Special Magistrate Garretson found the Respondent GUILTY of the alleged violation and ordered him to: 1. Pay Operational Costs in the amount of $111.75 incurred in the prosecution of this case by August 2, 2021. 2. Obtain all required Collier County Building Permit(s), Inspections and Certificate of Completion/Occupancy by September 2, 2021 or a fine of $100.00 per day will be imposed until the violation is abated. 3. Notify Code Enforcement Investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the Respondent fails to abate the violation the County may abate the violation and may use the assistance of the Collier County Sheriff’s Office to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property owner. The Stipulation was entered into by the Respondent’s representative Greg Carlisle on July 2, 2021. ** Special Magistrate Garretson noted the Respondent must provide documentation the agreement was signed on July 2, 2021 given the July 3, 2021 date indicated on the Stipulation is a scrivener’s error. Special Magistrate Garretson found the Respondent GUILTY of the alleged violation and ordered them to: 1. Pay Operational Costs in the amount of $50.00 incurred in the prosecution of the case. 2. Pay an Administrative Fee of $5.00. 3. Pay a Civil Penalty of $2,000.00 for a total amount due of $2,055.00 payable before August 2, 2021. 4. Abate the violation by removing all refuse around the dumpster and dispose of in a suitable manner by July 7, 2021 or a fine of $100.00 per day will be imposed until the violation is abated. FOLIO NO: 68099520009 PROPERTY ADDRESS: 3320 Balboa Circle W, Naples, FL 34105 Mike Oreus, son of Image Oreus was present. Special Magistrate Garretson queried if Ms. Oreus knew Mr. Oreus was present and representing her at the hearing. Mr. Oreus reported his mother is out of the Country, aware of the violation but not the convening of a hearing today on the matter. Special Magistrate Garretson expressed concern proceeding with the hearing based on Mr. Oreus testimony he is not the legal owner of the property. Manager Letourneau stated proper notice was given by Certified Mail (6/16/21) and the Property and Courthouse were posted (6/16/21). He had no objection to allowing Mr. Oreus to testify in the proceeding. Special Magistrate Garretson decided to hear the case based on the fact sufficient notice was provided to Ms. Oreus. Officer Cathey presented the case. Evidence Entered: Composite Exhibit A: 4 photos dated 4/12/21 Composite Exhibit B: 3 photos dated 7/1/21 Exhibit C: Aerial photo of the property Exhibit D: Building Official’s determination a permit is required Mr. Oreus testified:  He was raised on the property, acquiring title to the home and intends to obtain the necessary permits and abate the violation.  His acquisition was delayed due to a scrivener’s error by the attorney representing him.  He showed Special Magistrate Garretson a copy of the documentation (housed on his phone) the attorney filed to correct the scrivener error. Special Magistrate Garretson requested Mr. Oreus provide a copy of the documentation to County Staff for their records. Manager Letourneau stated the case would be WITHDRAWN and remain open and a hearing will be requested in the future if necessary. VII. NEW BUSINESS B. MOTION FOR IMPOSITION OF FINES AND LIENS 5. CASE NO: CEPM20190002611 OWNER: Bertha S Hall Et Al OFFICER: John Connetta July 2, 2021 5 VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 22, Article VI, Sections 22-231(12)(c) and 22-231(12)(n). Vacant dwelling with roof damage and a damaged accessory structure (shed). FOLIO NO: 56403440004 PROPERTY ADDRESS: 209 Eustis AVE E, Immokalee, FL 34142 Officer Connetta represented the County noting the violation has not been abated. Myrtle Elaine Perdue, daughter of Ms. Hall was present noting she is one of the “Et Al” listed for the case. She manages the estate of Ms. Hall. Mr. Connetta testified 4 permits have been applied for on the property in order to abate the violation. Three were cancelled and the current one is active, but in “rejection status” as of 3/3/21. Ms. Perdue testified:  They have hired contractors to assist in abating the violation however they may not be familiar with the requirements of Collier County.  One major issue is the improvements proposed are in excess of 50 percent of the value of the structure and the home is required to be elevated to meet the recently adopted FEMA requirements.  The home is the former residence of Bertha Hall, the first African American school teacher in Collier County.  The family wishes to retain the home and restore it for historical reasons, and no one currently resides on the property.  She requested additional time to abate the violation and is working with Renald Paul of the building department to obtain the necessary permits. Manager Letourneau had no objection to continuing the case. Special Magistrate Garretson CONTINUED the case until January of 2022. Recessed: 10:47 a.m. Reconvened: 11:00 a.m. VIII. Date of Hearing Notice by Certified Mail: 6/16/21 Date of Hearing Notice Property/Courthouse Posting: 6/9/21 July 2, 2021 6 Officer Musse represented the County and testified the violation was abated on 7/1/21 however the property is the site of repeat violations with 32 cases opened since 1996. He provided 8 photos from 4/22/21 depicting the storage on site prior to the abatement. Special Magistrate Garretson, finding the Notice of Hearing was properly served, found the Respondent GUILTY of a repeat violation for outside storage at the time the Notice of Violation was issued and ordered her to: 1. Pay Operational Costs in the amount of $111.70 incurred in the prosecution of the case by August 2, 2021. 2. Pay a Civil Penalty for a repeat violation in the amount of $500.00 by August 2, 2021.
