WITNESSETH
WHEREAS, on September 22, 2020, Agenda Item 16.D.11, the COUNTY entered into an
Agreement with the Collier County Sheriff's Office to administer the Department of Justice - Bureau of
Justice Assistance,Emergency Supplemental Funding Program.
WHEREAS, the parties wish to amend the Agreement to increase the amount of grant funds
awarded.
NOW,THEREFORE, in consideration of the mutual promises and covenants contained herein,the
parties hereto agree to amend the Agreement as set forth below.

1.4 AGREEMENT AMOUNT
The COUNTY agrees to make available TWO HUNDRED AND ONE THOUSAND, TWO
HUNDRED AND SIXTY FIVE DOLLARS AND 00 CENTS ($201,265.00) TWO HUNDRED
AND EIGHTEEN THOUSAND, ONE HUNDRED AND TWENTY SEVEN DOLLARS
($218,127.00) for use by the SUBRECIPIENT, during the term of the Agreement (hereinafter,
referred to as the"Funds").
Modifications to the"Budget and Scope"may only be made if approved in advance.Budgeted fund
shifts between line items shall not be more than 10 percent of the total funding amount. Fund shifts
that exceed 10 percent of the Agreement amount shall only be made with Board of County
Commissioners (Board) approval.
The COUNTY shall reimburse the SUBRECIPIENT for the performance of this Agreement upon
completion or partial completion of the work tasks, as accepted and approved by CHS.
SUBRECIPIENT may not request disbursement of CESF funds until funds are needed for eligible
costs, and all disbursement requests must be limited to the amount needed at the time of the
request. SUBRECIPIENT may expend funds only for allowable costs resulting from obligations

incurred during the term of this Agreement.Invoices for work performed are required every month.
If no work has been performed during that month, or if the SUBRECIPIENT is not yet prepared to
send the required backup, a $0 invoice will be required. Explanations will be required if two
consecutive months of$0 invoices are submitted. Payments shall be made to the SUBRECIPIENT
when requested as work progresses but,not more frequently than once per month. Reimbursement
will not occur if SUBRECIPIENT fails to perform the minimum level of service required by this
Agreement.
Final invoices are due no later than 90 days after the end of the Agreement. Work performed during
the term of the program but not invoiced within 90 days after the end of the Agreement may not be
processed without written authorization from the Grant Coordinator.
The County Manager or designee may extend the term of this Agreement for a period of up to 180
days after the end of the Agreement. Extensions must be authorized, in writing, by formal letter to
the SUBRECIPIENT.
No payment will be made until approved by CHS for grant compliance and adherence to any and
all applicable Local, State, or Federal requirements. Payment will be made upon receipt of a
properly completed invoice and in compliance with §218.70, Florida Statutes, otherwise known as
the"Local Government Prompt Payment Act."
1.6 NOTICES
Notices required by this Agreement shall be in writing and delivered via mail (postage prepaid),
commercial courier, personal delivery, or by facsimile or other electronic means. Any notice
delivered or sent as aforesaid shall be effective on the date of delivery or sending. All notices and
other written communications under this Agreement shall be addressed to the individuals in the
capacities indicated below, unless otherwise modified by subsequent written notice.

SUBJECT TITLE: DELINEATION OF RESPONSIBILITY

APPLICABILITY: ALL MEMBERS
PURPOSE -The purpose of this directive is to describe levels and lines of authority and to set
forth details related to chain of command.
1.3.1 DESCRIPTIONS OF DUTIES AND RESPONSIBILITIES:
The CCSO shall maintain, through its Human Resources Bureau, updated statements of the
duties and responsibilities of each position assignment within the CCSO. Position descriptions
for each organizational component are available to all CCSO members.
1.3.2 ACCOUNTABILITY:
A. Every member of the CCSO is given the appropriate authority to execute effectively
his/her defined area of responsibility.
B. All members are accountable for the proper use of delegated authority, as well as for the
failure to use (proper) authority when necessary.
C. All supervisors are accountable for the activities of members under their immediate
control.
1.3.3 ORDER OF SUCCESSION:
A. In the temporary absence of the Sheriff, his responsibilities shall shift to the Undersheriff.
B. In the temporary absence of the Sheriff, and the Undersheriff, the responsibilities of the
Sheriff shall shift to the department chiefs who carry the rank of Major in order of
seniority (in order of appointment to Major), then successively to the division captains in
order of seniority (in order of appointment to Captain).
1.3.4 DESCRIPTIONS OF RANK:
A general description of each rank is as follows:
A. The Sheriff is the chief law enforcement officer in the county. The authority of the
Sheriff in law enforcement matters is paramount throughout the unincorporated and
incorporated areas.

1. The Sheriff has the authority and responsibility for the management, direction,
and control of the operations and administration of his Office. These
responsibilities include (but are not limited to):
a. Preservation of the peace
b. Protection of life and property
c. Prevention of crime
d. Detection of violations and enforcement of all laws over which the Sheriffs
Office has jurisdiction
e. Service of civil and criminal process issued from the various courts
f. Attendance at all terms of circuit and county court within Collier County
g. Attendance at designated meetings of the Collier County Board of
Commissioners
h. Fiscal management
2. In order to carry out the many functions of the CCSO, the Sheriff may appoint
certified deputies to act as his alter ego with his same power. The Sheriff is
responsible and liable for the actions of his Deputies. The Sheriff possesses sole
authority over the selection, appointment, and release from duty of members,
and the setting of salaries.
3. The Sheriff has the power to prescribe, promulgate, and enforce Agency policies,
procedures, orders, rules, and regulations consistent with the Florida and U.S.
Constitution, Federal and state laws, and county ordinances for the administration
of the CCSO.
4. Only the Governor has the authority to investigate the Sheriff for misfeasance,
malfeasance, or nonfeasance. As a Constitutional Officer in Collier County, the
Sheriff submits his budget to the County Commission for approval. If the
Commission disapproves, the Sheriff may elect to exercise his authority to appeal
to the Florida Cabinet.
B. UNDERSHERIFF—appointed by the Sheriff and serves as the second in command for the
agency, reporting directly to the Sheriff. The Undersheriff directly supervises Department
Chiefs and shares delegated responsibility and authority for the oversight of the agency.
All agency positions, except the Sheriff, are subordinate to the Undersheriff. The
Undersheriff directs all Department Chiefs and is responsible for policy formulation and
review, direction of internal review processes and agency evaluations and formal reports
to the Sheriff.
C. CHIEF OF OPERATIONS, CHIEF OF INVESTIGATIONS, CHIEF OF ADMINISTRATION,
CHIEF OF CORRECTIONS, CHIEF OF COMMUNITY ENGAGEMENT, AND CHIEF OF LEGAL
&COURT SERVICES are appointed by the Sheriff to coordinate, manage, and direct
their individual department's activities and services, and recommend and administer
CCSO policies, priorities and procedures.
Department Chiefs will provide administrative assistance to the Sheriff and the
Undersheriff, assist in development, planning, and implementation of CCSO goals and
objectives and evaluate and address changing patterns of criminal activity and other
concerns of the Sheriffs Office.

D. CERTIFIED POSITIONS:
1. Captain — usually appointed by the Sheriff to command a larger division. Division
Captains report directly to the appropriate Department Chief.
a. Captains plan, organize, implement policy and procedure, rules, and
regulations and direct the activities of their respective divisions.
b. Captains have the authority to issue orders for their divisions consistent
with those of the Sheriff.
2. Commander — usually commands smaller divisions or multiple bureaus and/or
geographically deployed elements. Commanders serve under the supervision
and control of the assigned Captain or Chief of the responsible
division/department. Commanders promote policy revision, policy compliance
and review through contact with field and operational elements and act as
liaison to CCSO HQ for policy communication. Commanders are authorized to
interpret policy and direct operational elements of the Agency. Commanders
who are responsible for a Division shall have the same administrative approval
authority otherwise afforded to a Captain.
3. Lieutenant - commands a bureau/district/shift, under the control of the respective
Captain/Director and/or Commander. Lieutenants have the authority to issue
orders for those under their command as long as they are consistent with those of
the Sheriff.
4. Sergeant - supervises a section or shift, under the command of a lieutenant; and
personally performs patrol, investigative, special assignments, public service,
arrest, confinement, and administrative duties.
5. Corporal — generally a non-supervisory position, performs law enforcement, crime
prevention, traffic control, public service, bailiff, and jail facility duties on a regular
basis.
6. Certified Deputy - performs law enforcement, crime prevention, traffic control,
public service, bailiff, and jail facility duties.
7. Rank may be assigned by the Sheriff based on experience required by a specific
position, i.e. Executive Officer or Legal Staff.
E. CIVILIAN POSITIONS:
1. Division Director - the equivalent of a Captain; commands either the
Communication Services, Information Technology, Finance, or Human Resources
Division. Directors usually answer directly to the Chief of Administration.
2. Bureau Manager- the equivalent of a Lieutenant; under the control of the
applicable Division Captain or Director.
3. Section Supervisor - the equivalent of a Sergeant; personally performs
administrative duties under the control of a Lieutenant or Bureau Supervisor.
4. Civilian Member - performs administrative and/or support duties.
F. Community Service Deputy - Uniformed, non-certified members who perform quasi-law
enforcement, crime prevention, traffic control, public service, and support duties.

A. In order to achieve effective direction, coordination, and control, the number of
members under the immediate control of a supervisor shall not exceed 15. However, the
optimum span of control depends upon a number of considerations. (Patrol operations
span of control is reflected in 0-1.1.)
B. It shall be the responsibility of the Captains and Directors to periodically review the span
of control of all supervisory members under their command in order to maintain the
efficiency of both the supervisors and their subordinates. In doing so, a minimum of the
following should be considered:
1. The competence of both the supervisor and the subordinates;
2. The degree of inter-action between the units or members;
3. The extent to which the supervisor must carry out non-managerial responsibilities,
and the demands on his/her time from other people and units;
4. The similarity or dissimilarity of the activities being supervised;
5. The incidence of new problems in a unit;
6. The extent of standardized procedures;
7. The degree of physical dispersion of subordinates.
C. The optimum span of control may vary considering the above factors, therefore
emphasis should be placed on stability and predictability when considering a specific
situation.
1.3.6 COMMAND RESPONSIBILITY:
A. Each member will be directly accountable to only one supervisor at any given time.
B. Each organizational component shall be under the direct command of only one
supervisor.
C. Command responsibility during an operation involving members from different
components within the CCSO shall be assumed by the following:
1. Major operation (long-term) - the supervisor of the component responsible for the
operation, or a person designated by the Sheriff.
2. Crime scene - the ranking investigator.
3. Traffic accident - the ranking STEP Deputy.
4. Incident requiring Special Response Bureau - the ranking Special Response
Bureau Deputy.
1.3.7 RESPONSIBILITY TO OBEY ORDERS:
A. All members shall obey any lawful order of a supervisor, including any order relayed from
a supervisor through a member of the same or lesser rank.
B. In cases where a member receives a conflicting lawful order, it shall be the duty of the
member receiving the order to first advise the supervisor of the conflict. Should that
supervisor not alter or retract the order, it shall be the duty of the member to obey it. In
such cases, the member given the order shall not be responsible for disobedience of the

order or directive given previously; however, the supervisor shall assume full
responsibility for the consequences of his/her action.
C. Members receiving an order from a supervisor that is clearly unlawful are under no
obligation to follow that order. Members must be certain of the legal status of the order,
simply"believing"that the order is illegal is not a defense for having refused to carry out
a lawful order. Conversely, members can be held liable for knowingly carrying out an
order known to be a violation of law.
1.3.8 CHAIN OF COMMAND:
A. Memoranda or correspondence will normally be submitted through the member's specific
chain of command for review and signature by each supervisory level within the chain
and forwarded by each supervisor to the designated member.
B. Unless specifically directed to respond directly to the Sheriff, or otherwise specified in the
CCSO Operations Manual, memoranda from agency members shall be submitted through
their chain of command for review and comment as appropriate.
C. If the Sheriff, Undersheriff, Department Chief, or Division Captain/Director specifically
request a direct response, the member's immediate supervisor will be notified, if
appropriate, i.e. time and circumstances permitting, and the memoranda/
correspondence will proceed directly to the requestor.
1.3.9 SHERIFF'S OPEN DOOR POLICY:
The Sheriff's open door policy is extended to all members regardless of rank or assignment.
The following restrictions shall apply:
A. Discussion of problems or issues within individual unit/section/bureau/division should be
directed first to the member's immediate supervisor. If the issue is with the member's
immediate supervisor, then the member should speak with the next supervisory level
until each level has been exhausted. This process should continue until the chain of
command is exhausted at the Chiefs level. The problem can then be directed to the
Sheriff. This process ensures that supervisors have the opportunity to exercise their
experience/authority to address the issue(s), and/or solve the problem.
B. If the problem/issue is sensitive, an immediate agency wide emergency, or the directions
stated in paragraph "A"above are not feasible, then direct contact with the Sheriff,
Undersheriff, or Department Chief is directed.
C. It is preferred that members call the Sheriff's secretary to schedule an appointment date
and time, or the member may chance that the Sheriff is available and can meet the
member on the spur of the moment.
