THIS CAUSE came on for public hearing before the Special Magistrate on June 4, 2021, and the
Special Magistrate, having heard argument respective to all appropriate matters, hereupon issues her
Findings of Fact, Conclusions of Law and Order of the Special Magistrate, as follows:
FINDINGS OF FACT and CONCLUSIONS OF LAW
1. Respondent, D R HORTON INC,is the owner of the subject real property located at 15112
Wildflower Circle,Naples, Florida 34119, Folio No. 59953003668.
2. Respondent was duly notified of the date of hearing by certified mail and posting, and was
represented at the hearing by James Mackin,Area Construction Manager for D R HORTON
INC, who entered into a Stipulation on behalf of Respondent.
3. The subject real property owned by Respondent is in violation of the Collier County Code of
Laws and Ordinances, Chapter 134, Article VI, Section 134-174(N)in the following particulars:
Illegally connecting an unapproved PVC pipe device directly to a County
potable water curb stop without a meter or backflow assembly installed.
4. The violation was not abated as of June 4, 2021,the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority
granted in Chapter 162, Florida Statutes, and Collier County Ordinance No. 07-44, as amended,
IT IS HEREBY ORDERED:
A. Respondent is found guilty of violation of the Collier County Code of Laws and Ordinances,
Chapter 134,Article VI, Section 134-174(N).
B. Respondent is ordered to pay a civil penalty of$15,000.00,operational costs in the amount
of$50.00 incurred in the prosecution of this case and an administrative fee in the amount of
$5.00,for a total amount of$15,055.00 to be paid on or before July 2,2021.

down to the ground from up-right position and back-leg pulled up to illegally
connect a water valve with a hose going into a bucket.
4. The violation was not abated as of June 4, 2021,the date of the public hearing.

THIS CAUSE came before the Special Magistrate for public hearing upon the Petitioner's Motion
for Imposition of Fines/Liens on June 4, 2021, and the Special Magistrate, having heard argument
respective to all appropriate matters, hereupon issues her Findings of Fact, Conclusions of Law and Order
of the Special Magistrate, as follows:
FINDINGS OF FACTS AND CONCLUSIONS OF LAW
1. Respondent,FONTINO MENDEZ,is the owner of real property located at 3610 White Blvd,
Naples, Collier County, Florida 34117, Folio No. 37987760009, on which the violations
occurred.
2. On October 2,2020, Respondent was found guilty of violation of the Collier County Land
Development Code 04-41,as amended, Section 2.02.03, and Collier County Code of Laws and
Ordinances, Chapter 54, Article VI, Section 54-181 and Section 54-185(b).
3. An Order was entered by the Special Magistrate ordering Respondent to abate the violations on or
before October 9, 2020, or a fine of$100.00 per day would be assessed for each day the
violations continue thereafter until abatement is confirmed. (The Order is recorded at Collier
County Records,OR 5837,PG 312).
4. Respondent was not in compliance with Part C of the Order for the period from October 10, 2020
to June 3, 2021 (237 days)at a rate of$100.00 per day, for a total fine amount of$23,700.00.
5. Respondent was not in compliance with Part D of the Order for the period from October 10, 2020
to January 11, 2021 (94 days)at a rate of$100.00 per day, for a total fine amount$9,400.00.
6. The violation was abated as of June 3,2021.
7. Previously assessed operational costs of$111.70 have been paid.
8. Respondent,having been properly noticed for the public hearing on the County's Motion,was
present for the hearing.
ORDER
Based upon the foregoing Findings of Fact, and pursuant to the authority granted in Chapter 162,
Florida Statutes, and Collier County Ordinance No. 07-44, as amended,
IT IS HEREBY ORDERED:
A. Petitioner's Motion for Imposition of Fines/Liens is GRANTED.
B. Fines are imposed for both Part C and Part D of the Order in the total amount of$2,500.00.
C. Respondent shall also pay operational costs for today's hearing in the amount of$111.80.
D. Respondent is ordered to pay fines and costs in the total amount of$2611.80.
E. This Order shall be recorded in the Public Records of Collier County, Florida and shall constitute

ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority
granted in Chapter 162, Florida Statutes, and Collier County Ordinance No. 07-44, as amended,
IT IS HEREBY ORDERED:
A. Respondent is found guilty of violation of the Collier County Code of Laws and Ordinances,
Chapter 130,Article III, Section 130-96(a).
B. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of
$111.7.con or before July 5,2021.
C. Respondent must abate the violation by relocating the offending boat and trailer to an
enclosed structure, rear yard or adjacent to the waterway(as permitted), OR by removing
the offending boat and trailer from the property on or before July 5,2021,or a fine of
$50.00 per day will be imposed until the violation has been abated.
D. Respondent shall notify the Code Enforcement Investigator within 24 hours of abatement of r
compliance so that a final inspection may be performed to confirm compliance.
E. If Respondent fails to comply with this Order,the Collier County Code Enforcement Division
may abate the violation using any method to bring the violation into compliance. If necessary,the
County may request the services of the Collier County Sheriffs Office in order to access the
property for abatement. All costs of abatement shall be assessed against the property owner and
become a lien on the property.

Respondent is found to have been in violation at the time and on the date of issuance of the
Notice of Violation to the Respondent.
B. Respondent is ordered to pay the operational costs in the amount of$111.70 incurred in
prosecuting this case on or before August 2,2021.
C. Respondent is also ordered to pay a civil penalty in the amount of$500.00 for this repeat

THIS CAUSE came before the Special Magistrate for public hearing upon the Petitioner's Motion
for Imposition of Fines/Liens on July 2,2021,and the Special Magistrate,having heard argument respective
to all appropriate matters, hereupon issues her Findings of Fact, Conclusions of Law and Order of the
Special Magistrate, as follows:
FINDINGS OF FACTS AND CONCLUSIONS OF LAW
1. Respondent, ALEJANDRA LYNCH, is the owner of real property located at 5330 Broward
Street,Naples, Florida 34113, Folio No. 62260040000, on which the violation occurred.
2. On February 5,2021 Respondent was found guilty of violation of the Collier County Code of
Laws and Ordinances, Chapter 130,Article III, Section 130-97(5)
3. Respondent was ordered to abate the violation on or before March 5, 2021 or a fine of$100 per
day would be assessed and imposed until the violation is abated. (A copy of the Order is recorded
at OR 5921, PG 125).
4. Previously assessed operational costs of$111.65 incurred by the County in the prosecution of
this case have not been paid.
5 The violation had not been abated as of July 2,2021,the date of the public hearing.
6. Fines continue to accrue.
7. Respondent, having been duly noticed for the public hearing regarding the County's Motion,was
not present at the public hearing.
ORDER
Based upon the foregoing Findings of Fact, and pursuant to the authority granted in Chapter 162,
Florida Statutes, and Collier County Ordinance No. 07-44, as amended,
IT IS HEREBY ORDERED:
A. Petitioner's Motion for Imposition of Fines/Liens is GRANTED.
B. Fines of$100.00 per day are assessed against Respondent for the period from March 6, 2021 to
July 2, 2021 (119 days) for a total fine of$11,900.00.
C. Fines continue to accrue until abatement of the violation.
D. Respondent is ordered to pay previously assessed but unpaid operational costs of$111.65.
E. Respondent shall also pay operational costs for today's Imposition of Fines hearing in the
amount of$111.75.
F. Respondent is ordered to pay fines and costs in the total amount of$12,123.40 or be subject
