I previously entered an appearance in Code Enforcement Case No. CEN20210002604, which was settled earlier this year through Stipulation. I was not previously sent a copy of the Final Order of the Magistrate although I was counsel fo record, and so I requested a copy from my client. Upon review, I am extremely disappointed that the Magistrate's Order (which 1 presume was submitted through your office) is not consistent with the Stipulation, which I discussed with your staff the morning of the hearing. Packet Pg. 119 9.A.1.a I have attached copies both the Stipulation and Order for reference. In particular, the Stipulation was particuIart❑ Naples 2.0, LLC, which admitted to an adjudication for violation of the Noise Ordinance. However, in regard to Celebration Park, LLC, this was a first notice of Code Violation, and so pursuant to the Code, this would not result in an adjudication of violation in regard to its Amplified Sound Permit. This point of the Stipulation was specifically discussed with your staff prior to submission and counter -signature by the county, and either Mr. Ossorio or you and I spoke by phone immediately prior to the hearing regarding this point. Equally importantly, before leaving the hearing room that morning to attend to other business, I obtained assurances by your staff that if the Stipulation was not accepted as signed, then the hearing would be continued. In light of the error, I would ask that the County either (a) agree to an Amended Order for consideration and execution by the Magistrate, making it clear that there is no adjudication against Celebration Park, LLC in regard to its Amplified Sound Permit, though acknowledging that a notice of violation and warning have been issued (such that the next violation is subject to an adjudication); or (b) issue a simple written clarification to Celebration Park, LLC on which we can rely at a future hearing attesting to the same, should the client run afoul of the noise ordinance in the future. If the County is resistant to either of these solutions, then I have no choice but to presume that this was not, in fact, a mistake, but intentional on your part and thus fraud on the court, and I will have to seek more formal relief by Petitioning the Magistrate for a re- hearing and resulting corrective Order. I certainly would not have left the hearing and relied on both the clear verbiage of the signed Stipulation and the assurances of your staff had I known that the County intended to go outside of the Stipulation and the clear letter of the Code to the detriment of my client. 1 respectfully request that you forward this correspondence to your counsel for review and resolution as soon as possible.
