilities within dedicated easements to serve this development. (See attached location map). The potable water and sewer facilities were offered for conveyance to the County, as described in OR Book 5718, Page 460, and are located within County utility easements dedicated by the plat of Abaco Pointe, recorded in Plat Book 66, Pages 61 through 64 of the Public Records of Collier County, Florida. 2) Preliminary acceptance of these utility facilities was approved by the Development Review staff on January 16, 2020. At that time, the value of these potable water and sewer utility facilities (assets) was $62,929.50 and $87,462.00, respectively. 3) Staff recorded all preliminary acceptance documents associated with the facilities being conveyed to the County in the public records of Collier County, which were reviewed and approved by the County Attorney’s office as to form and legality. The County acquired its record interest in the potable water and sewer facilities by Utility Facilities Special Warranty Deed recorded in Official Records Book 5718, at Page 460 (“The Utilities Facilities Deed”) of the Public Records of Collier County, Florida. 4) The potable water and sewer utility facilities have been operated and maintained during the required one (1) year warranty period, following preliminary acceptance. 5) A final inspection to discover defects in materials and workmanship has been conducted by the Development Review staff on June 11, 2021, in coordination with Public Utilities and these facilities have been found to be satisfactory and acceptable. 6) Staff recommends final acceptance of the subject utility facilities and to release the Final Obligation Bond in the total amount of $4,000. Staff also recommends acceptance of the Utilities Facilities Deed and the facilities described in the Certification of Contributory Assets, which is attached to this Executive Summary. 7) This final acceptance is in accordance with Collier County Ordinance No. 2004-31, as amended. 8) Staff is unaware of any issues that would serve to negate the recommendation to release the applicable security. 16.A.2 Packet Pg. 351 09/14/2021 FISCAL IMPACT: Approval of this Executive Summary will result in the Collier County Water-Sewer District receiving title to the utility facilities, which at the time of preliminary acceptance, had a total gross value of $150,391.50 (no depreciation applied) and an asset will be recorded in the financial records of the county. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval. -DDP RECOMMENDATION: To approve final acceptance and the conveyance of the potable water and sewer utility facilities for Abaco Pointe Phase 1, PL20190002237, accept the conveyance of the Utilities Facilities Deed and the facilities described in the Certification of Contributory Assets, and to authorize the County Manager, or his designee, to release the Final Obligation Bond in the total amount of $4,000 to the Project Engineer or the Developer’s designated agent.
